Randall, Planning Director Doug Dake, Town Board Liaison 16 Joe Wetmore, Town Board Liaison 17 18 Public Present via Zoom — Live on YouTube: 19 No Public Present 20 21 Chair Jerry Caward opened the meeting at 6:30 pm. 22 23 Chair Jerry Caward and the Board discussed the logistics in great detail on what would be 24 needed to host meetings with some people by Zoom and some present in the Town Board 25 Room. 26 27 Privilege of the Floor 28 No Public Comments for the working meeting 29 30 Town Board Liaison Doug Dake gave an update from the August 19 Town Board Meeting 31 - No Board member responses to the Privilege of the floor 32 - Approved Consent Agenda 33 o Motion authorizing Town of Lansing Superintendent to purchase a replacement 34 box broom not to exceed $3,500, proceeds to come out of Town of Lansing 35 Highway Superintendent's Budget. 36 o Resolution Authorizing Town of Lansing Director of Planning to sign letter of 37 agreement and publicity release form with William G. Pomeroy Foundation for 38 Peter Wheeler Historic Marker. 39 o Resolution to re-levy yearly water and sewer charges on the 2021 Town and 40 County Tax Bill. 41 o Resolution adopting retention and disposition schedule for NYS Local 42 Government Records (LGS-1) 43 o Resolution approving audit and budget modifications and Supervisor's report. Pagel of 5 APPROVED 44 - Approved Resolution authorizing Town Supervisor to execute independent contractor 45 agreement with Susan Munson for administrative services for Planning & Code 46 Enforcement Dept. 47 - Approved Resolution approving agreement for sale of gore of land at the end of Forest 48 Acres Drive 49 - Approved Resolution authorizing issuance of Notice of award and execution of materials 50 purchasing contract for Consolidated Water District Improvement Project and 51 Consolidated Water District Extension #5. 52 - Approved Resolution re-establishing Town Center Committee and Appointing members. 53 - In the work session we talked about the Ethics Board Vacancies and that no Board 54 member are allowed on the Ethics Board. Recruiting members will start in the near 55 future. 56 - Discussion on parking lot lights and cameras was pushed to the September meeting. 57 - Discussed the issue of people leaving debris at Salt Point and being there late and not 58 social distancing. Parks and Rec has taken care of the issue. 59 60 Update from the Short Term Rental Committee 61 - Spoke with Code Officer who thought that it may be difficult to police it. 62 - Town of Ithaca is still trying to work out concerns. 63 - The group is leaning more towards a limited amount of standards and require short 64 term registration at the Town so if complaints come in a Town Contact could discuss 65 issue directly to the Property Owner. 66 - There might be a small fee for a fire and safety inspection 67 - Sheriff's office could handle complaints. 68 - Possible to hire a 3rd party inspector. 69 - Biggest concern is Code and Fire compliance. 70 - Public Health and Safety is a large concern. 71 - Fire & Safety inspections for the Town of Lansing are currently$25.00 for units less than 72 five. Five or more are $50.00. 73 - Discussion of contracting with Tompkins County to enforce. 74 o Collect Data. 75 o Optional enforcement if Town of Lansing decides to add. 76 - Preferred to have the short term rental owners Register with the Town. 77 78 Continued review of the Land Use Ordinance Audit 79 - Discussed in the work plan is possibility of bringing some of the past LUO reviews to life. 80 - Would like to hire a firm to work on graphics to bring the words of the LUO to life. If this 81 is something the Board would like to do next year we do have money in the budget in 82 2021. 83 - The Planning Board would still continue to work on the wording throughout the LUO. 84 85 Page 2 of 5 APPROVED 86 Reviewing Allowed Uses- picking up where they left off on number 80. 87 - Line 80- Do lot sizes conform to the Comprehensive Plan? 88 It is pretty close. 89 - Line 81—Are Special provisions made governing lot sizes in areas where natural features, scenic 90 attraction, public open spaces, or topographical conditions affect the development of the land? 91 Conservation Advisory Council is working on scenic points to see if the Town would like to 92 preserve in the future. What would the Planning Board like to see?Would like to see more 93 muni water as many wells have gone dry due to the dry summer. 94 No industrial on the scenic by way, small business with reverse frontage would be ok. Value 95 added floating zone with three or four wineries 96 Discussion on Trails and ideas of how to implement. 97 - Line 82—Does the future land use map clearly identify natural hazard areas? No it does not. 98 We are part of the group at the County on an all hazard mitigation plan. 99 - Line 83—Do the land use policies discourage development or redevelopment within natural 100 hazard areas?The Planning Board has always followed the County Planning comments about 50' 101 from an intermittent stream. It was mentioned that it would be nice to have it written out for 102 the Town of Lansing by drainage basin. It could also be mapped out by the County. Due to soil 103 types and erosion some areas could be 50'from a stream and other could be 200'. It all 104 depends. C.J. can ask Soil, Water& Conservation to give us some feedback based on some of our 105 major streams. Maybe combine the hazard area maps with the repetitive loss areas. 