GENERAL BUSINESS
Stephen White, Chairman of the board called the meeting to order at 7 : 00 PM.
Approval of June 21 , 2005 Minutes
Daniel Konowalow made a motion to accept the minutes as presented. Wayne Lucas
seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY.
Mary Hudson — Area Variance — 134 Burdick Hill Road, Parcel # (s)
42 .4m53 .6 (Town) & 42 . 1 =53 .5 (Village)
Stephen White, Chairperson read the Legal Notice published in The Ithaca Journal
regarding the Public Hearing for the Area Variance. Linda Hirvonen made a motion to
open the Public Hearing at 7 : 05 PM . Daniel Konowalow seconded. VOTE : ALL IN
FAVOR, MOTION CARRIED UNANIMOUSLY ,
Mary Hudson appeared before the Zoning Board of Appeals requesting an Area Variance
to access her property located in the Town of Lansing in order to build a home, via her
parcel located in the Village (Village Parcel # 42 . 1 - 1 -53 . 5 ) .
Daniel Konowalow questioned Ms . Hudson if she had the access driveway deeded off in
any way for possible future land sale of the remaining property.
Mary Hudson indicated she had not .
• James Gillett, neighbor stated his property is broken up the same way. Mr. Gillett was
present to support Ms . Hudson in her efforts .

• The Board suggested/recommended that Ms . Hudson create a 40 ' easement to the parcel
that she will be building on.
Daniel Konowalow made a motion to close the Public Hearing at 7 : 08 PM . Linda
Hirvonen seconded. VOTE : ALL IN FAVOR. MOTION CARRIED .
Discussion
The consensus of the Board was this was a technical issue due to the way the Town and
Village separated the Zoning.
Linda Hirvonen read the Balancing Test as follows :
• Whether benefit can be achieved by other means feasible to applicant
No .
• Undesirable change in neighborhood character or to nearby properties ;
No .
• Whether request is substantial ;
No .
• Whether request will have adverse physical or environmental effects ;
No .
• • Whether alleged difficulty is self- created ;
No
Final Decision
Daniel Konowalow made a motion to accept the Area Variance . Wayne Lucas
seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UANIMOUSLY.
Linda Hirvonen completed the SEQR. Daniel Konowalow made a motion to declare
a negative declaration. Wayne Lucas seconded. VOTE : ALL IN FAVOR.
MOTION CARRIED UNANIMOUSLY,
Daniel Konowalow made a motion to adjourn the meeting at 7 : 23 PM . Linda
Hirvonen seconded . VOTE : ALL IN FAVOR. MOTION CARRIED
UNANIMOUSLY .
