Thank you very much for your email-- I think it is most useful for you to bring your knowledge and
experience to bear at the meetings/hearings however if at all possible . You are certainly NOT just a mere
" Piddle clerk" " I ' ll '
I agree that Landscaping/excavating is inexplicably not a listed use in the entire use schedule in the
Zoning Ordinance for the Town .
HOWEVER, although commercial excavation is not a permitted use in the R3 district, it is a permitted use
with special conditions in the RA district (see 503 ( D ) (6 ) ) , Among the special conditions for that
permitted use, is a reference to Section 802. 6: Commercial Plant Nursery, greenhouse—permitted with
requisite planning board site plan review including , but not limited to buffer and landscaping concerns .
The ZBA has among its powers the authority to interpret the Zoning Ordinance for an applicant. If the
ZBA finds that the intent of the ordinance is to permit landscaping/excavating in the RA district, given the
reference to plant nurseries/greenhouses in conjunction with excavating , zones are relevant and do
come into play -- and the suggestion of the ZBA for the applicant to ascertain whether he could put the
new building entirely within the RA zone (and 50 ' permitted extra buffer zone from the adjacent) is helpful
to the applicant.
I do agree that the applicant will need to appear again before the ZBA board in any event, as the hearing
has not been concluded . At that point, the applicant can seek a finding from the board on the
interpretation of the ordinance so far as it relates to landscape/excavating in an RA district or can seek a
use variance in the RA district or both .
As for a February 19th meeting , I would not be able to attend as I will be in NYC for the AOT meeting , so I
would suggest an alternate date if my presence at the continued hearing would be helpful . . .

I know I 'm just the "piddle Clerk" for the ZBA, but, I must voice my concerns with last pm 's Meeting regarding Mr.
Cornell 's Use Variance . I believe Mr. Cornell came before the board for a decision as to whether he can build his
new building in the TOWN . According to our Land Use Ordinance , Landscaping/Excating is not listed

therefore , NOT an allowed use in the entire Town . I believe a decision should have been made on that request.
Districts or set back issues should not have been involved . Mr . Cornell will have to re-appear at the Feb . 19th
Meeting for a decision .
