110 - Tim DeRuyscher reviewed the report he has provided.
111 - Wayne Matteson, PE and Russell Wark, representatives of Mirabito,joined the meeting.
112 - Wayne Matteson commented that the application pertains to the use of petroleum bulk
113 storage and it is understood that any activities would be done within NFPA, DEC, EPA
114 etc. guidelines.
115 - Russell Wark commented that they do not understand why Mirabito has to go above
116 and beyond of what is permitted.
117 - Tim DeRuyscher explained that total reliance on the local responding fire department
118 could be problematic.

119 - Wayne Matteson stated that this is Phase 2, so most of the details would have been
120 provided during Phase 1. Deb Trumbull countered that they knew that it was going to
121 happen, but not how it was going to happen.
122 - There were concerns over storm water pollution in the event of an emergency.
123 - The Planning Board would like to see a protective tank or a barrier wall used on the
124 Mirabito site.
125 - The Planning Board would like more information on the type of tank Mirabito plans to
126 use.
127 - The Planning Board reviewed the SEQRA Review of Full Environmental Assessment Form

129 - The Highway Department plans to reopen the access road onto Peruville Road. The
130 Planning Board would like more information regarding the intention for the use of the

166 WHEREAS, an Application was submitted for Subdivision review by Max Heitner of Finger Lakes
167 Land Trust for William and Jean Lee Sims, Owners, for the proposed subdivision of the existing

181 primary responsibility for approving and funding or carrying out the action; and

183 WHEREAS,The Planning Board of the Town of Lansing is believed best suited to review the
184 impacts of this proposed Subdivision as (i) the Planning Board is the only body with jurisdiction
185 to classify the Subdivision and issue the final Subdivision approval, (ii)the Planning Board is best
186 situate to understand and evaluate the potential unique impacts of such Subdivision upon the
187 Town based upon the developmental patterns, topography, and unique natural and non-
188 natural features of the Town of Lansing, including known streams, wetlands, UNAs, agricultural
189 resources of value, and archeosensitive sites within or near the Major Subdivision area, (iii) the
190 Planning Board has the broadest governmental powers for investigating the potential or actual
191 impacts of the Subdivision and implementing conditions or mitigating controls, and accordingly
192 (iv) the Planning Board has the greatest capacity for providing the most thorough
193 environmental assessment of the proposed Subdivision; and

195 WHEREAS, this proposed action is an Unlisted Action for which the Town of Lansing Planning
196 Board is the sole involved agency for the purposes of a State Environmental Quality Review Act

301 WHEREAS, the Planning Board has considered and carefully reviewed the requirements of the
302 LUO relative to site plan review and subdivision review, the unique needs of the Town due to
303 the topography, the soil types and distribution, and other natural and man-made features upon
304 and surrounding the area of the proposed site plan, and the Planning Board has also considered
305 the zoning in the area and the project in light of the Town's Comprehensive Plan and
306 compliance therewith, and as the underlying use is a permitted use in the zone in which
307 located; and

309 WHEREAS, upon due consideration and deliberation by the Town of Lansing Planning Board,
310 now therefore be it RESOLVED as follows:

312 1. That the Planning Board of the Town of Lansing determines the proposed project will
313 result in no significant impact on the environment and that a Negative Declaration for
314 purposes of Article 8 of the Environmental Conservation Law be filed in accordance with
315 the provisions of Part 617 of the State Environmental Quality Review Act for the Site Plan
316 approval for Town of Lansing Tax Parcel Number 37.1-2-19 for Mitchell Munson, Owner,
317 on behalf of Munson Tires, LLC.

318 2. That the Planning Board of the Town of Lansing does hereby grant Preliminary and Final
319 Site Plan approval for Town of Lansing Tax Parcel Number 37.1-2-19 for Mitchell
320 Munson, Owner, on behalf of Munson Tires, LLC, which includes all parking layouts,
321 screening, dark sky lighting, and other site improvements depicted in "Sketch Map: No.
322 17 Peruville Road, Town of Lansing, County of Tompkins, State of New York" dated
323 9/6/2018 (revised 3/11/2021) by T.G. Miller, P.C., Engineers and Surveyors subject to
324 the following conditions:
325 a. Compliance with the recommendations of the Town's Engineer and SMO for any
326 final stormwater plans prior to the issuance of any certificate of occupancy or
327 compliance for the Project.
328 b. Building Permits are required to construct the approved building and site
329 facilities. Plans must meet all code requirements, including the sealing of plans
330 by a licensed engineer or architect. All improvements shall be constructed in
331 compliance with all state and local building code requirements.
332 c. In accordance with Town Code § 270-27(K), this site plan approval is valid for
333 only 36 months from the date hereof, and the applicant/owner is required to
334 commence and substantially complete the construction or other activities for
335 which the site plan is applicable within said 36 months or this approval shall,
336 unless extended upon application timely made, expire, lapse, and be of no
337 further validity, force or effect.
338 d. Compliance with curb cut and NYSDOT permit conditions and requirements,
339 including receipt of final NYSDOT approval or permit close-out for any curbing or
340 driveway, culvert, or related land use designs or improvements as may be
341 emplaced upon or adjacent to any existing highway right-of-way or public
342 highway. Modification of vehicular ingress and egress requires modification of
343 Site Plans, and this approval, by the Planning Board.
344 e. The applicant must be issued a Sign Permit in compliance with Town Code
345 Chapter 210 to erect, install, build, place, emplace, site, or substantially rebuild
346 or repair any signs.
347 f. All plantings (including as shown on planting schedule described above) shall be
348 maintained as healthy and natural non-invasive vegetation designed to provide
349 both visual and sound buffering. Existing and any new vegetation shall be
350 properly maintained and any dead, diseased, or dying trees or plants shall be
351 promptly replaced, and any tree or plants that, whether singularly or in

352 combination, due to lack of growth, death, recession, disease or other cause,
353 cease to function as buffers shall be replaced in a manner as promotes the goal
354 of such buffer as stated in this site plan approval. This condition shall be deemed
355 to augment and further define prior site plan approval conditions and site plan
356 features hereby or heretofore approved by the Town.
357 g. All new lighting fixtures will be "dark sky compliant" glare-free, downward
358 directed, and shielded lighting as promotes the dark-sky standards of the
359 International Dark-Sky Association (IDA) and lamps will be not higher than 3000K
360 CCT to minimize adverse human and ecological impacts.
361 h. Documentation from New York State Electric & Gas (NYSEG) utility consenting to
362 emplacement of permanent structure within the existing overhead electric
363 transmission line easement prior to the issuance of any certificate of occupancy
364 or compliance for the Project.
