LANSING PLANNING BOARD
November 23 , 1970 : Town Hall
701 Planning Session , Regular Meeting
PRESENT : Mr . Peter H . Craig , Chairman ; Miss Louise Barr , Mrs . Viola Miller ;

ABSENT : Messrs . Paul Barron , Samuel Baughman , Frederick Edmondson
The meeting came to order at 8 : 15 p . m . and was immediately
turned over to Mr . Niederkorn .
It was announced that there will be a slide presentation at LIONS CLUB
the meeting of the Lions Club on December 7 , 1970 , at MEETING
Chris ' N Green ' s Restaurant . PRESENTATION
Craig Remarked that he will speak about the status of zoning in his
introduction at this meeting , and emphasize that what is be -
ing presented is of far greater scope than mere planning .
• Craig Mr . Howell is unclear about what is going on in connection TOWN BOARD
with planning and with subdivision regulations . MEETING
Miller Stated that at the most recent Town Board meeting Attorney
Williamson had verified the fact that the Town Board had
delegated to the Planning Board , by resolution , all the powers
that can be granted to a planning board under the laws of the
State of New York .
Farkas Had asked for a clarification of the issue , and Williamson
had made the statement at the meeting .
Craig Feels that the resolution by which the powers were conferred
is meaningless ; that a study of the laws of the State shows
that practically nothing is granted to planning boards .
Niederkorn Stated that Mr . Edmondson ' s feeling is that the only way to ZONING
have land control in Lansing would be by independent areas , ORDINANCE
not related . Mr . Niederkorn feels , however , that a dis -
jointed handling of that kind is not professional and that a
zoning ordinance should be drawn up . State laws permit only
a coning ordinance , not independent area ordinances . The
simplest possible ordinance for Lansing would embody the types
of regulations needed . There are some alternatives . Zoning
must concern itself with two points : ( 1 ) Use of land ( stating
• what is not permitted is vitally important ) ; ( 2) Density of
development .

• Mr . Niederkorn displayed maps of development density . Apparently
no regulations are needed for the north end of the Town .
Special attention should be given to the south end . The north
end was designated as Zone A , unrestricted , with no controls
whatsoever in terms of land use or population density . Build -
ing permits would not be required . Zone B is of moderate
population density , and Zone C high density .
Craig Suggested that Mr . Niederkorn design what he regards as a good
zoning ordinance which will be realistic and effective for all
areas of Lansing .
There was a discussion of the value of building permits as a
means of keeping the Planning Board up to date as to what is
going on in the Town , and it was therefore decided that Mr .
Niederkorn should include in the zoning ordinance a statement
requiring building permits even in unrestricted zones .
Niederkorn Discussed the question of whather an "unrestricted " zone actual -
ly means just that . Such a zone faces the danger of becoming a
dumping ground for all uses not permitted in restricted zones .
Farkas Remarked that the requirement of building permits would provide
some protection for an unrestricted zone .
• Miller People in the north end might be glad to know that there would
be some restrictions on mobile homes . For those who think
there should be some restrictions , an alternative with some
restrictions could be offered .
Niederkorn Suggested that it would be possible to have certain restrictions
which would apply to all districts .
Craig It would not be too bad an idea to have people realize what the
complete absence of restrictions would do to the district . The
kind of agriculture which goes on in Lansing is not incompatible
with rural residential areas .
Farkas Feels that it might be possible to get together with the Farm
Bureau through Mr . Paul Barron , to see how thesefarmers feel
about this question .
Craig If you combine farm territory and residential areas the price
of land goes up , to a point where the farmer can make more money
selling off his land than by farming it . Restrictions for a
combined area might prohibit the raising of hogs , or the con -
struction of gas stations , or the presence of junkyards or of
mobile homes .
• Craig Inquired whether there is any ruling by which the objections of
neighbors can govern the passing of a restriction .

• Niederkorn Replied that if 20 percent of the neighbors are against it , the
matter can come before the Town Board , and the restriction can
be passed only by a majority vote .
The present inclination is to keep Zone A unrestricted . If the
zoning mechanism is passed , it is always possible to change or
amend it . The basic line is just 500 feet north of the Peru -
ville Road , to Bush Lane ; Buck Road to Wilson Road to the Creek ,
and to Lakeview , and then to the railroad track .
Craig Any alternative should include realistic restrictions which would ,
for example , protect Salmon Creek .
Niederkorn Alternative 2 would protect the conservation areas such as the
lake shore , Salmon Creek , and perhaps some part of Gulf Creek .
The main problem is overcrowding , and the determining factor is
drainage for sewage , the existence of sewers being the important
control .
It was the sense of the Board that mobile homes should be permit -
ted in Zone A without restriction , but only in mobile home parks
in Zone B . In Zone C they might be permitted in mobile home parks .
• It was also the sense of the Board that natural features should
be included in conservation areas and protected ; that even the
strip along the lake shore should have restrictions , to make sure
that docks and other such facilities are properly built . The
statement was made that Lansing ' s natural features cannot be
argued against , and should be protected and preserved . The Board
felt that 1000 feet from the railroad tracks along the lake is a
good Zone A line .
Niederkorn Displayed a breakdown of Zone C , limiting the commercial zone .
The C area assigned to this commercial area becomes a high -
density residential area . There seems to be a strong feeling
about multiple dwellings , since a sudden influx of multiple fam-
ily dwellings can upset a school district .
Niederkorn Would like the Planning Board to be thinking about the proposed
conservation zone and its control (along the lake and the Salmon
Creek area) ; also the boundaries of the Zone B area , and the size
of the commercial Zone C .
Craig On the agenda for December 14 is a discussion of the conservation
zone , Salmon Creek to the lake shore , and also the idea that the
Board have a fairly clear idea of the housing prediction for Zone B .
The meeting adjourned at 10 : 15 p . m .
