33 Ridge Road Imports, LLC. Location: 2025 East Shore Drive; Tax Parcel No. 37.1-2-
34 53.4 Project Description: The Applicant proposes construction of a 1,320 sq. ft.
35 single-story addition to the existing used car sales site (including garage service and
36 repair) to accommodate a new wheel alignment lift and cargo lift. The property is in
37 the Commercial, Mixed-Use (B-1) Zoning District. This is a Type II Action under the
38 State Environmental Quality Review Act 6 NYCRR 617.5(c)(9).

69 WHEREAS, an Application was submitted for Site Plan approval by Raymond Tuhro,
70 Applicant,for Ridge Road Imports, LLC, to construct a 1320 sq.ft. single-story addition

77 to be a Type II Action under 6 NYCRR § 615 (c)(12) of the State Environmental Quality
78 Review Act ("SEQRA"); and

80 WHEREAS, this is a proposed action reviewed under Section 701.0 Site Plan Review of
81 the Town of Lansing Land Use Ordinance, for which the completed application was
82 received September 11, 2019; and

84 WHEREAS, this Board did on September 23, 2019, review and accept as adequate: Plans
85 of Tax Parcel Number 37.1-2-53.4 dated September 11, 2019 prepared by McCormick
86 Engineering P.C.; and

87 WHEREAS, The Public Hearing and 600 feet parcel notices were waived by the
88 Planning Board on September 23, 2019; and
89 WHEREAS, this action is exempt from New York State General Municipal Law §239 -1,
90 -m, and-n referral requirements as there is no change in commercial use in the existing
91 building and the action does not change in vehicular access on a State or County
92 highway are excluded per an Inter-Governmental Agreement between the Tompkins
93 County Planning Department and the Town of Lansing dated December 17, 2003; and

95 WHEREAS, the Planning Board has again considered and carefully reviewed the
96 requirements of the LUO relative to site plan review, the unique needs of the Town due
97 to the topography, the soil types and distribution, and other natural and man-made
98 features upon and surrounding the area of the proposed site plan, and the Planning
99 Board has also considered the zoning in the area and the project in light of the Towri s
100 Comprehensive Plan and compliance therewith, and as the underlying use is a
101 permitted use in the zone in which located, now therefore be it

103 RESOLVED, that the Planning Board of the Town of Lansing does hereby grant
104 Preliminary and Final Site Plan approval for Town of Lansing Tax Parcel Number 37.1-
105 2-53.4 for Ridge Road Imports, Applicant, Raymond Tuhro, Owner, as submitted in the
106 Elevation Views (A-1.0) prepared by McCormick Engineering, P.C, dated 9/11/19 and
107 subject to the following specifications and conditions:

109 1. Lighting must be International Dark-Sky compliant and limited to a color
110 temperature of 3000K degrees or less.
111 2. In accordance with LUO § 701.10, this site plan approval is valid for only 36
112 months from the date hereof.
113 3. Building Permits will be required to construct the approved building and site
114 facilities and such plans must meet all code requirements, including the sealing
115 of plans by a licensed engineer or architect, and be constructed in compliance
116 with all state and local building code requirements.

145 Summary of Discussion of the Updates to the Site Plan:
146 - Adjusted the trail on the north side of the property to match the original trail

148 - Labeled sidewalk across the southern edge of the property
149 - Signs were moved a little bit to account for the tree or shrub plantings
150 - Trees that were recommended for landscaping from a local nursery were a
151 variety of Red Maples, River Birch and Spruce Trees
152 - Added drains north of the driveway and another one further down to enhance
153 existing drainage on the property
154 - Added a transformer that NYSEG will be adding to the northeast corner of the
155 property
156 - Labeled trail easements
157 - Patio will not be over sand filter
158 - Patio will be crushed stone until they can afford to update
159 - Soil qualities are good for the leach field only in the front south east corner
160 - Handicap parking is located in the first four parking spots closest to the entry

187 Brewing Company, LLC,by Chris Hesse, Applicant,for the proposed new 4,000 square

190 including parking spaces on 5.479 acres at Auburn Road at Town Center Lands

195 WHEREAS, 6 NYCRR § 617 of the State Environmental Quality Review Act ("SEQRA")
196 requires that a Lead Agency be established for conducting environmental review of
197 projects in accordance with local and state environmental law and the Lead Agency shall
198 be that local agency which has primary responsibility for approving and funding or
199 carrying out the action; and

