HomeMy WebLinkAbout21-01 PB Hatfield - Wildlife Resolutions Neg Dec SPRRESOLUTION PB 21-01 TOWN OF LANSING PLANNING BOARD RESOLUTION - STATE ENVIRONMENTAL QUALITY REVIEW (SEQR) NEGATIVE DECLARATION AND PRELIMINARY AND FINAL SITE PLAN APPROVAL, HATFIELD/ WILDLIFE RESOLUTIONS ADAPTIVE REUSE AND REQUEST FOR EXTENSION OF TOWN BARN ROAD, TAX PARCEL NO.30.4-23, TOWN OF LANSING, NEW YORK WHEREAS, an application was made by John Hatfield, Owner, for adaptive reuse of existing 1,200 s.f. structure, construction of site improvements, emplacement of sign on, as well as request for extension of Town Barn Road to, the existing 7.75-acre parcel, currently numbered 96 Peruville Rd., Lansing, New York, TPN 30.-1-23, located in the Industrial / Research (IR) Zoning Dish; and WHEREAS, 6 NYCRR § 617 of the State Environmental Quality R7whlicVa ct QRA") requires that a Lead Agency be established for conducting environmental review rdance with state environmental law and the Lead Agency shall be that local imary responsibility for approving and funding or carrying out the action; and ?SU WHEREAS, the Planning Board, being the local agency ycai y responsibility for approving the action, did on November 23, 2020 declare itselfke Lea;1 the environmental review; and WHEREAS, this is a proposed action reviewe er Thwn of Lansing Code § 270-7 Site Plan Review for which the respective completed applicv s recei* October 30, 2020; and WHEREAS, this proposed action ' an U sted ti(Tn for the purposes of a State Environmental Quality Review Act ("SEQRA") w; a WHEREAS, this Board, act' g a ad Agency n environmental review, did on November 23, 2020 and January 25, 2021, revie d a pt as adequate: drawings titled "Survey Map Showing Proposed Parcel to be Medicate as Town Barn Road Extension, Town of Lansing, Tompkins County, State of New York,"prepared by T.G. Miller, P.C. Engineers and Surveyors, dated 10/16/2019; "Survey Map No. 196 & 100 Peruvil�e Road, Town of Lansing, Tompkins County, State of New York," prepared by T.G. Miller, P.C. Engineers and Surveyors, dated 4/25/2008; a Short Environmental Assessment Form (SEAF), Part 1, submitted by the Applicant, and Parts 2 and 3, prepared by Plannin taff, reviewed and amended by the Planning Board as Lead Agency; and other application mat ials, and WHEREAS, the Tompkins County Highway Department and Town of Lansing Highway Department were given the opportunity to comment on the proposed action; and WHEREAS, the Town Board of the Town of Lansing on January 20, 2021 approved Resolution 21-04 Declaring Consent and Approval of Town Board to the Laying Out and Opening of Town Barn Road Extension as Dedicated Public Highways of the Town Of Lansing Pursuant To Highway Law § 171 and said Order was filed with the Town Clerk on January XX, 2021; and WHEREAS, a negative declaration of environmental impacts was duly issued under the State Environmental Quality Review Act (SEQRA) in respect of this action, and it is further noted that this action is exempt from the General Municipal Law County Planning referral requirements of General Municipal Law ("GML") §§ 239-1, 239-m, and 239-n through an Inter -Governmental Agreement between the Tompkins County Planning Department and the Town of Lansing dated December 17, 2003, as "Site Plan Reviews or Special Permits for change of commercial use in an existing building not involving any change in building footprint and with no change in vehicular access on tate or County highway" are excluded from GML referral requirements; and WHEREAS, the Planning Board has considered and carefully reviewed the requirements of UO relative to site plan review, the unique needs of the Town due to the topography, the soil types and distribution, and other natural and man-made features upon and surrounding the area of the proposed site plan, and the Planning Board has also considered the zoning in the Nrea and the project in light of the Towns Comprehensive Plan and compliance therewith, and as thederlying use is a permitted use in the zone in which located; and WHEREAS, upon due consideration and deliberation by the Town of Lans Planning Board, now therefore be it RESOLVED as follows: 1. That the Planning Board of the Town of Lang"denesproposed project will result in no significant impact on the environmerAiLid that a NeNve Declaration for purposes of Article 8 of the Environmental Conservation Law be filed in accordance with the provisions of Part 617 of the State Environmental Quality Review Act for the action of Site Plan approval for Town of Lansing Tax Parcel Number 30,E 1-23 for John Hatfield, Applicant and Owner. 2. That the Planning Board of the Town of Lansing does hereby grant Preliminary and Final Site Plan approval for Town of Lansing Tax Parcel Number 30.-1-23 for John Hatfield, Applicant and Owner, subject to the following conditions: a. Compliance w�h the recommendations of the Towri s Engineer and Stormwater Management Officer for any stormwater plans and proper completion of any required stormwater reports, permits, and facilities in a form and manner as approved by the Town and NYSDEC, is required prior to the issuance of any certificate of occupancy or compliance for the Project. b. The applicant will be required to obtain a Bolton Point water permit for any water service and meter improvements to connect to the existing Consolidated Water District Mains, as well as a Tompkins County Health Department Onsite Wastewater Treatment Systerrl�OWTS) permit, both as pre -conditions to obtaining any Certificate of Occup,ancy ("CO"). In afflFordance with Town Code § 270-27(K), this site plan approval is valid for only 36 nths from the date hereof, and the applicant/ owner is required to commence and substantially complete the construction or other activities for which the site plan is applicable within said 36 months or this approval shall, unless extended upon application timely made, expire, lapse, and be of no further validity, force or effect. d. Modification of vehicular ingress and egress requires Modification of Site Plan by the Planning Board. e. The applicant must be issued a Sign Permit in compliance with the Towns Sign Local Law (#1 of 2014) in order to erect, install, build, place, emplace, site, or substantially rebuild or repair any Sign.
