HomeMy WebLinkAbout19-34 Salt Point Brewing - Site Plan - Town Center Parcel DRESOLUTION PB 19-34 PRELIMINARY AND FINAL APPROVAL - SITE PLAN REVIEW, SALT POINT FARM BREWERY AND TASTING ROOM AT LANSING TOWN CENTER WHEREAS, an Application was submitted for Site Plan approval on behalf of Salt Point Brewing Company, LLC, by Chris Hesse, Applicant, for the proposed new 4,000 square foot wholesale production facility for Salt Point Brewery, including on -site retail sales / taproom and outside seating, (including restaurant) and other site improvements including parking spaces on 5.479 acres at Auburn Road at Town Center Lands connected to the Town Center Trail (across from ballfields, adjacent to Milton Meadows), Lansing, New York, also known as Tax Parcel No. 31.4-16.6 (Parcel D) located in the Commercial, Mixed -Use (B-1) Zoning District; and WHEREAS, 6 NYCRR § 617 of the State Environmental Quality Review Act ("SEQRA") requires that a Lead Agency be established for conducting environmental review of projects in accordance with local and state environmental law and the Lead Agency shall be that local agency which has primary responsibility for approving and funding or carrying out the action; and WHEREAS, this proposed action is an Unlisted Action for which the Town of Lansing Planning Board is the sole involved agency for the purposes of a State Environmental Quality Review Act ("SEQRA") review; and WHEREAS, the Planning Board, being the local agency which has primary responsibility for approving the action, did on. August 12, 2019 declare itself the Lead Agency for the environmental review; and WHEREAS, this is a proposed action reviewed under Section 701.0 Site Plan Review of the Town of Lansing Land Use Ordinance, for which the completed application was received August 10, 2019; and WHEREAS, the Planning Board, acting as Lead Agency in environmental review, did on August 12, 2019 and August 26, 2019, review and accept as adequate: Site Plan (A1.0) "Proposed Site Plan, Proposed Development of Lansing Meadows Parcel `D," prepared by Jonathan Wolfe Architecture; and a Short Environmental Assessment Form (SEAF), Part 1, submitted by the Applicant, and Part 2, prepared by the Lead Agency; and other application materials; and WHEREAS, the Planning Board, having declared itself Lead Agency in this matter, on August 26, 2019 determined the proposal will result in no significant impact on the environment and that a Negative Declaration for Purposes of Article 8 of the Environmental Conservation Law be filed in accordance with provisions of 6 NYCRR § 617 of the State Environmental Quality Page 1 of 4 Review Act ("SEQRA"); and WHEREAS, this action was referred to Tompkins County Department of Planning and Sustainability under the referral requirements of General Municipal Law ("GML") §§ 239-1, 239-m, and 239-n and a September,11, 2019 letter from Commissioner of Planning and Sustainability Katherine Borgella determined that the proposal has no negative inter - community or county -wide impacts; and WHEREAS, legal notice was published on August 17, 2019 and adjacent property owners within 600 feet were notified by mail on August 16, 2019, and pursuant to Section 701.6.2 of the Land Use Ordinance ("LUO") of the Town of Lansing, the Planning Board held a Public Hearing on August 26, 2019, which was heard by the Planning Board to assure full opportunity for citizen participation; and WHEREAS, the Planning Board has duly considered the proposed Site Plan and proposed Utility Plan in accordance with the provisions of the Town of Lansing Land Use Ordinance Section 701.4 et seq., including consideration of site characteristics, site lighting, nearby residences, landscaping, parking, and screening, and any potential on- and off -site environmental impacts, and upon due consideration and deliberation by the Town of Lansing Planning Board, NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: Preliminary and Final Site Plan Approval be and hereby is granted for the Salt Point Farm Brewery and Tasting Room at Lansing Town Center with the landscaping and amenities as submitted in the final Site Plan (A1.0) "Proposed Site Plan, Proposed Development of Salt Point Brewing Parcel 'D,'" and Utility Plan (A2.0) "Proposed Utility Plan, Proposed Development of Salt Point Brewing Parcel 'D,' prepared by Jonathan Wolfe Architecture, both dated 9/10/2019 and all subject to the following specifications and conditions: 1. In accordance with LUO § 701.10, this Site Plan approval is valid for only 36 months from the date hereof, and the applicant/ owner is required to commence and substantially complete the construction or other activities for which the site plan is applicable within said 36 months or this approval shall, unless extended upon application timely made, expire, lapse, and be of no further validity, force or effect. 