201 WHEREAS, this proposed action is an Unlisted Action for which the Town of Lansing
202 Planning Board is the sole involved agency for the purposes of a State Environmental
203 Quality Review Act ("SEQRA") review; and
204
205 WHEREAS,the Planning Board,being the local agency which has primary responsibility
206 for approving the action, did on August 12, 2019 declare itself the Lead Agency for the
207 environmental review; and
208
209 WHEREAS, this is a proposed action reviewed under Section 701.0 Site Plan Review of
210 the Town of Lansing Land Use Ordinance, for which the completed application was
211 received August 10, 2019; and
212
213 WHEREAS, the Planning Board, acting as Lead Agency in environmental review, did
214 on August 12, 2019 and August 26, 2019,review and accept as adequate: Site Plan (A1.0)
215 "Proposed Site Plan, Proposed Development of Lansing Meadows Parcel 'D," prepared
216 by Jonathan Wolfe Architecture; and a Short Environmental Assessment Form (SEAF),

217 Part 1, submitted by the Applicant, and Part 2, prepared by the Lead Agency; and other
218 application materials; and

220 WHEREAS, the Planning Board,having declared itself Lead Agency in this matter, on
221 August 26, 2019 determined the proposal will result in no significant impact on the
222 environment and that a Negative Declaration for Purposes of Article 8 of the
223 Environmental Conservation Law be filed in accordance with provisions of 6 NYCRR §
224 617 of the State Environmental Quality Review Act ("SEQRA"); and
225
226 WHEREAS, this action was referred to Tompkins County Department of Planning and
227 Sustainability under the referral requirements of General Municipal Law ("GML") §§
228 239-1, 239-m, and 239-n and a September, 11, 2019 letter from Commissioner of Planning
229 and Sustainability Katherine Borgella determined that the proposal has no negative
230 inter-community or county-wide impacts; and
231
232 WHEREAS, legal notice was published on August 17, 2019 and adjacent property
233 owners within 600 feet were notified by mail on August 16, 2019, and pursuant to
234 Section 701.6.2 of the Land Use Ordinance ("LUO") of the Town of Lansing, the
235 Planning Board held a Public Hearing on August 26, 2019, which was heard by the
236 Planning Board to assure full opportunity for citizen participation; and
237
238 WHEREAS, the Planning Board has duly considered the proposed Site Plan and
239 proposed Utility Plan in accordance with the provisions of the Town of Lansing Land
240 Use Ordinance Section 701.4 et seq., including consideration of site characteristics, site
241 lighting, nearby residences, landscaping, parking, and screening, and any potential on-
242 and off-site environmental impacts, and upon due consideration and deliberation by the
243 Town of Lansing Planning Board,

245 NOW,THEREFORE, BE IT RESOLVED AS FOLLOWS:

247 Preliminary and Final Site Plan Approval be and hereby is granted for the Salt Point Farm
248 Brewery and Tasting Room at Lansing Town Center with the landscaping and amenities
249 as submitted in the final Site Plan (A1.0) "Proposed Site Plan, Proposed Development of
250 Salt Point Brewing Parcel 'D,'" and Utility Plan (A2.0) "Proposed Utility Plan, Proposed
251 Development of Salt Point Brewing Parcel'D,' prepared by Jonathan Wolfe Architecture,
252 both dated 9/10/2019 and all subject to the following specifications and conditions:

254 1. In accordance with LUO § 701.10, this Site Plan approval is valid for only 36
255 months from the date hereof, and the applicant/owner is required to commence
256 and substantially complete the construction or other activities for which the site
257 plan is applicable within said 36 months or this approval shall, unless extended
258 upon application timely made, expire, lapse, and be of no further validity, force
259 or effect.
260 2. Building Permits will be required to construct the approved building and site
261 facilities and such plans must meet all code requirements, including the sealing

