Platt, Code Enforcement Officer * Bud Shattuck, Town Board Liaison * Lorraine Moynihan Schmitt, ZBA Attorney PUBLIC PRESENT Timothy Cornell Jim Hulbert • Barbara Hulbert GENERAL BUSINESS Gregg Travis, Chairman called the meeting to order at 5 : 02 PM . Mr . Travis announced that a change to the original Agenda had been made to include discussion regarding holding a joint Meeting with the Planning Board Members regarding the proposed Zoning Ordinance and Subdivision changes . Further Discussion " IMandscaping - Timothy Cornell, Buck Road, Tax Parcel# P/O 28.4-28.32 Timothy Cornell appeared before the Board . At a previous meeting, Mr . Cornell was asked by the Zoning Board to re-evaluate his situation to see if he could get by with performing what task he wanted to do within the remaining land that is in the currently zoned RA district. Mr . Cornell has advised the Board that after measuring out where he would like to erect his building, and following the . Town Zoning Ordinance with regards to setbacks, the building would be 2' over at the corner. Rather than request just 2' , Mr . Cornell would like to follow through with his original request and be granted the additional 501 . Henry (Hurf) Sheldon stated he has reviewed the project closely, and Mr . Cornell • does own the surrounding land . With the erection of this building, he would not 1 APPROVED ZBA Amended 3/1 sins j be invading the very near property owners . This is not a substantial request, and • Mr. Sheldon is in favor of the proposal . Linda Hirvonen made a motion to accept Mr . Cornell' s request for a Use Variance . Daniel Konowalow seconded . VOTE AS FOLLOWS: Linda Hirvonen - Aye Daniel Konowalow - Aye Henry (Hurf) Sheldon - Aye Gregg Travis - Aye MOTION CARRIED . REQUEST TO HEAR AREA VARIANCE Applicant, Ron Ronsvalle for James Hulbert, Tax Parcel no. 41 .445. 9, R1 District, 21 Stormy View Drive Mr . & Mrs . James Hulbert appeared before the Zoning Board of Appeals requesting an Area Variance to build closer to the property line than allowed by the Town of Lansing Land Use Ordinance . The home owners wish to create • living space in the existing garage and build a new 3 car attached garage on the North side of the house . A 25' side yard setback is required in the R1 District. The proposed garage would be approximately 12' from the side yard . A letter from the neighbors, Gerald Friedman and Sally Detko was submitted to the Board advising them that they have no objection to the Hulbert' s project as long as they can agree to the set back distance and the Hulbert' s planting and maintaining a visual barrier . Mrs . Hulbert explained that since the letter was written, a new survey shows that the neighbor' s tree limbs are on the Hulbert' s property by 10 to 12 feet. The limbs will now create a problem for the Hulbert' s and this must be worked out prior to any construction. Henry (Hurf) Sheldon made a motion to accept hearing the case and place it on the Agenda for a Public Hearing to take place on Tuesday, March 18, 2008 at 6 : 00 PM . Daniel Konowalow seconded . ApprovaVDenial of February05, 2008 Minutes Linda Hirvonen made a motion to approve the Minutes of February 05, 2008 as submitted . Henry (Hurf) Sheldon seconded . Other Business III The Planning Board has invited the Zoning Board of Appeals Members to join them at their March 10, 2008 Meeting at approximately 8 : 00- 8 : 15 PM to discuss the proposed changes to the Zoning Ordinance and the Subdivision Rules & • Regulations . Nodule Development Workshop Linda Hirvonen stated she attend the Nodule Workshop presented by The New York Planning Federation last week and found it to be quite interesting . Ms . Hirvonen indicated that at the workshop they requested that municipalities promote Cluster Development. One way would be to provide incentives to a Developer . Ms . Hirvonen further stated she thought this would be a very good thing for the Town Board and the Planning Board to investigate . Linda Hirvonen made a motion to adjourn the meeting at 6 :47 PM, Daniel Konowalow seconded . Further Discussion, TT Landscaping Variance Timothy Cornell appeared before the board requesting that a Use Variance be considered as Mr. Cornell would like to sell his existing building (road front portion) located at 360 Auburn Road and move his business to another location on the property with access to Buck Road . The parcel (10 ft) is in the RA District. Landscaping and Excavation Businesses are not identified as allowed uses in the Town of Lansing Land Use Ordinance , Mr . Cornell has staked out • the location of the proposed building and feels that the Variance would be necessary to make the best use of the property . 5 : 15 P . M . REQUEST TO HEAR AREA VARIANCE Applicant, Ron Ronsvalle for Tames Hulbert, Tax Parcel no. 41 .-1- 15.9, R1 District, 21 Stormy View Drive Ron Ronsvalle, of Heritage Builders has submitted an Application for a Variance to build closer to the property line than allowed by the Town of Lansing Land Use Ordinance . The home owners wish to create living space in the existing garage and build a new attached garage on the North side of the house . A 25' side yard setback is required in the R1 District. The proposed garage would be approximately 12' from the side yard . Since a current survey is not available, Mr .