2. Building Permits will be required to construct the approved building and site facilities and such plans must meet all code requirements, including the sealing of plans by a licensed engineer or architect, and be constructed in compliance with all state and local building code requirements. 3. Receiving approval from New York State Department of Environmental Conservation ("DEC") and the State and Tompkins County Health Departments (together, the "DOH") for the proposed sanitary sewer or septic treatment system servicing the Salt Point Farm Brewery and Tasting Room. The patio/ deck shall not be installed atop the Page 2 of 4 sand filter associated with the On -Site Water Treatment System. The obtaining of final approvals and permits for such sewer or on -site wastewater treatment system(s) shall be a requirement of this Site Plan approval, both as pre -conditions to obtaining any building permit and a Certificate of Occupancy ("CO"). 4. Approval from the Southern Cayuga Lake Intermunicipal Water Commission ("Bolton Point") for the installation of one or more master water meters located at points selected by Bolton Point substantially adjacent to the public highways upon such Map. The Developer and owner will be responsible for the installation and maintenance of the complete water system throughout the Project, including, fife ,hydrants, and the payment of all water bills. The obtaining of final approvals and per'mits from Bolton Point and the final testing and approval of all water lines, hydrant's, anq systems shall be a requirement of this Site Plan approval, and no building permits and=no certificates of compliance or occupancy shall be applied for or,delivefed until such permits and approvals are duly obtained, and such system is tested; up, funning and operational. 5. Review and approval of the overall stormwater plans, retention basins, and drainage systems as included within the Stormwater Pollution Prevention Plan ("SWPPP") dated 9/18/2019, including specific approvals as follows: a. All stormwater calculations and designs shall be approved by the Town Engineer.. b. The final SWPPP shall be duly approved by the Town Engineer and the Towns SMO. c. All permanent stormwaterpractices shall be subject to adequate easements and a stormwater operation, management, and reporting agreement ("SOMRA") to ensure the long term viability of stormwater practices and improvements, as well as mandated reporting,`per EPA Phase II Stormwater Rules and the requirements own of DEC and the Ts Stormwater Local Law, with the form of such easements and SOMRA to be approved by the Town Engineer and the Attorney for the Town. d. The execution of, such SOMRA and emplacement of such easements shall be a requirement _of this site plan approval, and no certificates of compliance or ;occupancy shallbeapplied for or delivered until such SOMRA and any such easements are duly executed, dedicated and accepted, and filed in the Tompkins :A . County Clerk's Office (at Developer's sole expense). 6. Applicant agrees with the following recitation and consents to the following conditions and, in`"connection therewith The Town's rights, as set forth in Applicant's deed (Instrument # 2019-08380, filed in Tompkins County Clerk's Office July 15, 2019), to keep, maintain, locate, and relocate the Town Center Trail (the "Trail") and its rights -of - way as per the Lansing Town Center Trail Policy (adopted by the Town Board September 5, 2018) in such manner as ensures the continuity and existence of the Trail: a. The Towns Trail rights -of -way, which shall be sited and located along the southerly and westerly boundaries of applicant's parcel, being 20' in width, as shown on the final Site Plan. Page 3 of 4 b. The Towns right to install within the southerly extent of such right-of-way, and together with or adjacent to the Trail, a 5'-8' wide concrete (or other hard - surfaced) sidewalk. 7. The applicant must be issued a Sign Permit in compliance with the Town's Sign Local Law (#1 of 2014) in order to erect, install, build, place, emplace, site, or substantially rebuild or repair any Sign. 8. Modification to landscaping, lighting, or signage as shown on the Site Plan must be in accordance with LUO § 701.7.5; significant changes in aesthetic appearance will be referred to the Planning Board at the discretion of the Code Enforcement Officer. 9. Lighting must be International Dark -Sky compliant and limited to a color temperature of 3000K degrees or less. 10. The Applicant agrees to end amplified music at 11 pm.
