Applicants have concurrently applied for a 86 Special Use Permit considered under Town of Lansing Code § 270-36 at the March 17, 2021 87 Town Board meeting. The property is located partially in the Residential Low Density (R1) 88 Zoning District and partially in the Residential Mixed Use (R3) Zoning District. The 3.5 acres the applicant would like to use as 97 pasture is in the R1 Zone. 98 - The Planning Board did receive a letter of support from a neighbor. 99 - Applicant Dean Shea was placed in the waiting room. 100 101 RESOLUTION PB 21-03 102 103 TOWN OF LANSING PLANNING BOARD RESOLUTION — PRELIMINARY AND FINAL SITE PLAN 104 APPROVAL FOR FARMING - LIVESTOCK AT 416 ASBURY ROAD, TAX PARCEL NO. 38.-1-38 105 106 WHEREAS, an Application was submitted for Special Use Permit and Site Plan approval by Dean Shea, 107 Applicant and Owner, for keeping of livestock on the existing 10.09-acre Tax Parcel No. 38.-1-38 (416 108 Asbury Rd), located partially in the Residential Low Density (R1) Zoning District and partially in the 109 Residential Mixed Use (R3) Zoning District; and 110 111 WHEREAS, this is a proposed action reviewed under Town of Lansing Code § 270-35(Q), § 270-36 (A) 112 Special Conditions and Special Use Permits and § 270-36 Site Plan Review, for which the completed 113 application was received November 17, 2020; and 114 115 WHEREAS, this action was determined to be a Type II Action under 6 NYCRR 617.5(c)(4) of the 116 State Environmental Quality Review Act ("SEQRA"); and Page 3 of 23 APPROVED 117 118 WHEREAS, this Board did on March 22, 2021, review and accept as adequate: "Survey for Michael A. 119 and Melanie A. Collier, Town of Lansing, County of Tompkins, State of New York" dated 6/26/1985 by 120 George C. Schlecht; Short Environmental Assessment Form Part 1; Agricultural Data Statement; brief 121 statement describing the project and Animal Waste disposal plan; correspondence with Tompkins 122 County Health Department; and other application materials; and 123 124 WHEREAS, 600 feet parcel notices were mailed on March 2, 2021 and the Town Board duly held a 125 Public Hearing on March 17, 2021 on the Special Use Permit application wherein all evidence and 126 comments were considered, along and together with the requirements of the Town's Code, existing 127 development in the surrounding area, the public facilities and services available, the Town's 128 Comprehensive Plan and land use regulations, and site characteristics and issues; and 129 130 WHEREAS, this action is exempt from New York State General Municipal Law §239 -I, -m, and -n 131 referral requirements as Special Use Permits for permitted accessory uses on residential lots are 132 excluded per an Inter-Governmental Agreement between the Tompkins County Planning Department 133 and the Town of Lansing dated December 17, 2003; 134 135 WHEREAS, in accordance with Town Code § 270-36B(1), on December 22, 2020 the Planning Board 136 passed a Motion RECOMMENDING TOWN BOARD AUTHORIZE SPECIAL USE PERMIT FOR FARMING— 137 LIVESTOCK AT 416 ASBURY ROAD, TAX PARCEL NO. 38.-1-38, FINDING THAT THE SPECIAL CONDITIONS 138 OF § 270-35(Q) and GENERAL REQUIREMENTS 270-36(A) HAVE BEEN COMPLIED WITH; and 139 140 WHEREAS, on March 17, 2021 the Town Board authorized the Special Use Permit under Town 141 Code § 270-36 (A), after a duly advertised public hearing, making the following findings for the 142 aforementioned: (1) That the proposed land use or activity is to be located, constructed, and 143 operated so that the public health, safety and general welfare will be protected; and (2) that 144 the existence of the proposed land use or activity will not cause substantial injury to the value 145 of other property in the surrounding neighborhood; (3) that adequate landscaping and 146 screening is to be provided; and (4) that adequate off-street parking and loading is provided 147 and the ingress and egress are so designed as to cause minimum interference with traffic on 148 abutting roads; and (5) that the proposed land use or activity will not result in excessive erosion 149 and will not increase the volume or velocity of surface water runoff onto abutting properties; 150 and (6)that any proposed water and/or sewage disposal system is determined by appropriate 151 jurisdictional authority to be adequate; and (7)that vibration, glare, odor, heat or noise 152 anticipated from the proposed use can be mitigated; and 153 154 WHEREAS, the Planning Board has considered and carefully reviewed the requirements of the 155 LUO relative to site plan review and subdivision review, the unique needs of the Town due to Page 4 of 23 APPROVED 156 the topography, the soil types and distribution, and other natural and man-made features upon 157 and surrounding the area of the proposed site plan, and the Planning Board has also considered 158 the zoning in the area and the project in light of the Town's Comprehensive Plan and 159 compliance therewith, and as the underlying use is a permitted use in the zone in which 160 located; and 161 162 WHEREAS, upon due consideration and deliberation by the Town of Lansing Planning Board, 163 now therefore be it RESOLVED as follows: 164 165 That the Planning Board of the Town of Lansing does hereby grant Preliminary and Final Site 166 Plan approval for Town of Lansing Tax Parcel Number 38.4-38 for Farming— Livestock, subject 167 to the following specifications and conditions: 168 169 1. In accordance with Town Code § 270-27(K), this site plan approval is valid for only 36 170 months from the date hereof, and the applicant/owner is required to commence and 171 substantially complete the construction or other activities for which the site plan is 172 applicable within said 36 months or this approval shall, unless extended upon 173 application timely made, expire, lapse, and be of no further validity, force or effect. 174 2. Matteson, Jr., P.E., on behalf of Mirabito Holdings, Inc., Owner 196 Location: 15 Town Barn Rd; Tax Parcel No. 30.-1-16.25 197 Anticipated Board action(s)this month: SEQRA Declaration of Lead Agency; Classification of 198 Action; Public Hearing 199 Project Description: The Applicant is proposing Site Plan approval for construction of three (3) 200 30,000-gallon petroleum bulk storage tanks alongside the existing 30,000-gallon propane 201 storage tank (approved via Planning Board Resolution 16-09 on May 9, 2016, amended 202 September 26, 2016) and a 4,000 SF garage structure, a 1,600 SF office building, 10-15 parking 203 spaces, and other site improvements on the existing 3.05-acre parcel.The property is located in 204 the General Commercial (132) Zoning District. This is anticipated to be an Unlisted or Type 1 205 Action under the State Environmental Quality Review Act 6 NYCRR 617.4(b)(6)(v)and is subject 206 to environmental review. 207 Project submittals are located at: https://Ifweb.tompkins- 208 co.org/WebLink/Browse.aspx?id=48000&dbid=7&repo=Lansing 209 210 Summary of Discussion: 211 - The Planning Board members discussed the need for Stormwater Management, in 212 addition to what they have already done in Phase 1. 213 - The Planning Board members discussed safety concerns they have, including lack of 214 protection around the existing tank and the haphazard appearance of the small tanks on 215 the site. 216 Motion to Open Public Hearing for Lansing Propane/ Petroleum Storage and Distribution 217 Facility(Phase 2) at 7:07PM 218 Moved by: Norman L. Davidson Seconded by: Dean Shea (Motion Carried) 219 220 Summary of Discussion: 221 - Applicants Brett Hughes and Wayne Matteson, representatives of Mirabito,joined the 222 meeting. 223 - Mirabito has submitted a new application to construct three 30,000 gal. petroleum bulk 224 tanks. They have amended the proposal to eliminate the additional propane tank. 225 - During Phase 1 of this project, the applicant was required to complete the Stormwater 226 plan for the full buildout of the project. 