262 of plans by a licensed engineer or architect, and be constructed in compliance
263 with all state and local building code requirements.
264 3. Receiving approval from New York State Department of Environmental
265 Conservation ("DEC") and the State and Tompkins County Health Departments
266 (together, the "DOH") for the proposed sanitary sewer or septic treatment
267 system servicing the Salt Point Farm Brewery and Tasting Room. The patio/
268 deck shall not be installed atop the sand filter associated with the On-Site Water
269 Treatment System. The obtaining of final approvals and permits for such sewer
270 or on-site wastewater treatment system(s) shall be a requirement of this Site Plan
271 approval,both as pre-conditions to obtaining a building permit and a Certificate
272 of Occupancy ("CO").
273 4. Approval from the Southern Cayuga Lake Intermunicipal Water Commission
274 ("Bolton Point") for the installation of one or more master water meters located at
275 points selected by Bolton Point substantially adjacent to the public highways upon
276 such Map. The Developer and owner will be responsible for the installation and
277 maintenance of the complete water system throughout the Project, including fire
278 hydrants, and the payment of all water bills. The obtaining of final approvals and
279 permits from Bolton Point and the final testing and approval of all water lines,
280 hydrants, and systems shall be a requirement of this Site Plan approval, and no
281 building permits and no certificates of compliance or occupancy shall be applied
282 for or delivered until such permits and approvals are duly obtained, and such
283 system is tested, up, running and operational.
284 5. Review and approval of the overall stormwater plans, retention basins, and
285 drainage systems as included within the Stormwater Pollution Prevention Plan
286 ("SWPPP") dated 9/18/2019, including specific approvals as follows:
287 a. All stormwater calculations and designs shall be approved by the Town
288 Engineer.
289 b. The final SWPPP shall be duly approved by the Town Engineer and the
290 Towri s SMO.
291 c. All permanent stormwater practices shall be subject to adequate easements
292 and a stormwater operation, management, and reporting agreement
293 ("SOMRA") to ensure the long term viability of stormwater practices and
294 improvements,as well as mandated reporting per EPA Phase II Stormwater
295 Rules and the requirements of DEC and the Towri s Stormwater Local Law,
296 with the form of such easements and SOMRA to be approved by the Town
297 Engineer and the Attorney for the Town.
298 d. The execution of such SOMRA and emplacement of such easements shall
299 be a requirement of this site plan approval,and no certificates of compliance
300 or occupancy shall be applied for or delivered until such SOMRA and any
301 such easements are duly executed, dedicated and accepted, and filed in the
302 Tompkins County Clerk's Office (at Developer's sole expense).
303 6. Applicant agrees with the following recitation and consents to the following
304 conditions and, in connection therewith The Towri s rights, as set forth in

305 Applicant's deed (Instrument # 2019-08380, filed in Tompkins County Clerk's
306 Office July 15, 2019), to keep, maintain, locate, and relocate the Town Center Trail
307 (the "Trail") and its rights-of-way as per the Lansing Town Center Trail Policy
308 (adopted by the Town Board September 5, 2018) in such manner as ensures the
309 continuity and existence of the Trail:
310 a. The Towns Trail rights-of-way, which shall be sited and located along the
311 southerly and westerly boundaries of applicant's parcel,being 20' in width,
312 as shown on the final Site Plan.
313 b. The Towns right to install within the southerly extent of such right-of-way,
314 and together with or adjacent to the Trail, a 5'-8' wide concrete (or other
315 hard-surfaced) sidewalk.
316 7. The applicant must be issued a Sign Permit in compliance with the Towns Sign
317 Local Law (#1 of 2014) in order to erect, install, build, place, emplace, site, or
318 substantially rebuild or repair any Sign.
319 8. Modification to landscaping, lighting, or signage as shown on the Site Plan must
320 be in accordance with LUO § 701.7.5; significant changes in aesthetic appearance
321 will be referred to the Planning Board at the discretion of the Code Enforcement
322 Officer.

342 The Town is getting ready to have a Town Center Traffic Impact Study as the County
343 Municipal Affordable Housing Grant awarded funding. We would also like to have a
344 whole parcel Stormwater Review of the Town Center Property and with that; they can
345 do a Generic Environmental Impact Statement (GEIS) for the entire Town Center Area,
346 which will allow zone design as part of the Site Plan Review. It would also give an idea
347 of what the area will look like. The Planning Board would like to have the Town Center
348 with similar architectural standards.

350 Town Board Liaison Report for September 18, 2019 Town Board Meeting
351 - The Town Board has set up a meeting on Monday, September 30 at 4:00pm to
352 discuss the Budget. Look over the Budget as now is the time to get your feedback
353 and thoughts heard.
354 - Made a recommendation to the State for a speed limit on Conlon Road
355 - Authorized a new digital Town Board Sign that should be going up soon
356 - Passed an agreement with Tompkins County Soil &Water Conservation District
357 that they can take care of some of the Stormwater work as needed
358 - Upgrading all the Town Computers, as they will be out of date with Windows 7.
359 There will be no more security updates with that version
360 - Photo sessions will be coming up soon for the Board Members so we can get the
361 pictures on the website
362 - There is a real contention with the prime soils being used with Solar Farms.
363 - Investigating the Economic Impact of the Solar Farms

365 The Planning Board is ok with a larger Solar Farm as long as anything 25 acre and
366 above will not receive a PILOT (payment in lieu of taxes) or other subsidies if it contains
367 prime soils on the siting.

369 If an applicant wants to use prime farmland in excess of 25 acres then a request for a
370 PILOT or other subsidies should not be granted. The land and improvements should be
371 taxed at the full-assessed value.

373 There is an agricultural conversion penalty for changing land qualified to receive an
374 agricultural assessment into some other use even with grazing animals. It is a onetime
375 penalty of$600 per acre along with five times the taxes saved.

380 requests for PILOTs or other subsidies for Solar Energy Systems in excess of 25 acres
381 sited on any_prime farmland; The Planning Board recommends that Solar Energy
382 Systems larger than 25 acres sited on any prime farmland should be assessed at the
383 full market value (land and improvements).
