39 Subdivision; SEQRA Declaration of Lead Agency; Recommendation to the Zoning Board of
40 Appeals Project Description: Applicant is requesting to subdivide the existing 25.20-acre parcel

41 into two parcels: Parcel A, measuring 6.943 acres and vacant; and Parcel B, 18.140 acres and
42 vacant. The property is located in the Residential Low Density (111) Zoning District. This is an
43 Unlisted Action under the State Environmental Quality Review Act and is subject to
44 environmental review.

46 Discussion between the Board and Applicant, Ed Dormady-Subdivision
47 - Applicant is asking the Board to approve a Subdivision on an existing parcel. Parcel A
48 would be approximately 6.9 acres and Parcel B would be approximately 18 acres
49 - The Board is concerned with road frontage. There is 59 feet 7.1-inch access from Forest
50 Acres Drive. Required road Frontage in that Zoning District is 150' unless Parcel A was
51 classified as a Flag Lot. The Board recommends an Area Variance request to the Town
52 Zoning Board of Appeals. Forest Acres Drive is not suitably improved, and Applicant
53 doesn't own the strip between Forest Acres Drive and Parcel A
54 - Applicants plan is to build a single residence on Parcel A
55 - The Board would like to reserve a 60' strip along the northside of Parcels of A thru B to
56 leave and area for a right-of-way to Hillcrest Road, for possible future development of
57 the property
58 - If the ZBA approves an Area Variance, Forest Acres Drive between the parcel and the
59 present centerline would need to be suitably improved to handle emergency access to
60 the proposed single-family home
61 - Applicant's intention is to improve the Forest Acres Drive to the Towns Specifications
62 from Parcel A to Forest Acres Drive, approximately 150 feet
63 - Classification of this subdivision will not be considered Exempt

71 WHEREAS, an Application was submitted for Subdivision review by Ed Dormady on
72 behalf of Helen Krizek Dormady, Owner, for the proposed subdivision of the existing
73 25.20-acre parcel into two parcels: Parcel A, measuring 6.943 acres and vacant; and
74 Parcel B, 18.140 acres and vacant, Lansing, New York, also known as Tax Parcel
75 Number 44.4-4.2 in the Residential Low Density (R1) Zoning District; and

77 WHEREAS, this is a proposed action reviewed under the Town of Lansing Subdivision
78 Rules and Regulations, for which the completed application was received January 28,
79 2020; and

81 WHEREAS, 6 NYCRR § 617 of the State Environmental Quality Review Act ("SEQRA")
82 requires that a Lead Agency be established for conducting environmental review of

83 projects in accordance with local and state environmental law and the Lead Agency shall
84 be that local agency which has primary responsibility for approving and funding or
85 carrying out the action; and

87 WHEREAS,The Planning Board of the Town of Lansing is believed best suited to
88 review the impacts of this proposed Major Subdivision as (i) the Planning Board is the
89 only body with jurisdiction to issue the final Major Subdivision approval, (ii) the
90 Planning Board is best situate to understand and evaluate the potential unique impacts
91 of such Major Subdivision upon the Town based upon the developmental patterns,
92 topography, and unique natural and non-natural features of the Town of Lansing,
93 including known streams, wetlands, UNAs, agricultural resources of value, and
94 archeosensitive sites within or near the Major Subdivision area, (iii) the Planning Board
95 has the broadest governmental powers for investigating the potential or actual impacts
96 of the Major Subdivision and implementing conditions or mitigating controls, and
97 accordingly (iv) the Planning Board has the greatest capacity for providing the most
98 thorough environmental assessment of the proposed Major Subdivision; and

100 WHEREAS, this proposed action is an Unlisted Action for which the Town of Lansing
101 Planning Board is the sole involved agency for the purposes of a State Environmental
102 Quality Review Act ("SEQRA") review;

104 NOW,THEREFORE, BE IT RESOLVED AS FOLLOWS:
105 That the Town of Lansing Planning Board does hereby declare itself Lead Agency for the
106 environmental review for the action of Subdivision review for Town of Lansing Tax
107 Parcel Number 44.-1-4.2 for Helen Krizek Dormady, Owners, Ed Dormady, Applicant.

133 Recommendation to Town Board Project Description: The Applicant is requesting a waiver
134 from the PDA § 1610 (12)(a) limitation on the number of building permits issued prior to
135 completion of the Community Center (Building F).