227 - Planning Board member Dean Shea provided photographs of the lights on the Mirabito 228 site. 229 o There is a light that is casting directly onto the existing propane tank. The light 230 has been confirmed to belong to Mirabito, not the Town Barn. Page 6 of 23 APPROVED 231 - The office and garage buildings will provide a buffer to the properties to the South. 232 - Project Engineer Wayne Matteson explained how the tanks will be contained. 233 - Brad George, Fire Chief, and Tim DeRuyscher, PE, FSFPE, RAN Fire Protection 234 Engineering,joined the meeting. 235 - Brad George stated that with the removal of the second propane tank from the 236 application, he no longer sees it necessary to install a deluge system. 237 - Multiple Board Members would like to see Town Barn Road extend back out to Peruville 238 Road. 239 - Tim DeRuyscher will be providing a memorandum evaluating the proposal for and 240 current conditions at the site. 241 - Community member Deb Harper joined the meeting. She questioned if the Mirabito 242 project was an allowed use, which it is in the IR zone. 243 - Community member Joe Williams joined the meeting. He provided pictures of the 244 lighting issue from his home on Peruville Road. He does have concerns over safety. 245 - Heather Dries, Planning Clerk, read an email into record. 246 o From Ruth Hopkins: I am out of town but wish to have my comments read at the 247 Planning Board this evening, either at a public hearing if appropriate or during 248 privilege of the floor.Thank you. 249 Comment on proposed increased propane facility. The addition of three to five 250 30,000 gallon propane tanks to the area behind the Lansing appears to be a 251 change from a local distribution center to a large regional distribution center. 252 A full environmental impact is needed. Increased fuel trucks will further degrade 253 the center of our town. Greatly increased numbers of fuel trucks will increase 254 likelihood of vehicle accidents involving flammable materials. The worst hazard 255 associated with regional propane centers are the truck accidents. How have this 256 and other increased hazard risks been assessed. 257 Most towns and counties site these facilities far away from residential areas, and 258 shopping. Please share the full environmental review with our community and 259 allow us to comment BEFORE any approval is begun. 260 Please tell us the plans for the adjacent lands that were recently cleared making 261 this entire heavy industrial facility visible to the residential area and everyone 262 passing through the center of town. 263 Motion to Close Public Hearing for Lansing Propane/ Petroleum Storage and Distribution 264 Facility(Phase 2) at 8:31PM Page 7 of 23 APPROVED 265 Moved by: Dean Shea Seconded by: Deborah Trumbull (Motion Carried) 266 267 RESOLUTION PB 21-04 268 269 STATE ENVIRONMENTAL QUALITY REVIEW RESOLUTION —DECLARATION OF LEAD AGENCY— 270 MIRABITO HOLDINGS LANSING PROPANE/ PETROLEUM STORAGE AND DISTRIBUTION 271 FACILITY SITE PLAN (PHASE TWO), 15 TOWN BARN RD, TAX PARCEL NO. 30.4-16.25 272 273 WHEREAS, 6 NYCRR§ 617 of the State Environmental Quality Review Act ("SEQRA") requires that 274 a Lead Agency be established for conducting environmental review of projects in accordance with 275 state environmental law and the Lead Agency shall be that local agency which has primary 276 responsibility for approving and funding or carrying out the action; and 277 278 WHEREAS, an application was made by Wayne C. Page 9 of 23 APPROVED 342 - Planning Board member Tom Butler has concerns over the lack of consideration of heat 343 pumps. 344 - Applicants provided two exterior color choices; Planning Board preference was option B. 345 - Applicants will forward the response to the County Planning letter regarding the 346 consideration of the 4 energy elements as per the Tompkins County Energy 347 recommendations. 