Platt, Code Enforcement Officer * Bud Shattuck, Deputy Town Supervisor PUBLIC PRESENT John Hicks • Sylvia Hicks Daniel Pace Nancy Pace J. Scott Hicks GENERAL BUSINESS Stephen White, Chairman of the Board opened the meeting at 6 : 06 PM. Hick/Pace, Public Hearing-Relocation of Golf Driving Range on Waterwam Road, Parcel # 4204MI Mr. White began by reading the Public Notice article published in The Ithaca Journal . The Public Hearing was opened to the floor at 6 : 10 PM . No public comments were given. Mr. Daniel Pace introduced himself and wife Nancy to the Board Members and began his presentation by stating the number one reason for the relocation request is due to the water flow coming off North Triphammer Road. There has been a drainage issue in that area for a number of years, however, due to the recent regrading of North Triphammer Road last year the problem has worsened . Last year their current property was wet all • year long and business could not be conducted the way the Pace ' s wanted to . The Pace ' s would like to keep the location of the range in the same area for their existing cliental . Amended 4/ 1 /04 Stephen. White inquired as to what exactly were the Pace ' s plan for the proposed property as far as structures, landscaping, and buffers . Mr. Pace states an 1 , 800 square foot building (30 x 60) will be erected towards the front of the property. Berm hills will be located along the property on the sides and parking will be located in the front area towards the road. Pine Trees would be planted on the west side of the property as a buffer to the residential homes . The total number of acres involved will be approximately IS to 20 . The Tompkins County Fish & Game Club is located to the Southwest of the proposed property. Linda Hirvonen stated that people who want to build homes and move into that area find The Gun Club offensive . Linda firmly believes that the proposed site would be difficult to sell for residential purposes . Mr. Pace feels that this business would be a great buffer between the homes and the Gun Club . Linda Hirvonen questioned lighting and was advised by the Pace ' s that they didn ' t think it would be necessary. With the hours that they keep and the rate of NYSEG they didn ' t feel they needed additional lighting. Mr. Pace states in helping the Zoning Board ' s decision he would like to bring to their attention the fact that he would like to continue in the continuity of what they' ve been idoing for the last 13 years which is working with the Town of Lansing Recreation Department for the Youth Golf Program. This program is discounted tremendously to the Lansing residents . Stephen White, Chairman closed the Public Hearing at 6 : 31 PM. Linda Hirvonen read the following to the members . What is a Variance "Before the Board may exercise its discretion and grant a Variance upon the ground of unnecessary hardship , the record must show that : 1 . The land in question cannot yield a reasonable return if used only for a purpose allowed in that zone; Linda Hirvonen felt this is quite true. The land will not yield the return it should for residential purposes due to the Rod & gun Club . Daniel Konowalow felt there are a lot of possibilities such as anything that is allowed in the R2 Zone . Wayne Lucas agreed with Linda Hirvonen. Amended 4/ 1 /04 2 . That the plight of the owner is due to unique circumstances and not to the general conditions in the neighborhood which may reflect the unreasonableness of the Zoning Ordinance itself; Linda Hirvonen stated that the Rod & Gun Club has been there for a very long time and they have no intention of moving. 3 . That the use to be authorized by the Variance will not alter the essential character of the locality. " Wayne Lucas stated that basically all the Pace ' s are doing is moving a %z mile down the road with the same set up . Linda Hirvonen states the Rod & Gun Clubs adds the sporting aspect to the area which would coincide with what the Pace ' s are doing . Richard Platt commented to the members that the original Variance was granted to Mr. Pace even though Mr. Holt owned the property. The use at the current location can no longer be used by someone else once Mr. Pace vacates the property. Daniel Pace explained that he and his wife read the variance to say if they sold the business the use would not remain. If they dissolved up at their current location, the use would go back to the R2 restrictions . Ronald Bricker completed the SEQ R. Linda Hirvonen made a motion to declare a negative declaration. Wayne Lucas seconded . VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. Daniel Konowalow read the final question . 4 . Alleged hardship has not been self-created. All board members felt the hardship was not self-created. The Rod & Gun Club is the hardship that the members have identified and consequently difficulty using this property. Linda Hirvonen made a motion to grant the Variance to Mr. Hicks/Pace for the Use presented this evening. Wayne Lucas seconded. The following restriction will apply, only one ( 1 ) of the properties either/or be operated as a Driving Range not both simultaneously. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. Approval of January 29 2004 Minutes Daniel Konowalow states on page 3 , his vote was not recognized.
