Mr. Dittman read the legal notice in the Ithaca Journal 16 regarding the public hearing for a variance request for 1148 , 1152 & 1158 Ridge Road, Tax Parcel 16 . - 1 - 19 40 . 1 . 20 Mr. Tuttle stated that he and his spouse would like to subdivide their parcel so they may obtain a 21 mortgage on their home . The Tuttles have resided at this location for approximately 9 years and have 22 put a lot of hard work into their place . They would like to have their own separate parcel . 23 Mr. Dittman advised Mr. Tuttle that when he purchased his land there was an adjacent property that had 24 been sub-divided, however that was permitted before zoning took effect . 25 Linda Hirvonen questioned whether The Tuttles had received the Health Departments acceptance. 26 Richard Platt states he has received two separate letters of acceptance, one from the Tompkins County 27 Health Department and the other from the Tompkins County Planning Department . 28 Stephen Wright asked if Mr. Tuttle had inquired of his neighbors if they would sell him enough property 29 to allow his lot to comply with the zoning regulations . 30 Mr. Tuttle states he is able to purchase land from Mr. Worsell , however, the price he is requesting per 31 acre is awfully high . The price would be $ 5 ,000 . 00 for aback lot and $ 10,000 . 00 for the front lot with a 32 minimum purchase of 5 acres . He can not justify spending $30, 000 . 00 . 33 Stephen Wright asked Mr. Tuttle what he thought the approximate value of his house was right now . 34 Allen Tuttle replied he thought it was in the price range of $ 120,000 . 00 to $ 150,000 . 00 . 6 Stephen Wright questioned Mr. Tuttle regarding the sharing of utilities . Allen Tuttle states there are no sharing of utilities . There is one water valve that is split. 37 Stephen Wright asked if that would be a problem if The Tuttles were to sell . 2 Town o Lansing Zoning Board ofjppeals, April 23, 2002 1 2 Allen Tuttle replied no , all they would have to do is place another meter. 03 David Dittman closed the Public Hearing at 7 : 19 PM . 4 Stephen Wright read the SEAR. Linda Hirvonen motioned to declare a declaration . Stephen Wright 5 seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY . 6 The board discussed the conditions of an area variance. 7 FINDINGS : 8 1 . Whether the benefit sought by the applicant can be achieved by some method, feasible for the 9 applicant to pursue, other than an area variance ; 10 VOTE : Wayne Lucas -No 11 David Dittman -No 12 Linda Hirvonen -No 13 Stephen Wright -No 14 2 . Whether an undesirable change will be produced in the character of the neighborhood or a 15 detriment to nearby properties will be created by the granting of the area variance. 16 VOTE : Wayne Lucas - No 17 David Dittman - No 18 Linda Hirvonen - No 19 Stephen Wright - No 20 3 . Whether the requested area variance is substantial ; VOTE : Wayne Lucas - No 72 David Dittman - No 23 Linda Hirvonen - No 24 Stephen Wright - No 25 4 . Whether the proposed variance will have an adverse effect or impact on 26 the physical or environmental conditions in the neighborhood or district; 27 VOTE : Wayne Lucas - No 28 David Dittman - No 29 Linda Hirvonen - No 30 Stephen Wright - No 31 Steve White - No 32 5 . Whether the alleged difficulty was self-created , which consideration shall be relevant to the 33 decision of the board of appeals, but shall not necessarily preclude the granting of the area 34 variance . 35 VOTE : Wayne Lucas -No 36 David Dittman -No 37 Linda Hirvonen -No 38 Stephen Wright -No 39 40 Based upon these findings, Linda Hirvonen motioned to approve the variance .
