Platt, Code Enforcement Officer * Bud Shattuck, Town Board Liaison Lorraine Moynihan Schmitt, ZBA Attorney PUBLIC PRESENT Tania Johnson • Raymond Johnson GENERAL BUSINESS Gregg Travis, Chairman called the Meeting to order at 7: 00 PM. Public Hearing For: Area Variance, Applicant. Raymond Johnson, Agent for Faith Baptist Fellowship, 998 Auburn Road, Tax Parcel # 8.41 30 Daniel Konowalow made a motion to open the Public Hearing at 7:02 PM. Ronald Bricker seconded. VOTE AS FOLLOWS: Ronald Bricker - Aye Linda Hirvonen - Aye Daniel Konowalow - Aye Gregg Travis - Aye MOTION CARRIED. Gregg Travis read the Legal Notice published in The Ithaca Tournal. Public Comments/Concerns There were none. • Applicant: 1 J DRAFT zsn osa vo7 • Raymond & Tania Johnson, Agents for Faith Baptist Fellowship appeared before the board requesting an Area Variance, The Johnson s would like to erect a small mud room and deck on the north side of the Parsonage. The existing Parsonage is located 21'9" in the road-right-of way, however, the proposed additional would not extend beyond the existing building. The Town right-of-way is 50' . Due to the lay of the land, there is no other location for this addition. Ronald Bricker made a motion to close the Public Hearing at 7:05 PM. Daniel Konowalow seconded. VOTE AS FOLLOWS: Ronald Bricker - Aye Linda Hirvonen - Aye Daniel Konowalow - Aye Gregg Travis - Aye MOTION CARRIED. The Board Members reviewed the Area Variance Criteria as follows : 1 . State whether an undesirable charge in the neighborhood character • will be created, and reason why : No undesirable change will be created . 2. State whether there is an alternative method to achieve what the applicant desires, and reason why : Perhaps do nothing, or dismantle house, so no practical alternative . 3 . State whether the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district, and reason why : No adverse affect. 4. State whether the alleged difficulty (variance needed) was self- created, and reason why : Not self created since house was existing in right-of-way . CONDITIONS : List conditions prescribed by the Zoning Board of Appeals in • granting this variance : 2 L� DRAFT ZBA 08/2 U07 • The building addition should conform to the Sketch provided for review. This variance can extend one year from the date of this approval . Ronald Bricker made a motion to approve the area variance with the condition the building addition conforms to the Sketch provided . Linda Hirvonen seconded . VOTE AS FOLLOWS: Ronald Bricker - Aye Linda Hirvonen - Aye Daniel Konowalow - Aye Gregg Travis - Aye MOTION CARRIED. Richard Platt, C.E .O requested that we place an additional condition in the motion extending the variance request to start construction for a year from this approval date per the Johnson' s request. Ronald Bricker amended the previous motion to include the extension to build for a • period of one (1) year from the date of approval. Daniel Konowalow seconded. VOTE AS FOLLOWS: Ronald Bricker - Aye Linda Hirvonen - Aye Daniel Konowalow - Aye Gregg Travis - Aye MOTION CARRIED. Approval/Denial of Jul y 17, 2007 Minutes Linda Hirvonen made a motion to accept the minutes as presented. Daniel Konowalow seconded. VOTE AS FOLLOWS. Ronald Bricker - Aye Linda Hirvonen " Aye Daniel Konowalow - Aye Gregg Travis - Aye MOTION CARRIED. • 3 DRAFT ZBA 08/21 /07 Town Board Liaison Bud Shattuck expressed to the members that the board is running very smoothly and professionally, attendance was good, and schedule changes made to accommodate the needs of everyone else was appreciated. Other Business None Daniel Konowalow made a motion to adjourn the meeting at 7:15 PM. Ronald Bricker seconded. VOTE AS FOLLOWS.
