Parcel # 42044 * 2 23 At 7 : 04 PM David Dittman opened the public hearing by reading the legal noticed published in the 24 Ithaca Journal regarding the public hearing for a variance request for 157 Waterwagon Road , Tax Map # 25 42 . - 1 - 1 . 2 , 26 Mr. Hicks stated that last year lie came before Mr. George Totman and had this parcel approved as a 27 marketable building lot. Due to the appropriate paperwork not getting filed within the 60 day time limit 28 with the Tompkins County Clerk, the approval was void . Mr. Hicks has an interested party whom 29 wishes to purchase this property. Ms . Hirvonen stated that Mr. Hicks has already lost one buyer which 30 that has created a hardship . 31 Mr. Platt passed out a letter of recommendation from the Tompkins County Planning Department 32 indicating that they recommend a disapproval of the proposal due to the site not being served by 33 municipal sewers and the lot square footage wound not meet County Health Department Sanitary Code 34 regulations . 35 Mr. Hicks indicated that he has spoken with John at the Tompkins County Health and was advised he • could install an engineer system in . As long as he had 30, 000 square feet he would be all set . 2 Town o Lansing Zoning Board of Appeals, November 20, 2002 1 According to the Tompkins County Department of Planning we must have a supermajority (meaning a 2 majority plus one) for this decision making. Mr. Platt will check into this further with the State to see 0 how we will have to handle this as two board members will be abstaining from voting . 4 Mr. Dittman asked the audience if they had any questions . No response from two guests .