106 - Line 84—Are there provisions setting standards for temporary or transient structures such as 107 mobile homes or construction trailers and defining the limits of construction?Areas where not 108 to set those trailers, should fall in the setback requirements. Lynn could deal with in the Permit 109 application process.A common complaint is travel trailers and mobile campers in neighbor's 110 yards. 111 - Line 85—Are the side and rear yards in each category adequate to ensure the provisions of the 112 light and air required by the various land uses permitted in that zone? Feel the Town has 113 adequate setbacks. 114 - Line 86—Do the side and rear yards provide protection against noise and ensure adequate 115 privacy? Ludlowville, Lansingville, Lakeshore areas need setbacks to be adjusted for those areas. 116 Noise tends to be another common compliant,that needs to be left to Law Enforcement. It is 117 reasonable to require no Jake brakes on the large trucks on 34B and East Shore Drive. 118 The Planning Board is willing to make a recommendation to the Town Board to work with 119 the County on a County wide noise ordinance. Will make a motion/resolution on the 120 meeting on September 28, 2020. 121 122 - Line 87—Are the reference points or lines from which side or rear yard dimensions are to be 123 measured and the methods for the measurement of side and rear yards, (particularly in lots of 124 irregular shapes) clearly defined in the regulations? Current LUO has nice diagrams. 125 - Line 88—Are Special provisions necessary in dealing with side yard requirement on the corner 126 lots where two sides of the lar are bounded by intersecting streets? Discussed during Line 87. Page 3 of 5 APPROVED 127 - Line 89—Are the side and rear yard requirements so inflexible that they would hamper the 128 development of private or public housing projects developed on a large area in the form of 129 condominiums, townhouses, senior housing or assisted living, or other housing forms which may 130 require a different spatial relationship between individual structures?Just need to reconfigure. 131 - Line 90-Are there areas in the community where a maximum setback would also be desirable in 132 order to promote a more uniform appearance of infill development? Discussed for the 133 Ludlowville area where the houses are already set closer to the road and it would be nice to 134 keep the new builds in line with the current neighborhood. It's good for a hamlet. 135 - Line 91—Do special conditions in the municipality indicate that it would be better to establish a 136 series of setback distances for varying conditions and types of streets rather than to attempt to 137 establish such setback requirements by one set of overall provisions?Yes, like B1. 138 - Line 92—Is the method for measuring distances clear in the regulations? It could be a little 139 better.There are somethings we can do to help clarify. 140 - Line 93—Are the existing set back lines in the present regulations adequate to permit 141 homeowners to site their home for privacy and quiet—or alternatively, permit homeowners to 142 build closer to the road if they wish? We are seeing people want to turn old commercial 143 building into residences that happen to be within 10'of the road.The question is if it hasn't 144 been used in a long time, do they need to get area variances? Should be looked at individually 145 by the ZBA to assess the situation. Would be nice to have a list of the non-conforming buildings. 146 Should encourage to repurpose old buildings. It would be nice to have the PB see them first to 147 give the ZBA a recommendation. 148 - Line 94—Do conditions exist in the municipality which would make desirable the establishment 149 of special set back lines off drainage ways, areas subject to flooding, public parks or properties? 150 Maybe we should have special setbacks for parks. Zone boundary might need larger setbacks or 151 berms. 152 - Line 95—Are special setback requirements desirable to apply to public or quasi-public 153 institutional buildings or structures for the protection of the surrounding neighborhood or for 154 the provision of additional light, air or privacy to the public structures? If the Hwy Dept. needs a 155 new building. By having detailed laws in place is helpful for Local, State and Fed locations. 156 - Line 96—Are there provisions in the law which govern the orientation of the building itself, such 157 as requiring it to locate its entrance or to face in a certain direction or upon a public 158 thoroughfare? Reverse frontage or to a building placed as a center piece for the area. 159 - Line 97—Does the Town currently have special provisions required to control the location, 160 height, and character of walls and fences?Yes, on fences,finished walls facing the road and 161 height limit. Limits on type of fencing in different zones. PB not a fan of regulating to that 162 extent. However, would like to see a setback on fences for maintenance. 163 Planning Update: 164 Need an hour and a half on Communication to complete the required two hours.
