17 GENERAL BUSINESS
0 Steve Wright called the meeting to order at 7 : 02PM. Mr. Wright read the legal notice printed in the Ithaca
19 Journal regarding the public hearing for a variance request forl893 East Shore Drive, Tax Map #37 . - 1 -8- 5 .
20 Mr. Hunter stated that he is requesting permission to subdivide tax parcel #37 . - 1 - 8 -5 in order to sell his
21 apartment building and retain the single family home . The parcel is located in the B1 district, bordering
22 the R2 district . B1 requires 20, 000 S .F . per dwelling unit, but the R2 requires only 8 , 000 S .F . per
23 dwelling.
24 Mr. Hunter stated that at the time he built the apartments ( 12 - 13 yr. ago) it was not necessary to
25 subdivide or split the parcel , as there was no zoning in Lansing.
26 Steve Wright closed the public hearing at 7 : 06 PM .
27 David Dittman : The 3 . 6 acres parcel that the apartments are on, is that enough land to meet Zoning
28 codes?
29 Richard Platt: No that ' s where the problem occurs . In the R2 zone it is 8 ,000 S . F . per dwelling and the
30 B 1 requires 20,000 S .F . The property has it ' s own septic within the boundaries .
31 Wayne Lucas : Is that a raised bed septic?
32 Malcolm Hunter: Yes, 3 of them. The map only shows one, but there is one behind each building.
33 Steve Wright : Is it possible to purchase property around yours to increase the lot size so that you may
34 comply with zoning?
• Malcolm : I have no idea, I had not tried to buy any.
36 Richard Platt : Passed out a copy of the #239 from the County stating no negative impacts .

1 Wayne Lucas : The flag lot next to the property couldn ' t be purchased because it has a NYSEG right-of-
way (power lines and gas lines) .

3 Steve Wright: What would an acre in that location cost?
4 Linda Hirvonen : If it was a buyable building lot, it cost be as much as $ 15 , 000 . 00 per acre.
5 Steve Wright completed the SEAR. The members of the Zoning Board of Appeals voted unanimously
6 to declare a negative declaration.

9 1 . Whether the benefit sought by the applicant can be achieved by some method, feasible for the
10 applicant to pursue, other than an area variance;

4 Based upon these findings, Wayne Lucas motioned to accept the Variance. Linda Hirvonen
5 seconded. VOTE : Wayne Lucas - Aye

9 The motion carried unanimously.
