TOWN OF LANSING PLANNING BOARD RESOLUTION OF STATE
ENVIRONMENTAL QUALITY REVIEW (SEQR) NEGATIVE DECLARATION
FOR THE HARTZ - MAPLE AVENUE MINOR SUBDIVISION, 21 MAPLE AVE, TAX PARCEL
NO. 26. 10-16, TOWN OF LANSING, NEW YORK
WHEREAS, an Application was submitted for Subdivision review by Mathew Hartz, Owner and
Applicant, for the proposed subdivision of the existing 3.37-acre parcel into three parcels: Parcel A,
measuring 1.262 acres with existing two -unit residence; Parcel B,1.089 acres; and Parcel C, measuring
1.015 acres, in Lansing, New York, also known as Tax Parcel Number 26.-10-16 in the Residential
Moderate Density (R2) Zoning District; and
WHEREAS, this action was determined to be an Unlisted Action for which the Town of Lansing
Planning Board is the sole involved agency for the purposes of a State Environmental Quality Review
Act ("SEQRA") review; and
WHEREAS, this is a proposed action reviewed under Local Law 3 of 2016, Town of Lansing
Subdivision Rules and Regulations, for which the application was received May 29, 2020; and
WHEREAS, this Board, acting as Lead Agency in environmental review, did on July 27, 2020, August
24, 2020, and September 28, 2020, review and accept as adequate: "Subdivision Plat - Lands of
Matthew G. Hartz and Catherine E. Hartz," prepared by T.G. Miller, P.C. and dated 6/6/2008
(revision August 12, 2020); a Wetlands Delineation Report prepared by LeCain Environmental
Services, Inc., sampling date 7 Sept 2020; a Full Environmental Assessment Form (FEAF), Part 1,
submitted by the Applicant, and Part 2, prepared by the Planning Board; and other application
materials;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
That the Planning Board of the Town of Lansing determines the proposed project will result in no
significant impact on the environment and that a Negative Declaration for purposes of Article 8 of the
Environmental Conservation Law be filed in accordance with the provisions of Part 617 of the State
Environmental Quality Review Act for the action of Minor Subdivision approval for Town of Lansing
Tax Parcel Number 26.-10-16 for Matthew Hartz, Owner and Applicant.
