HomeMy WebLinkAbout20-02 Declaration of Lead Agency - Pinney Properties, LLCRESOLUTION PB 20-02 STATE ENVIRONMENTAL QUALITY REVIEW RESOLUTION - DECLARATION OF LEAD AGENCY, PINNEY PROPERTIES, LLC SITE PLAN FOR 15 DUPLEX BUILDINGS AT PERUVILLE AND SCOFIELD ROADS, TAX PARCEL NO.30.4-28.212 WHEREAS, an application was made by SDM Rentals, Applicant, on behalf1 ey Properties, LLC, Owner, for Site Plan review for the proposed constructi%bEdde (15) new duplex (two-family residential) units, each to be approximately 1,568 SFtoexisting contractor's office, contractor's storage yard, and four (4) existinntial buildings located at 390 Peruville Road, Lansing, New York, als wn1-28.212, as located in the Rural Agriculture (RA) Zoning District and co tintely 37.99t acres located on the northwest corner of Peruville a , . o d R s. and such proposal will also include, when fully completed, a privat6drivewaYINicting Peruville Road with Scofield Road; and WHEREAS, the previous Site Plan approval expired on Navemberm, 2019 (Planning Board Resolution 16-26, approved November 28, 2 accordawith Town of Lansing Land Use Ordinance Section 701.10 - Expiration c Site Plan Approvals; and WHEREAS, 6 NYCRR § 617 of the Stake Environmental Quality Review Act ("SEQRA") requires that a Lead Agency be establ' ed 1br coed ng environmental review of projects in accordance with local and state nviro ental law and the Lead Agency shall be that local agency which has primary rqopons ity proving and funding or carrying out the action; and WHEREAS, The P1 rd`�wn of Lansing is believed best suited to review the impacts of this pro sed to i) the Planning Board is the only body with jurisdiction to issue final SiNA, Pl appro� 1, the Planning Board is best situate to understand and evaluate the tential unique pacts of such Site Plan upon the Town based upon the developm-enta '' atterns, Topography, and unique natural and non -natural features of the ng, inclung known streams, wetlands, UNAs, agricultural resources of value, itive sites within or near the Site Plan area, (iii) the Planning Board has the al powers for investigating the potential or actual impacts of the Site Plan jn conditions or mitigating controls, and accordingly (iv) the Planning Board >t capacity for providing the most thorough environmental assessment of the Plan; and WHEREAS, this proposed action is a Type I Action for which the Town of Lansing Planning Board is the sole involved agency for the purposes of a State Environmental Quality Review Act ("SEQRA") review, such that the Town will thus undertake as Lead Agency an coordinated review of the long -form, Full Environmental Assessment Form ("FEAF") under Page 1 of 2 SEQRA; and NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: That the Town of Lansing Planning Board does hereby declare itself Lead Agency for the environmental review for the action of Site Plan review for Town of Lansing Tax Parcel Number TPN 30.4-28.212 for SDM Rentals, Applicant, on behalf of Pinne44Serties, LLC, Owner.-Fv Dated: April 13, 2020 Motioned by: Dean Shea Seconded by: Deborah Trumbull VOTE AS FOLLOWS: Sandra Dennis Conlon - Norman L.
