40 - Privilege of the floor-John Howell requested a temporary Court Clerk, which was
41 approved.
42 - Board members gave their reports.
43 - Consent Agenda- several resolutions were passed.
44 o There was a motion authorizing the Town Supervisor to sign an agreement
45 between the Town of Lansing and Food Net/Meals-on-Wheels.
46 o There was a motion to approve carryover of vacation time exceeding 40hrs.
47 o There was a resolution authorizing acceptance of the bid issuance of Notice of
48 Award and Contract to Cayuga Commercial Cleaning for the Town Hall and
49 Community Building for custodial services.
50 o There was a resolution to hire a full-time Information Aide for the Supervisors
51 office, and a part-time Information Aide for the Clerks office.
52 o There was a resolution approving the Town of Lansing Conservation Advisory
53 Council 2020 Annual Report.

68 Project Description: The Applicant is proposing a Major Subdivision for ten (10) residential

70 Public Hearing was held on July 27, 2020. The Planning Board as Lead Agency made a Negative
71 Declaration of Environmental Significance on July 27, 2020. The proposed subdivision plat may
72 include drainage easements to be dedicated to the Town. This is an Unlisted Action under the

86 WHEREAS, an Application was submitted for Major (Conservation) Subdivision review by
87 Timothy Buhl, P.E., Applicant, on behalf of Scotty & Wayne Britton, Owners, for the proposed
88 subdivision for ten (10) residential building lots on 9.7 acres of land located on Triphammer
89 Road, Lansing, New York, also known as Tax Parcel Number 37.1-4-2.12 in the Residential Low
90 Density (R1) Zoning District; and

92 WHEREAS,this is a proposed action reviewed under §235-7 and §235-8 of the Town of Lansing
93 Code, for which the completed application was received December 2, 2019; and

95 WHEREAS, the Applicant proposes to subdivide the existing 9.7-acre property into ten parcels:
96 Parcel 1, measuring 27,115.4 s.f.; Parcel 2, measuring 29,688.7 s.f.; Parcel 3, measuring
97 36,739.9 s.f.; Parcel 4, measuring 35,759.3 s.f.; Parcel 5, measuring 33,455.7 s.f.; Parcel 6,
98 measuring 33,529.6 s.f.; Parcel 7, measuring 40.268.0 s.f.; Parcel 8, measuring 29,818.1 s.f.;

102 WHEREAS,the Planning Board has considered and carefully reviewed the requirements of the
103 Town's local laws relative to subdivisions and the unique needs of the Town due to the
104 topography, the soil types and distributions, and other natural and man-made features upon
105 and surrounding the area of the proposed subdivision, and the Planning Board has also
106 considered the Town's Comprehensive Plan and compliance therewith; and

108 WHEREAS, this is an Unlisted Action under the State Environmental Quality Review Act and is
109 subject to environmental review; and

111 WHEREAS, this Board, acting as Lead Agency in environmental review, did on July 27, 2020,
112 review and accept as adequate: drawings titled "Final Plat— Lands of Wayne Britton and Scotty
113 Britton, Town of Lansing, County of Tompkins, State of New York," prepared by Owasco Land
114 Surveying, dated June 8, 2020; Drawings ST-1 through ST-11 dated 1/12/2020, and a Short
115 Environmental Assessment Form (SEAF), Part 1, submitted by the Applicant, and Parts 2 and 3,
116 prepared by Planning staff, reviewed and amended by the Planning Board as Lead Agency; and
117 other application materials; and

119 WHEREAS, this Board, acting as Lead Agency in environmental review, did on July 27, 2020
120 make a Negative Declaration of Environmental Significance via Planning Board Resolution 20-
121 07; and

123 WHEREAS, the Planning Board recognizes that information received and reviewed for this
124 Major Subdivision indicates the resultant parcels have modified applicable area requirements
125 otherwise required in the Residential Low Density (R1) Zoning District to allow Conservation
126 Subdivision design; and

128 WHEREAS,this action was referred to Tompkins County Highway Department and comments
129 were received from John T. Webert, P.E., on July 8, 2020; and
130
131 WHEREAS, Project plans, and related information, were duly delivered to the Tompkins County
132 Department of Planning and Sustainability per General Municipal Law § 239, et seq and
133 Commissioner Katherine Borgella responded by letter dated July 27, 2020 and determined that
134 the Project has no negative inter-community or county wide impacts; and
135
136 WHEREAS, Town Engineers T.G. Miller, P.C. have reviewed the Stormwater Pollution Prevention
137 Plan ("SWPPP") and offered comments in letters dated January 27, 2020,June 29, 2020, and
138 December 2, 2020, which resulted in a revised SWPPP, prepared by Timothy C. Buhl, P.E., duly
139 submitted on July 16, 2020 (dated September 2019, REV December 2020); and
140
141 WHEREAS, on July 27, 2020, the Planning Board reviewed and considered the aforementioned
142 subdivision application and duly held a Public Hearing on the Major (Conservation) Subdivision
143 application, and all evidence and comments were considered, along and together with the
144 requirements of the Town's subdivision regulations, existing development in the surrounding
145 area, the public facilities and services available, the Town's Comprehensive Plan and the Land
146 Use Ordinance, site characteristics and issues, and any potential on- and off-site environmental
147 impacts; and