137 Discussion between the Board and Applicant, Rocco Lucente
138 - Applicant is requesting to have the ability to continue building two buildings at a time.
139 The Community Building was postponed last August due to the possibility of building a
140 larger community building. Even though the Community Building was postponed,
141 construction on other buildings was allowed to proceed. The hope of acquiring the land
142 adjacent to the PDA within the allotted time frame issued by the Town last year was not
143 possible. So now, Applicant is reverting to their original plan to proceed with the smaller
144 community building. In order to avoid laying off contractors it is pertinent to have two
145 buildings constructed in tandem
146 - The Planning Board is fine with two buildings under construction at the same time as
147 long as the Applicant understand that the next Certificate of Occupancy will be for the
148 Community Center, even if building 117 is finished first. In that circumstance building
149 117 would have to stay vacant until the Community Building is completed and received
150 their CO
151 - The Applicant is not looking to apply for building permits for buildings 2 & 22 until after
152 the CO is receive for the Community Center
153 - The Planning Board agreed that the Community Center's CO would have to be received
154 before buildings 2 & 22 could receive building permits as originally agreed upon, but
155 buildings 2 & 22 could receive building permits prior to the CO for Building 117
156 Motion to recommend that the Town Board grant a Waiver to allow the Village Solars
157 Community Center and Building 117 to be built at the same time with the understanding that
158 the Certificate of Occupancy will not be issued for Building 117 until the Certificate of
159 Occupancy is issued for the Community Center. Following the Certificate of Occupancy for the
160 Community Center, the Planning Board recommends the building permits be issued for
161 Buildings 2 & 22 even if prior to the Certificate of Occupancy for Building#117

168 - Ludlowville bridge is going to be widened,this is controlled by the State. Concerns that traffic
169 speed will be increased due to the wider bridge
170 o What about the possibility of speed humps or bumps,there is a difference
171 o Ask police to ticket drivers that speed through the area

173 - Planner has asked the Town Board to put together a working meeting on March 11t"to discuss a
174 few things
175 o One it the almost constant daily change in the State of play of the Utility Scale Solar
176 Projects
177 ■ As of last Friday,the Governor's Office has decided that Article 10 takes too
178 long, so they are going to move this into the economic arm of the State. So,the
179 guess is,that NY Power Authority is going to be somehow taking over this kind
180 of regulatory piece to make "it shovel ready"which is the way it is being pitched
181 ■ It is time to for the Town of Lansing to make a decision to limit the size of large-
182 scale solar projects, if desired

184 ■ Submitting another application for Myers Park
185 • Parks& Recreation Committee is going to review at next meeting
186 ■ Highway Department looking into a significant upgrade to their building
187 0 Highway Department is looking into purchasing a vacuum truck
188 - Tompkins County Area Development has agreed to be the applicant for the latest Appalachian
189 Regional POWER Grant.The grant will essentially seek to expand a dark fiber broadband trunk
190 line already in Tompkins County into the Town of Lansing which is very exciting to have it
191 available for multiple businesses and the School District and for a possible Data Center. The
192 Grant is due at the end of next month
193 - Climate Smart Communities update: Cornell Cooperative a City and Regional Planning class are
194 working on mapping of the Natural Resource Inventory.They will be presenting at the next CAC
195 meeting on March 5tn
196 - Will be asking the Parks, Recreation and Trails Advisory Committee's to review the Parks Master
197 Plan RFP and give an approval to submit and then go through the process of selecting a firm for
198 that project.Their next meeting is tomorrow afternoon, February 25tn
199 - Recommend updating the Solar Local Law and exclude Wind as County Planning would like to
200 see significant changes to the Town's draft. We are not as interest in large-scale Wind
201 development and may not due to the studies on wind.There is an urgency with Solar because
202 NYSERDA(State Energy Research and Development Authority) is about to put out a notice for
203 the change in renewable energy credits in the next few months which will make it very easy to
204 determine the long-term financing. As most of you have noticed the large firms have already
205 started to become more and more aggressive in seeking out local land deals. Would like to
206 discuss further at the next Planning Board meeting on March 9tn
207 - Proposed Local Law 1 of 2020 Amending LL#3 of 2010 Pertaining to the Planning Board will no
208 longer allow excess training hours to be carried from year-to-year.Training shall be at sessions

209 scheduled or approved by the Town Board, which will include a list of pre-approved training
210 agencies and additional trainings that become available maybe approved at the discretion of the
211 Director of Planning
