LANSING PLANNING BOARD
• July 8 , 1968 : Town Hall
Regular Meeting
PRESENT : Mr . James Showacre , Chairman ; Mrs . Viola Miller ; Messrs . Paul
Barron , Alex Cima , Frederick Edmondson
Also : Mr . Frederick Spry
ABSENT : Messrs . H . D . Ruzicka , James Wood
The meeting was called to order by the Chairman at 8 : 35 p .m .
The minutes of the following meetings were approved by separate mo -
tions , made by Mrs . Miller , seconded by Mr . Cima , and carried : May 13 , 1968 ;
May 27 , 1968 ; and the executive session of June 27 , 1968 .
The first order of business was the selection of a vice - chairman , ELECTION
to replace Mr . John Ettinger , recently resigned from the Planning Board . OF VICE -
Mr . Cima was nominated by Mr . Edmondson , seconded by Mr . Barron . Mr .
Edmondson was then nominated by Mr . Cima , seconded by Mrs . Miller . In CHAIRMAN
the election by ballot , Mr . Edmondson received four votes , Mr . Cima one .
• The Chairman announced that the 701 Funds application has been 701 FUNDS
forwarded to Washington , recommended to the signatory for the State that
it be given highest priority . Mr . Drogin has not yet reported whether it
was actually given this priority . Sometime during the present quarter
Washington will notify this Board of either its approval or disapproval .
It it is approved , funds will be released immediately ; if disapproved in
this quarter , the application will be put on the list for the next quarter .
If approved the following quarter , work can be started ; if disapproved it
goes into the following quarter . If it is disapproved three quarters ,
the work on it must start over again from the beginning of the process .
This allows the Lansing Planning Board until March of 1969 for the final
decision .
The memorandum dated July 8 , 1968 , from Mr . Niederkorn to Mr . SUBDIVISION
Showacre , regarding suggested modifications of the proposed subdivision
regulations stemming from the public hearing on June 27 , 1968 , was dis - REGULATIONS
cussed point by point (copy attached to these minutes ) .
1 . Mr . Edmondson suggested that four instead of two or more divisions
of land be the criterion , unless a public or commercial facility is planned .
The Chairman agreed that he does not wish the Planning Board to become in-
volved with divisions into only two parcels of land where no improvements
are contemplated and it is not for commercial development . The following
change was therefore agreed upon :

i . Subdivision :
• The division of any lot , tract or parcel of land into two or more
parcels , lots , plots , tracts , sites or other division of land for the
purpose , whether immediate or future , of transfer of ownership , whether
or not new building or development is to occur , except that for the
purposes of these rules and regulations any parcel which is divided so
as to create two to four parcels , none of which is to be used for
commercial purposes and involves no new public improvements , shall not
be considered a subdivision . Subdivision shall include resubdivision
in whole or in part of any plot , filed or unfiled , which is entirely
or partially undeveloped .
2 . It was the sense of the Board that a maximum of four parcels of land ,
with improvements , constitutes a minor subdivision . A major subdivision is
any division which is not a minor subdivision ; in other words , five or more
subdivisions with improvements . The change was made as follows :

la . Subdivision , Minor :
The subdivision of any land into not more than four lots
(initial lot plus three new lots ) fronting on an existing street ,
not involving any new street or road , but involving the extension
of any municipal facilities such as public water and / or sewer mains .
lb . Subdivision , Major :
Any subdivision of land not classified by the Planning Board
. as a Minor Subdivision .
A discussion followed as to who has the responsibility for paying for
the improvements . It was the sense of the Board that the person who puts in
and pays for the improvements should appear before the Board for approval .
Regarding a definition of " improvements , " these were felt to be pub -
lic roads , water and sewer facilities . " Improvements " should be included in
definitions .
3 . The following change was made :

D . A Sketch Plan which is classified as a MINOR subdivision and has received
Board of Health approval , if required , may be conditionally approved by
the Planning Board . The subdivider shall comply with the provisions of
this Article regarding Final Plat and approval after a public hear g .
4 . Add ;
Page 32 .
Add . lc . Subdivision , Existing :
Any subdivision of land in the Town of Lansing which is
• filed in the office of the Town or County Clerk at the time
these rules and regulations take effect .

5 . The Board wished to delete this requirement ( trees ) .
• 6 . Regarding paragraph A , it was decided to leave , as it now stands , the
statement originally made on page 5 of the proposed subdivision regulations .

B . The Preliminary Plat drawing must have the approval of the Tompkins County
Health Department before it is submitted for approval .
7 . Add :
Page 7 .
A . line 4 . After the first sentence add the following sentence : "All such
Final Plats shall be laid out by a certified licensed land surveyor . "
8 . Approved by the Board (i . e . , that the original wording be retained ) .
Regarding the Chart of Procedure , the following change was made :

Strike out "MINOR SUBDIVISION (approved ) " and the arrow below it .
• It was the sense of the Board that Dr . Lyman Fisher ' s suggestion that
a copy of the Board of Health Regulations relating to subdivisions be incorporated
in the Subdivision Regulations could be granted by including these in an addendum ,
so that if they are changed it will not be necessary to revise the Subdivision
Regulations .
Mr . Spry then addressed the Board on the advisability of omitting refer-
ences to zoning , in the Regulations , as this is a controversial subject and should
actually be the final step in planning , instead of being included in a first step
such as subdivision regulations . He felt that the omission of such references
would take nothing from the regulations , aid would aid materially in their acceptance
in Lansing , as the educational process would thereby be expedited .
With this in mind , the Board made the following changes :

B . line 2 - strike out "zoning requirements , if any , and " .
Page 16 .
G . Permanent dead -end streets shall not be longer than six times the minimum
frontage (section 605 ) or 600 feet . All permanent dead -end streets shall
provide a turnaround at the end with a paved radius of not less than 60
• feet . Streets which are to be continued at a later date shall provide
a temporary turnaround .

