For future reference and clarity , a rehearing can happen in one of two ways : ( 1 ) By new application filed by the applicant (as is the case here ) based on prior and/or new evidence ; or (2 ) Upon motion of a ZBA member for rehearing of the application and the unanimous vote of ZBA members present at the time such motion is made . The rehearing can be based on the previous record and/or new evidence . Also , I removed the discussion concerning the Mold from my draft minutes and sent them off to our Web Master. In addition , I have advised Mr. Dwyer that he may return for a Full Board Review, however, a new Application must be turned in to the Planning Department . Thank you . I have modified it and would like feedback from you on the changes . There are a few more comments I ' d like to make here , but not in the denial letter . 1 . Rachel , I don ' t think your written notes should include reference to the prior mold problems the applicant acknowledged at the meeting ; for his sake . 2 . One of the " benefits " noted at the meeting to the Town would be the increased tax base ( the proposed two lots likely to be assessed at greater value than the current property ) . The increased taxes would ultimately be paid by the tenants of the properties , not by the applicant . We would be directly taxing the people with lower incomes who we supposedly would be trying to benefit . 3 . No new low cost housing would be created . Providing more low cost housing would be much more approvable to me . 4 .
