Platt, Code Enforcement Officer * Bud Shattuck, Deputy Town Supervisor PUBLIC PRESENT Jason Demarest Gregory Lawrence GENERAL BUSINESS • Linda Hirvonen made a motion to open the meeting at 5 : 02 PM . Ronald Bricker seconded . VOTE AS FOLLOWS : Ronald Bricker — Aye Linda Hirvonen — Aye Gregg Travis - Aye MOTION CARRIED . Gregg Travis newly elected Chairman, introduced himself to the Board Members present. Approval of December 7, 2005 Minutes Linda Hirvonen requested that her name be removed from the voting process in the minutes of December 7 , 2005 , Ronald Bricker made a motion to accept the minutes with the necessary corrections . Linda Hirvonen seconded . VOTE AS FOLLOWS : Ronald Bricker — Aye Linda Hirvonen — Aye Gregg Travis — Aye • MOTION CARRIED . Jr .. G ZBA 01 - 17-06 Acceptance/Denial to hear case in regards to : Area Variance for : Gregory Lawrence/ Daniel Brown , Parcel # 340447 .41 Richard Platt explained to the Board Members that in September of 1988 , the Planning Board granted a Variance on this parcel of land for a 1 lot subdivision. Due to the Planning Board granting this Variance instead of the Zoning Board, Mr. Platt contacted the Attorney for NYS and was advised that a Planning Board does not have the legal authority to grant a Variance . The Attorney advised Mr. Platt to have the applicant apply to our Zoning Board of Appeals for a legal Variance . The lot in question does not have road access . Access would be through a right of way over parcel # 34 . - 1 - 17 . 42 . The Survey Map does not properly identify the access right of way. Linda Hirvonen made a motion to accept the Application as submitted and set the Public Hearing date for Tuesday, February 21 , 2006 @5 : 00 PM . Ronald Bricker seconded . VOTE AS FOLLOWS : Ronald Bricker — Aye Linda Hirvonen — Aye • Gregg Travis — Aye Acceptance/Denial to hear case in retards to : Area Variance for , Babcock, Lillian , 32 Ladoga Park Road, Parcel # 33041 58 Richard Platt explained to the Board Members that in July 04 Ms. Babcock appeared before The Zoning Board of Appeals for the approval to erect a new cottage on her Lakefront property. The following is an excerpt from the minutes: WaVoe Llrcas made an amended motion as follows : to approve construction on the existing footprint. Any additional shucture outside of the existing footprint will be consistent wilh the current Zoning Regulations. (;round level will not be altered and drainage will be reviewc(i by the Town of Lansing's I ncincer at the applicants expense. Ronald Bricker seconded . VOTE: Ronald Brickcr-Aye, W-lyne Lucas-Aye. The proposed mininnon open space was approximately 78°b, which will he approximately W'40 with the reduction required to meet Zoning Regulations. Liniia Hirvonen seconded . Ms. Babcock recently went through Site Plan Review with the Planning Board at which time the proposed plans submitted indicated footage beyond what the Zoning requirements allow. The Planning Board was in favor of the proposal, however, proper procedure must be followed. The following was presented to the Zoning Board of Appeals: Dear Zoning Board of Appeal Members, At the January 9, 2006 Planning Board meeting the Board reviewed the Site Plan for a replacement of Ms. • LitiIan Babcocies existing cottage at 32 Ladoga Park.. structures less than 30' from shoreline shall be subject to Site Plan Review (Schedule II, footnote 12). Planning Board Members referred this project to the ZBA ZBA 01 - 17-06 because a small portion of the Proposed Living Room and Poach are less than 10' fi orn the property line as • required by the Ordinance. The Planning Board Members agreed with the proposal and strongly recorrrrnerrded that a Variance be granted. Ronald Bricker made a motion to accept the Application and hear the case. Linda Hirvonen seconded. VOTE AS FOLLOWS : Ronald Bricker — Aye Linda Hirvonen — Aye Gregg Travis — Aye MOTION CARRIED. Linda Hirvonen made a motion to set the Public Hearing date for Tuesday, February 21 , 2006 @ 5 : 15 PM. Ronald Bricker seconded. VOTE AS FOLLOWS : Ronald Bricker — Aye Linda Hirvonen — Aye Gregg Travis — Aye Other Business The Zoning Board of Appeals is currently accepting applications for a full time vacancy on the • board. Linda Hirvonen made a motion to adjourn the meeting at 5 :25 PM. Ronald Bricker seconded.
