LANSING PLANNING BOARD
• July 13 , 1970 : Town Hall
Regular Meeting
PRESENT : Mr . Peter H . Craig , Chairman ; Miss Louise Barr , Mrs . Viola Miller ,
Messrs . Sam Baughman , Frederick Edmondson , and Steven Farkas , Jr .
ABSENT : Mr . Paul Barron
The Chairman called the meeting to order at 8 : 15 p . m .
The minutes of the regular meeting of June 8 , 1970 , and of MINUTES
the 701 Planning meeting held June 22 , 1970 , were approved
as previously distributed .
Neither Mrs . Miller for Public Relations , Mr . Edmondson for REPORTS
Professional Relations , nor Mr . Baughman for Water and Sewer
Districts had any items of interest to report .
Craig At the Town Board meeting it was announced that the County WATER AND
Sewer Agency is beginning to look with less and less favor SEWER
on Lansing ' s possible involvement in the proposed sewer plan . DISTRICT
Miller There seems to be a lack of understanding of this matter on
• the part of the Town Board , and members of the Planning Board
should be attending meetings of the County Sewer Agency .
Baughman The engineering studies all showed lines going into Lansing .
Craig The cost of the lines into Lansing is a big part of the over -
all problem .
Miller Is there any chance of having Harris Dates attend a meeting
of the Planning Board , and talking to him ?
Craig Feels that there is a very good possibility of this , and that
Mr . Dates could be asked to attend the next meeting .
There will be a meeting of the County Sewer Agency on July 16th
at 3 : 30 p . m . in the Council Chambers on the third floor of the
Court House .
Edmondson Suggested that he would attend that meeting , and stated that
as many as possible of the Planning Board members should attend .
Barr Had not been able to find out who is building residences in RESIDENTIAL
a wooded area near Myers Road . DEVELOPMENT
Craig Informed the Board that the builder is Fred Knight , who is
• at present working out a solution with the Town Board in the
matter of getting water service to the apartments he is
building .

• Edmondson Felt that the meeting of June 22 had gone very well in spite PUBLIC
o f the fact that very few Lansing resident developers had RELATIONS
attended it .
Miller By September the Planning Board will have to give some real
consideration to public relations and have something very
interesting to present .
Craig About ten days ago he had called the Town Supervisor and ex - SUBDIVISION
pressed concern about the lack of Town Board action on the REGULATIONS
regulations . An executive session of the Town Board had been
held on June 26 for consideration of the Subdivision Regula -
tions . The Town Board members had apparently decided that they
did not like the regulations as presented , had roughed out a
substitute set , and given them to Counsel Robert Williamson
to write up . Mrs . Miller had talked with Mr . Williamson , who
told her that the Town Board had made radical and drastic
changes in the regulations as drafted by the Planning Board .
He had not had the time , however , to type in what the Town
Board had suggested as changes . His comment was that there
would not be much left for the Planning Board to go over , and
that so far as he could see the Town Board wanted to ordinances
o ver which they would not have complete jurisdiction . Mr .
Williamson knows that Groton has passed their subdivision
regulations , and asked for a copy so that he could present
• them to the Lansing Town Board in order to let them know what
they are up against .
Edmondson Suggested that the Planning Board should stand by until the
✓ evised document comes out of Mr . Williamson ' s office , and
then get a copy of it .
Craig Has already told Mr . Howell that the regulations cannot be
handled by the method being suggested by the Town Board .
Miller Mr . Howell said at the Town Board meeting that its members re -
alize the necessity of some kind of control , but they do not
know how to get it .
Craig Had presented the Town Board with the following resolution
at its meeting of July 10 , 1970 :
WHEREAS , The Town Planning Board of the Town of Lansing
has transmitted to this Board a copy of its resolution
dated , adopting Land Subdivision
Regulations for the Town and containing a copy of such
regulations , and
WHEREAS , it is desirable that said Planning Board be
provided with regulations for its use in carrying out
• subdivision control in this Town ,

THEREFORE BE IT RESOLVED , that :
• ( 1 ) pursuant to the authority of the Town Law , this
Board does approve such Land Subdivision Regulations
for the use of the Planning Board of the Town of
Lansing ,
( 2 ) a copy of this resolution be transmitted to the
Planning Board for its record .
The Town Board did not , however , consider the resolution seri -
ously . As matters now stant it does not seem as if they will
pass the Subdivision Regulations as the Planning Board sub -
mitted them . Under present laws , all such regulations must
come from outside the political sphere , and so in this case
must come through the Planning Board .
Edmondson The Planning Board has done everything it can , and should now
stand aside and see what happens .
Miller The Town Board wishes the Planning Board to see the matter from
the Town Board ' s point of view .
Baughman Their point of view seems to be that the people who elected them
want no part of this sort of thing , and that is why they were
elected . The members say they want planning , but no regulations .
41111 He himself would not wish to be in the position of regulating
what people do with their own land .
Craig Read to the Planning Board a letter that he had sent to the
Town Board for their meeting of July 10 , 1970 .
Doubts that his remark , that what the Town Board is possibly
planning to do with the Subdivision Regulations is illegal , was
believed by them .
Miller They have stated plainly that they do not wish any advice
from " experts . "
Craig Feels that the time has come for a decision as to what to do ,
or what not to do .
Miller Had told the Town Board that the Planning Board would consider
making changes in the proposed regulations , but until the
Planning Board knows what the Town Board does not like about
the regulations , it cannot make any changes .
Craig We could take the alternative and wait until the material
comes from Mr . Williamson ' s office .
• Edmondson MOTION to take the alternative of waiting until the material
comes from Mr . Williamson ' s office . This MOTION was seconded ,
and then discussed .

Craig Read aloud the enabling statute , stating that he feels it
• might be well to send a copy of it to the Town Board . He is
afraid that if they pass illegal rules and are then informed
o f their illegality they will be displeased . Seeing the en -
abling statute might get the idea across to them .
Edmondson Mr . Williamson should inform them of this .
Craig The membership of the Planning Board which approved the previous
✓ egulations was quite different from the present Planning Board
membership . This present Planning Board could reapprove the pre -
viously -written regulations and pass a current resolution saying
that this present Board approves those regulations . This might
carry some weight even if the feeling were not unanimous . This
o f course would entail going over the regulations one by one and
making any possible changes , and then transmitting them with a
resolution .
The MOTION was then repeated by the Chairman , who also presented
the possibility of writing the facts concerning the illegality
of the Town Board ' s present procedure in connection with the
subdivision regulations , and the idea of the Planning Board ' s
✓ e - reviewing the Subdivision Regulations and then reaccepting
them .
When put to vote , the MOTION was unanimously approved .
• The Chairman will contact Mr . Williamson aggressively in order
to get action on this matter .
The recent resignation of Mr . Ruzicka made it necessary to TREASURER
elect a new Treasurer . The nomination of Miss Barr by Mr .
Baughman was seconded , the nominations were declared closed ,
and the Recording Secretary was instructed to record that a
unanimous ballot was cast in favor of Miss Barr as Treasurer .
Craig Asked that a Treasurer ' s report be presented at the next Planning
Board meeting .
Miller Reminded the members that the budget is due in November , and
stated that this should be kept in mind as there may be no re -
minder of this fact .
The meeting was adjourned at 9 : 10 p . m .
