PLANNING BOARD
Town of Lansing
SUBDIVISION CONTROL POLICY STATEMENT
It is declared to be the policy of the Lansing Planning Board
to consider land subdivision plats as an objective toward the goal
of orderly and efficient residential , commercial and recreational
development consistent with the preservation of the rural- residential
open-space integrity of the Town of Lansing . This shall be ; inter-
preted to include the following considerations which shall guide the
Planning Board ' s decision .
A . Land to be subdivided shall be of such character that
it can be used safely for building purposes without
danger to health or peril from fire , flood , or other
menace .
B . Proper provisions shall be made for drainage , water
supply , sewage , and other needed improvements and
utilities .
C . Proposed streets shall compose a convenient system
conforming to the Highway Superintendent ' s specifica-
tions , and those of the Lansing Planning Board , and
shall conform to existing streets and surrounding
environment .
PLANNING BOARD
Town of. Lansing
PROCEDURE FOR SUBDIVISION APPROVAL
1 . Subdivider shall submit application form to Town Clerk
regular meeting Minimum of 5 days before a g of the Planning Board
2 . Subdivider shall attend a regular meeting of the Planning Board
A * '11 Submit basic site plan sketch ( 2 copies ) *
1 . Show topographic features
2 . Proposed lots
3 . Proposed location of buildings , if any
4 . Proposed streets
5 . Proposed water and sewer facilities
3 . Subdivider shall submit a Preliminary Layout to Planning Board
A . Three copies necessary showing #2 ( A ) 1 - 5 *
B ., Planning Board review and discussion with Subdivider
C .'� Planning Board advises Subdivider in writing of changes ii which will be
required before conditional approval of Preliminary Layout
4 .
(Within 4.5 days after #3 ) Planning Board shall review for compliance with #3 ( C )
and take - action on Preliminary Layout
A : Conditionally approves with or without modifications OR
B . Disapproves , stating reasons in writing
5 . ( Within 6 months after #4 ( A ) above ) Subdivider shall submit final subdivision
• plat and supporting data to the Planning Board at a regular meeting ( the Town
Clerk should receive the material at least 5 days prior to the meeting ) .
A Two copies of all supporting data required by the Planning Board
B4 Four copies of plat required ( 2 cloth and 2 paper ) by the Planning Board
1 . If a Tompkins County Health Department subdivision , one cloth and
one paper copy to the Health Department .
2 . Each copy must show Health Department approval , if applicable
Planning Board reviews final plat for compliance and installation of
improvements .
6 . (Within 30 days after #5 ) The Planning Board shall hold a public hearing .
7 . ( Within 45 days after #6 ) Planning Board shall take action on . final plat .
A ; Approve
B . Disapprove
1 . Meeting with Subdivider to explain reason for disapproval .
8 . Approved Subdivision Plat
A ; Town Clerk , one cloth copy ; Planning Board , one paper copy ; ( Health
Department , one cloth and one paper copy ) ; Subdivider,i, one cloth and one
paper copy ; one paper copy for each lot in the subdivision .
9 . Suseivider shall file one cloth copy of Plat with County Clerk within 90 days of
#7 ( A ) or it must again be submitted to the Planning Board before filing .
* Also required for a proposed Tompkins County Health Department, subdivision ,
defined as five ( 5 ) or more lots outside of a water and sewer district .

DEP INITIONS
DEAD-END STREET : means a street or a portion of a street with only
one vehicular outlet .
EASEMENT : means authorization by a property owner for the use
by another , and for a special purpose , of any
designated part of his property .
SUBMISSION DATE : means the date when a Subdivision Plat shall be
considered submitted to the Planning Board , as
provided in Section 276 of the Town Law , and is
hereby defined to be the date of a meeting of the
Planning Board at which all required surveys ,
plans and data are submitted .
PRELIMINARY means the preliminary drawing or drawingsin -
LAYOUT : dicating the proposed manner or layout of, the
subdivision to be submitted to the Planning
Board for its consideration .
STREET : means and includes streets , roads , avenues ,
lanes , or other ways .
SUBDIVIDER : means any person , firm , corporation , partnership ,
or association , who shall lay out , for the purpose
of sale or development , any subdivision or part
thereof as defined herein , either for himself or
others .
SUBDIVISION : means the division of any parcel of land into two
( 2 ) or more lots , plots , sites , or other division
of land , for the purpose , whether immediate or
future , of transfer of ownership or building
development , and shall include resubdivision .
SUBDIVISION PLAT : means the final map or drawing on which the Sub-
divider ' s plan of subdivision is presented to the
Planning Board for approval and which , if approved ,
will be submitted to the County Clerk for recording .

