Gregg Travis, Chairman called the Meeting to order at 5 : 02 PM . Mr. Travis
inquired if there were any Public comments or concerns. There were none .
Chairman Travis acknowledged before him an " Affidavit of Publication" with.
regards to the Legal Notice published in The Ithaca lournal .
Daniel Konowalow made a motion to open the Public Hearing at 5 : 03 PM .
Henry (Hurf) Sheldon seconded .

Road, Tax Parcel # 24.247
Clay Burruss appeared before the Zoning Board of Appeals requesting an Area
Variance to erect a 26' x 22' Garage . Due to the lay of the land, there is only one
location on the property that the structure can be situated . The Towri s setback
requirement from the road right of way is 30' whereas Mr. Burruss will have 23 . '
Public Comments/Concerns
There were none.
Ronald Bricker made a motion to close the Public Hearing at 5 : 11 PM. Linda
Hirvonen seconded .

The Board Members reviewed the Area Variance Criteria as follows :
1 . State whether an undesirable change in the neighborhood character
will be created, and reason whv :
No. No Public opposition was voiced at the Public Hearing or
otherwise .
2. State whether there is an alternative method to achieve what the
applicant desires, and reason why :
Yes, but the alternative site would be much more expensive .
3 . State whether the variance will have an adverse effect or impact on
the physical or environmental conditions in the neighborhood or
district, and reason why :
No .

O 4 . State whether the alleged difficulty (variance needed) was self-
created, and reason why :
No . The topography limits the practical site .
CONDITIONS: List conditions prescribed by the Zoning Board of Appeals in
granting this variance :
1 . Structure must be completed within twelve months of this date,
and this Variance does not convey with sale of the property if that
occurs within the twelve month construction period .
Linda Hirvonen made a motion to approve the area variance with the conditions
listed above. Henry (Hurf) Sheldon seconded .

Other Business
Applicant: John & Scott Oaks, Pre-Fab Carport Sales, 1793 East Shore Drive, Tax
Parcel # 37.1-945, R2 District
Richard Platt, C.E.O. expressed to the Members that at last nights Planning Board
Meeting a project by John & Scott Oaks was brought before the board for an " In-Home"
Business (Sales of Pre-Fab Carports). The Planning Board felt that the classification was
incorrect and it should be classified as a non conforming use in an existing business. The
Planning Board recommended the following recommendation;
• The Planning Board for the Town of Lansing while recognizing that the
action in question falls under the jurisdiction of the Board of Zoning
Appeals feels that this in no way changes or erodes the existing character
O of the neighborhood . There is a well maintained existing business on site
and this function is being added . Site Plan recommendation for the
business would be the positioning of the material (carport) is behind the
appropriate setback line .

seconded.