149 WHEREAS, upon due consideration and deliberation by the Town of Lansing Planning Board,
150 now therefore be it

152 RESOLVED, that the Town of Lansing Planning Board grants Final Subdivision Plat approval for
153 the Britton Woods Major (Conservation) Subdivision:

155 1. Submission for signing by the Chairperson or Vice Chairperson of the Planning Board of
156 four (4) raised-seal prints, signed by a land surveyor or engineer duly licensed in the State of
157 New York, of the approved final subdivision plat, prior to filing with the Tompkins County Clerk,
158 and submission of a copy of the receipt of filing to the Town of Lansing Planning and Code
159 Enforcement Department.

170 3. Prior to the signing of the plat by the Planning Board Chairperson or Vice Chairperson:

172 a. The Applicant shall provide all necessary, required, or requested approvals from the
173 New York State or the Tompkins County Health Department relative to the proposed water
174 supplies and sewage disposal systems to be used in the subdivision, and the seal thereof shall
175 be endorsed upon the proposed final plat.

177 b. A Full SWPPP shall be submitted for the entire subdivision (all phases and
178 improvements), and the same shall be approved by the Town Engineer and reviewed and
179 accepted by the Town's Stormwater Management Officer. Such Full SWPPP shall also describe a
180 specific system for ensuring the future reporting upon, inspection of, maintenance of,
181 replacement of, and improvement of all common or individual lot-based stormwater practices,
182 including the requirement for formation of a drainage district for the subdivision prior to the
183 issuance of building permit for any buildings or improvements within the subdivision.

185 4. Final Plat approval is further conditioned upon the Final Plat depicting and showing the
186 areas and grants of permanent stormwater drainage easements, and the Final Plat plan shall
187 provide adequate access to all stormwater facilities in a form as approved by the Planning
188 Board and /or Town Board. No certificates of occupancy shall be issued until a final dedication
189 of the stormwater pond parcels is made to the Town and the drainage district, together with
190 such other facilities as marked for dedication as set forth on the Final Plat.

192 5. Final Plat approval is further conditioned upon the Final Plat stating and requiring that
193 no building permits shall issue until such restoration and seeding shall have been substantially
194 and properly completed after disturbance for construction and roadway improvements.

196 6. Final Plat approval is further conditioned upon the approval by the Town of any
197 proposed covenants and conditions, mainly to ensure compliance with subdivision approvals
198 and the proper creation and dedication of easements or other rights to the Town to inspect and
199 maintain, or require the maintenance, of, individual lot-based stormwater practices.

201 7. Final Plat approval is further conditioned upon new road names recommended by the
202 Planning Board and approved by the Town Board in coordination with County 911.

204 8. Final Plat approval is further conditioned upon issuance of the necessary curb-cut/work
205 permits by the County or Town Highway Department(s) for any future road intersections
206 connecting with Triphammer Road (County Road 122), as well as for any culverts that are to be
207 installed in conjunction with such driveways.

209 9. Final Plat approval is further conditioned upon submission of accurate pre-construction
210 and post-construction-as-built surveys and layouts of all property that is to be offered for
211 dedication for public use, with the purpose indicated thereon, or to be held in private
212 ownership but permanently dedicated for recreation or open space use shall be provided to the
213 Town (five copies are required). Additionally, all deed covenants, legal agreements, or other
214 easements or restrictions that legally create or dedicate such public use or rights of use shall be
215 supplied in a form as approved by the Town Board.

217 10. Final Plat approval is further conditioned on a Basic SWPPP submitted to and approved
218 by the Stormwater Management Officer for the development of each lot in the subdivision,
219 including all acts that disturb soils upon any lot, and such Basic SWPPP shall be required and
220 approved prior to the issuance of any building permits for each such lot. This condition shall be
221 listed upon the Final Plat.

223 11. Final roadway drawings and cross-sectional drawings, surveys thereupon and therefor,
224 and construction specifications shall be provided that show: all right-of-way lines with center
225 lines showing angles of deflection; angles of intersection; curve radii; lengths of tangents and
226 arcs; and degrees of curvature, with the basis of curve data. Lengths and distances shall be to
227 the nearest one-hundredth foot and angles shall be to the nearest half-minute. No certificates
228 of occupancy shall be issued until a final dedication of such roadway and a final as-built survey
229 of the same is submitted to, approved, by, and accepted by the Town.