A It has come to my attention that . a recent decision of the
01 New York Supreme -Court states in effect " A planning board 14
t is limited in its power by the town law , Article 267 , 1
e subsection 2 , to review and recommendation power only"
( except in the case of . subdivision review ) . This decision
was the result of a case involving the Mobile Oil Corporation
I
versus Milton , New York State 2D704 . It would appear that
a town planningboard may review a site plan and make recom- a
Amendations to he town board , but the planning boardlicannot
be given nor assume the authority to actually approve or
disapprove the site plans . This power rests with the town
board . AAk
In order to avoid any possible legal actions , it would be
wise for your town attorney to research this matter in more
I detail . It would also be wise to forward recommendations by `'
41 the planning board on site plan approvals to the town board
g for final action to avoid future problems . I

Meeting held by said Lansing Town Board on October 29 , 1974 :
WHEREAS , the Town Board of the Town of Lansing has duly advertised a public
hearing on proposed amendments to the Lansing Zoning Ordinance to be held on the
29th day of October , 1974 at 8 : 00 in the evening thereof , and
WHEREAS , that at said hearing discussion was had both for and against said
amendments and
WHEREAS , said amendments will conform the Lansing Zoning Ordinance to current
New York Law , and be it further
RESOLVED , on motion made by Councilman Louis Bush , seconded by Councilman Bert
Hilliard that said amendments as proposed be and the same hereby are adopted and
the town clerk is hereby authorized and directed to publish said amendments in full
in the Ithaca Journal , Ithaca , New York and post same or the T own bulletin board
and enter same in the minutes of the Town Board , and be it further
RESOLVED , that the Town Board makes the following finding , that in order to
promote the purposes for which said Zoning Ordinance was enacted and to support the
integrity of said ordinance and the good faith reliance upon the provisions of
said ordinance by great numbers of people and property owners in the Town of Lansing ,

The officers of the Lansing Civic Association are deeply
concerned with the procedures that have been followed in
developing the zoning ordinance changes which are under
consideration tonight .
First , we feel that it was improper for the attorneys
for Pyramid Co . to have any input in these changes .
Second , we are disturbed that our Planning Board had
not been fully and completely informed as to the options
open to them when they considered the changes . In August ,
they were presented with a set of major changes in the
ordinance and were told by our Town Attorney that they wr. re
necessary because of the decisions in the Nemeroff and Katz
cases which made our ordinance legally questionable . They
and the Town Board were told the same thing and were given
to believe that they had no option but to accept these changes .
At a Town Board meeting held in September , members of the
general public indicated strong dissatisfaction with the
proposals . Our Town Supervisor then proposed a " compromise "
which he indicated contained the minimum changes required by
the Katz and Nemeroff cases .
Again , the Planning Board was not given an opportunity
to sit down with proper legal guidance and explore the various
options which these cases leave open to them . For example ,
they were told that the Planning Board cannot be given author -
ity to approve site plans because of the Nemeroff case . They
were not told that three options were open to them ; namely ,
this authority may be assumed by the Town Board or delegated
to the Zoning Enforcement Officer or to the Zoning Board of
Appeals . In our opinion , they should have had the opportunity
a

to look into the merits of each of these possibilities with
a legal advisor before being asked to give their approval .
There are many other areas covered in the chanes where options
were similarly available but not explained in detail to our
Planning Board .
The current Lansing zoning ordinance seems to be a good
one and has worked reasonably well in the year that it has
been in existence . It is a law that took :Tore than a year to
write and had a greatdeal of input from the Planning Board ,
Town Board , Zoning °Board of Appeals , and the general public .
It represents a compromise on the part of the various interests
involved and any changes should be considered as carefully as
the original law .
The Lansing Civic Association , as , a whole , does riot en -
arse any point of view on these changes although some indivi -
dual neighborhood chairmen may be ' expressing a legitimate
concensus of those who live in their particular neighborhoods
this evening . The only thing that we do endorse is open
decision making with full knowledge of all of the legal options .
A'.embers of the Zoning Appeals Board seem to feel that the need
for any change in the ordinance is questionable at this time .
With this in mind , we recommend that the changes be sent back
to the Planning Board for further review- this time with full ,
unbiased legal advice as to the options available .
