They also accused me of introducing a culture that they don't want continued by my being reappointed to the hoard_ At the last rneeting, I made that apology to Mr_Vary Every with regret for making a reasonable response in an unreasona late tone. I apologized and clearly explained the motivation for my response. My apology was sincere. As I stated in writing to the board, many in the neighborhood group from Emmon's Road were 32 disrespectful to the board in ignoring in Structlons and several, in the tone of their delivered remarks. Page 1 of 7 APPROVED No apology has been issued to the board for this appalling behavior. Here are some additional examples. After a hearing for the Osmica project,a member of the Ernmon's Road neighborhood group told a member of the board in this room that the appilcant was a liar. Ina letter to the board,a member of the public declared that any the use of the Qsmica property other than farming was a sin_ At a hearing for Osmica a board member was called out by a mernber of the audience for reacting to a statement from a public speaker. The motive for his reaction was ascribed to him by that audience member. At the last planning board meeting,some members of the public ascribed criminal motives to me. No apology har.heen issued to the board or myself for these appalling behaviors. I ask the board to strongly condemn this culture that I dfd not brhng to this room. A culture that engages in name calling and the toxic and cortoSive practice of ascribing motives to others. My motive for delaying my apology was my disgust at the behavior I have described here and the sincere feeling that an apology is due to this board. Givers that, how does the board move forward in a positive way? Well, here are some suggestions: I. Effectively enforcing the privilege of the Floor Guidelines. The practical application should be worked out by the board and implemented. 2. Alleviating frustration on the part of the public who don't feel listened to. This can't be done by printing a complalm on a political post card. I discussed this with Joe and he suggested a scfipted comment by the board to assure the public that they are listened to. I wrote a short comment that could be read to the public before or after privilege of the floor or public hearings. 3. The public have expressed frustration by their interaction with the board and I think It is related to a lack of understanding of how the board works,what its' limitations are and how it interacts with the public. I have written a short list of what to expect at a public or planning board meeting. I hope the board will consider making use of these ideas to move forward in a positive way. Thank you. 33 34 No other comments were made. 35 36 Project Update and Declaration of Lead Agency: Britton Woods Major Subdivision Applicant: 37 Timothy Buhl, P.E. on behalf of Scotty & Wayne Britton, Owners Location: East Side of 38 Triphammer Rd/ North of Asbury Rd; Tax Parcel No. 37.1-4-2.12 Project Description: The 39 Applicant is proposing a major subdivision for ten (10) residential building lots on 9.70 acres of 40 land located in the Residential Low Density (R1) Zoning District. The proposed subdivision plat 41 may include drainage easements to be dedicated to the Town. This is an Unlisted Action under 42 the State Environmental Quality Review Act and is subject to environmental review. 43 44 Scott Gibson gave an update on the project 45 - 9.7 acre parcel off North Triphammer Rd 46 - Site Plan Drawing shows the major subdivision including 10 homes 47 - The private homes will have septic systems and an area for replacement if needed and 48 they will have public water Page 2 of 7 APPROVED 49 - The placement of water utility has been added to the drawing and will run by the side of 50 the road 51 They have a stormwater plan which includes raised rain gardens 6" high and towards 52 North Triphammer there are two dry stormwater ponds. Dry pond 1 is 3 ft deep with a 1 53 on 4 gentle slope and Dry pond 2 is 6 inches deep 54 Both Dry Ponds are proposed to be conveyed to the Town and a Drainage District would 55 be formed 56 Applicants proposed the road would be stone for the first several years during the build 57 out then would be paved and dedicated to the Town 58 The final plat will need to show an extended road to the border of the