348 349 ZESOLUTION PB 21-05 350 351 TOWN OF LANSING PLANNING BOARD RESOLUTION —STATE 352 ENVIRONMENTAL QUALITY REVIEW (SEAR) NEGATIVE DECLARATION AND PRELIMINARY AND 353 FINAL SITE PLAN APPROVAL AND PRELIMINARY AND FINAL MINOR SUBDIVISION APPROVAL— 354 DOLLAR GENERAL RETAIL STORE, SITE PLAN REVIEW AND MINOR SUBDIVISION, AUBURN RD, 355 TAX PARCEL NO. 5.-1-32 356 357 WHEREAS, an application was made by Steve Vukas, Bohler Engineering MA, LLC on behalf of 358 Franklin Land Associates, LLC, Owners, for construction of a 9,100 sq. ft. retail store with parking 359 and other site improvements and subdivision of the existing 5.729-acre parcel, Lansing, New 360 York, TPN 5.-1-32, located in the Rural Agricultural (RA) Zoning District; and 361 362 WHEREAS, this is a proposed action reviewed under Town of Lansing Code § 270-27 Site Plan 363 Review and § 235-6 Minor Subdivision, for which the respective completed applications were 364 received August 28, 2020; and 365 366 WHEREAS, 6 NYCRR§ 617 of the State Environmental Quality Review Act ("SEQRA") requires that 367 a Lead Agency be established for conducting environmental review of projects in accordance with 368 state environmental law and the Lead Agency shall be that local agency which has primary 369 responsibility for approving and funding or carrying out the action; and 370 371 WHEREAS, the Planning Board, being the local agency which has primary responsibility for 372 approving the action, did on October 26, 2020 declare itself the Lead Agency for the 373 environmental review; and 374 375 WHEREAS, this proposed action is an Unlisted Action for the purposes of a State Environmental 376 Quality Review Act ("SEQRA") review, and the Lead Agency is conducting a coordinated review; 377 and 378 Page 10 of 23 APPROVED 379 WHEREAS, Notice of Intent to declare Lead Agency was distributed to NYS Department of 380 Environmental Conservation (DEC), NYS Department of Transportation (DOT), Tompkins County 381 Health Department on November 6, 2020; and 382 383 WHEREAS, letter from NYSDOT Region 3 dated November 23, 2020 expressed no objections to 384 the Town of Lansing Planning Board assuming lead agency status for SEQRA purposes and 385 equivalent correspondence was received from Tompkins County Health Department on 386 February 3, 2021; and 387 388 WHEREAS, legal notice was published on February 16, 2021 and adjacent property owners within 389 1200 feet were notified by mail on February 16, 2021, and pursuant to Town Code § 270-27(F); 390 and 391 392 WHEREAS, a public hearing was duly held before the Planning Board upon February 22, 2021, 393 and the public was duly allowed to speak upon and address the proposed Subdivision and Site 394 Plan, including the SEAR environmental review thereof, whereafter the Planning Board 395 considered approval of the Subdivision and Site Plan upon receipt of final stormwater input and 396 SWPPP updates, all including and in accordance with the provisions of the Town Code § § 270- 397 27(D); et seq., and including concerns addressing site drainage, lighting, nearby residences, 398 landscaping, and buffering/screening, driveway and any potential on and off site environmental 399 impacts; and 400 401 WHEREAS, the Tompkins County Department of Planning and Sustainability, Tompkins County 402 Highway Department, and Town of Lansing Highway Department were given the opportunity to 403 comment on the proposed action; and 404 405 WHEREAS, Project plans, and related information, were duly delivered to the Tompkins County 406 Planning and Sustainability Department per General Municipal Law § 239; et seq., and such 407 Department responded in a March 18, 2021 letter from Katherine Borgella, Tompkins County 408 Commissioner of Planning, pursuant to §239 -1, -m, and -n of the New York State General 409 Municipal Law recommended the following modification of the proposal: 410 • We recommend the Town require the applicant to document that they have considered 411 the four energy elements for new construction projects outlined in the attached 412 Tompkins County Energy Recommendations for New Construction (2018).