231 12. Submission of Public Water Supply Improvement construction details showing the
232 following items shall be included: i) the location, size, invert elevations, type, and class of pipes
233 on all sanitary and storm sewers and manholes; ii) the location, sizes, and type of pipes for all
234 water mains; iii) the location of all valves, hydrants, blowoffs, etc.; iv) the profiles with detailed
235 information on all storm sewers, sanitary sewers and water main crossings. All such details,
236 drawings, specifications, and plans shall conform to Town requirements and shall be subject to
237 the approval of and inspection by the Town's engineer. No certificates of occupancy shall be
238 issued until a final dedication of such water mains and appurtenances are proffered to the
239 Town and the Consolidated Water District, and a final as-built survey of the same is submitted
240 to, approved, by, and accepted by the Town.

263 2021 Town Board meeting. The property is located partially in the Residential Low Density (R1)
264 Zoning District and partially in the Residential Mixed Use (R3) Zoning District. This is a Type II
265 Action under the State Environmental Quality Review Act 617.5 (4) and is not subject to

271 - The previous owners had 6-8 horses on the property.

273 - The property is located in two zones- R1 and R3.The majority of the property is in the R3.
274 - The applicant would like to have 4-5 grass fed beef cows.
275 - This project is subject to Site Plan and Special Permitting

308 Project Description: The Applicant is proposing Site Plan approval for construction of a 9,100
309 sq. ft. retail store with parking and other site improvements and subdivision of the existing
310 5.729-acre parcel. The property is located in the Rural Agricultural (RA) Zoning District. This is
311 an Unlisted Action under the State Environmental Quality Review Act and is subject to

315 Summary of Discussion
316 - The timeline for this project is dependent on many things.
317 - The Planning Board would like to see updated Site Plan Drawings
318 - Bob Gage, Bohler Engineering,joined the meeting.
319 - The Planning Board is not happy with either of the elevation drawings received.
320 - The Planning Board would like to see the building set closer to the road with parking and
321 entry on the side. They would also be happy with a corner entry.
322 - The new Dollar General in Dryden (by NYSEG) would be a good model.
323 - The Comprehensive Plan describes the Town's preferences for new buildings. The board
324 members would like to see a building layout that conforms to the Comprehensive plan.
325 - The natural grade of the site pushes the stormwater detention facility to the east (road)
326 side of the property.
327 - A corner entry is the least preferred option by Dollar General, however, it is possible.
328 - A gabled end is preferred.
329 - A new site plan will be drawn up to try to accommodate the Planning Boards requests.
330 - A vegetative screen is requested on the North side of the property.

331 - There will be a 6-foot-tall stockade fence around the building on the North, West, and
332 South sides.
333 - More plantings around the building, especially bushes or shrubs along the road, has
334 been requested.
335 - For the North side of the property, the developer has offered to pull the fence back off
336 the property line 10-12 feet, and then plant about 130 feet of trees between the fence
337 and the property line. The trees would be about 6 feet tall at the time of planting.
338 - Bright and bold colors are not preferred. The yellow from the renderings was too bright,
339 but the grey was fine.
340 - As long as the materials are used correctly, the Planning Board does not have any
341 restrictions on materials.
342 - In order to move the building toward the road and have reverse frontage, it would also
343 need to be moved as far North as possible.
344 - There is a meeting with the Business Energy Advisors on 12/22, which is required for the
345 County Review 239.
346 - The County may prefer heat pumps over the propane that is planned.
347 - The Planning Board will be provided a cut sheet for the materials that will be used.
348 - The sign has been updated to fall within the Town's sign laws.

351 - C.J. sent her thanks for being flexible and adapting to the Covid restrictions.
352 - Thank you all for attending the Heated Meetings training.
353 - The Highway Department Renovation Project Initial Feasibility Study Agreement was
354 passed. Bergmann will be doing a few site layouts.
355 - The Town Barn Road Extension will be going to the Town Board next month to formalize
356 the end of that road.
357 - Comments were made to the ORES. Guy Krogh will attend the next meeting to go over
358 some of the finer details.
359 - The County will be interviewing the top two candidates for the Short-Term Rental
360 program. C.J. has not heard when that will take place.
361 - The Parks, Recreation, and Trails Master Plan website is up for comments. Please check

363 - The Parks, Recreation, and Trails Community Survey is up. Please take the survey and
364 share with others. It is not limited to just town residents- anyone who utilizes the parks
365 and trails are welcome to take the survey.

368 Discussion:
369 - There are a few projects that have been mentioned, but not substantiated:
370 o Interest in redeveloping the PitStop area.
371 o Rochester's Cornerstone Group is doing a geotechnical investigation at Town
372 Center.
373 o The State may consider putting the Lansing Residential Center up for auction.
374 The Parks and Recreation Department is interested in taking over the
375 Gymnasium and the fields on that property.
376 - The Planning Board would like an update on crime at Milton Meadows. Guy will be able
377 to address this at the next working meeting on January 11tn
378 - Al would like to see the demographic and background statistics on occupancy.