It was decided that another public hearing should be held by the
joint boards , with a statement to the Town Board from the Planning Board that
at the regular meeting of the latter on July 8 , 1968 , that Board reviewed the
recommendations made - at the recent public hearing and subsequently recom-
mended by Mr . Niederkorn , and recommends that the Lansing Town Board con-
sider these changes in the proposed subdivision rules and recommendations ,
and that the changes be presented at another public hearing to be held by
the joint boards this month .
Mrs . Miller announced that because of the vast number of hours PLANNING
spent by many of the members of the Planning Council , many of the surveys COUNCIL
are now finished . They are extremely worthwhile and interesting , and
• are being studied and abstracted . They are available for perusal by
members of the Planning Board .
The meeting adjourned at 10 : 40 p .m .

SUBJECT : Modifications of the ". Lansing Planning Board
DATE : July 8 , 1968
•
The following modifications of the proposed Lansing Subdivision •
Regulations resulted from the public hearing held last month and
from a discussion with the town engineer and the town attorney .
1 . Main concern seemed to focus on the provision which would
, require that all transferes of land would have to come before the
planning board for approval , regardless of the intended use to
which the land was to be put and whether or not new improvements
• were involved . It was felt that this would also put a burden on
the planning board . Softening of this provision should be done by
modifying the definition of a subdivision on page 32 . One possibility
would be to say that a subdivision was the division of a parcel -
into three or more parcels :instead of " two or more " as presently
• . stated . This would result in some loss of control .
A better possibility would be to exclude from the regula -
tions any one lot subdivision involving a parcel five acres or
larger which was to be used for agricultural purposes and did not
involve the construction of any improvements . This can be accom-
plished by adding the following wording after " occur" on line 8
of page 32 : " except that for the purposes of these rules
and regulations any parcel which is subdivided into not more than
one new parcel , which parcel is five acres or more in size , is to
be used solely for agricultural purposesand involves no new public
improvements , shall not be considered a subdivision . " This would
permit the large lot subdivision for agricultural purposes . The
five acre figure is arbitrary but seems reasonable .
2 . There was a suggestion to broaden the definition of a
MINOR subdivision so that a subdivision into more than two lots
would not have to comply with the procedures of a MAJOR subdivision .
Whether or not this should be done depends on the amount of control
the planning board wishes to maintain . I . doubt that serious problems

• would materialize 4&t the definition of MINOR subdivision (page 32 )
read as follows : " The subdivision of any land into not more than
three lots ( initial lot plus two new ones ) to be used solely for
residential purposes , etc
3 . Two attendant changes related to MINOR subdivisions should
be made on page 4 . The last sentence of the first paragraph should
be changed to read : " The subdivider shall file a copy of the en-
dorsed Sketch Plan with the Town Clerk within 90 days from the date
said Sketch Plan was endorsed . "
On the same page , paragraph E , strike the word " contiguous " .
The word " four" should possibly be reduced to " three" if the change
in the definition of a MINOR subdivision is adopted .
4 . The definition of an " Existing Subdivision" was mentioned .
This can be taken care of by adding ic .. at the bottom of page 32
as follows :
" lc . Subdivision , Existing :
Any subdivision of land in the Town of Lansing which
is filed in the office of the town or county clerk at
the time these rules and regulations take effect . "
• 5 . There was concern about the requirement for a tree in the
front yard (page 26 ) . While I feel this is not unreasonable , it
may be expeditious to delete this paragraph .
6 . On page 5 , it was suggested by Tom Miller that the following
wording be added to paragraph B : "All such Plats involving private
sewerage systems or a private water supply must bear the seal of
both- a 1-icensed- -pr-o-€esstonal engineer and a licensed -land-surveyor .
Plats involving public sewerage systems or a public water supply
may be submitted by a licensed land surveyor provided there are also
submissions of water and sewerage plans bearing the seal of a _. licensed
professional engineer . "
7 . On page 7 , Section 404 A , after the first sentence ad;d the
following sentence : "All such Final Plats shall be layd out by
a certified licensed land surveyor . "
8 . It is my feeling that the suggestion that the regulation
related to sidewalks (Section 701 C ) should be more positive A
not particularly valid . The planning board must retain some dis -
fretion here .
In my opinion , all the modifications listed in this memo could
be incorporated into the rules and regulations without compromising
the intent and effectiveness of the ordinance . The primary purpose
• of making these changes is to enable the subdivision regulations
to be accepted and approved . More changes in the future should
be expected .