property from the 59 North side of the hammerhead 60 Planning Board suggests adding a trail easement on the northern boundary 61 Maintenance building will not be built, not needed with the subdivision as the parcels 62 will be sold individually 63 RESOLUTION PB 19-39 64 65 STATE ENVIRONMENTAL QUALITY REVIEW RESOLUTION — 66 DECLARATION OF LEAD AGENCY, BRITTON WOODS MAJOR SUBDIVISION, TRIPHAMMER 67 ROAD,TAX PARCEL NO. 37.1-4-2.12 68 69 WHEREAS, an Application was submitted for Major Subdivision review by Timothy Buhl, P.E., 70 Applicant, on behalf of Scotty & Wayne Britton, Owners, for the proposed subdivision for ten 71 (10) residential building lots on 9.70 acres of land located on Triphammer Road, Lansing, New 72 York, also known as Tax Parcel Number 37.1-4-2.12 in the Residential Low Density (R1) Zoning 73 District; and 74 75 WHEREAS,this is a proposed action reviewed under Section 7 of the Town of Lansing Subdivision 76 Rules and Regulations, for which the completed application was received December 2, 2019; and 77 78 WHEREAS, 6 NYCRR§ 617 of the State Environmental Quality Review Act ("SEQRA") requires that 79 a Lead Agency be established for conducting environmental review of projects in accordance with 80 local and state environmental law and the Lead Agency shall be that local agency which has 81 primary responsibility for approving and funding or carrying out the action; and 82 83 WHEREAS, The Planning Board of the Town of Lansing is believed best suited to review the 84 impacts of this proposed Major Subdivision as (i) the Planning Board is the only body with 85 jurisdiction to issue the final Major Subdivision approval, (ii) the Planning Board is best situated 86 to understand and evaluate the potential unique impacts of such Major Subdivision upon the 87 Town based upon the developmental patterns, topography, and unique natural and non- 88 natural features of the Town of Lansing, including known streams, wetlands, UNAs, agricultural 89 resources of value, and archeosensitive sites within or near the Major Subdivision area, (iii) the Page 3 of 7 APPROVED 90 Planning Board has the broadest governmental powers for investigating the potential or actual 91 impacts of the Major Subdivision and implementing conditions or mitigating controls, and 92 accordingly (iv) the Planning Board has the greatest capacity for providing the most thorough 93 environmental assessment of the proposed Major Subdivision; and 94 95 WHEREAS, this proposed action is an Unlisted Action for which the Town of Lansing Planning 96 Board is the sole involved agency for the purposes of a State Environmental Quality Review Act 97 ("SEQRA") review; 98 99 NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 100 101 That the Town of Lansing Planning Board does hereby declare itself Lead Agency for the 102 environmental review for the action of Major Subdivision review for Town of Lansing Tax Parcel 103 Numbers 37.1-4-2.12 for Scotty & Wayne Britton, Owners, Timothy Buhl, P.E, Applicant. 104 105 Dated: December 16, 2019 106 107 Motioned by: Dean Shea 108 Seconded by: Deborah Trumbull 109 110 VOTE AS FOLLOWS: Sandra Dennis Conlon -Aye 111 Norman L. There have been discussions with the Town, County and 136 Lansing's Fire Department to mitigate this issue. The route 34B bridge repairs will keep 137 the bridge open for another year until the state can replace the bridge. 138 - Louise Bement Lane has officially been fully dedicated and opened 139 - License agreement for TCAT bus shelter to be located in the parking lot of the Town Hall 140 has been approved 141 - Another request to reduce the speed on Atwater Road was submitted to the State 142 - Public Hearing will be set for the CWD improvement project connecting and eliminating 143 the Dead-End Water Mains around the Highway Barn and 4-Corners Area 144 - Authorized Improvements in Consolidated Water District Extension #5 (Peruville Road) 145 146 Extension Request: Pinney Properties, LLC Duplexes Applicant: A. Scott Pinney, Owner, on 147 behalf of Pinney Properties, LLC Location: 390 Peruville Road; Tax Parcel No. 30.-1-28.212 148 Project Description: The Applicant is requesting renewal of previous Site Plan approval 149 (Planning Board Resolution 16-26, approved November 28, 2016) for construction of fifteen 150 (15) duplexes on the 37.99-acre parcel.
