HomeMy WebLinkAbout19-32 Peruville Rd Minor 2 lot SubdivisionRESOLUTION PB 19-32 TOWN OF LANSING PLANNING BOARD RESOLUTION APPROVING TWO -LOT MINOR SUBDIVISION FINAL PLAT, PERUVILLE ROAD, LANSING, NEW YORK WHEREAS, an Application was made by Andrew J. Sciarabba on behalf of Lansing Associates for Minor Subdivision approval, thus creating two new undeveloped commercial building lots, at Peruville Road, Lansing, New York, and otherwise known as Tax Parcel #30.-1-16.22, consisting of a total of 3.42± acres, in the B2 (General Commercial) Zoning District; and WHEREAS, the Applicant proposes to subdivide the existing 3.42-acre property into two parcels: Parcel 1, measuring 1.179 acres with existing Raised Bed Septic Area, approved by Site Plan by the Planning Board of the Town of Lansing by Resolution 09-87 on August 10, 2009, and Parcel 2, measuring 2.237 acres and vacant; and WHEREAS, the Planning Board has considered and carefully reviewed the requirements of the Town's local laws relative to subdivisions and the unique needs of the Town due to the topography, the soil types and distributions, and other natural and man-made features upon and surrounding the area of the proposed subdivision, and the Planning Board has also considered the Town's Comprehensive Plan and compliance therewith; and WHEREAS, this proposed lot to be subdivided was previously subdivided in 2016 separating the property at Tax Parcel #30.-1-16.22 from this parcel, meets the current definitions and requirements for a minor subdivision in that the subdivision is only for 2 lots and, there are no roads or infrastructure proposed to be developed, and the lots conform to zoning requirements; and WHEREAS, this is an Unlisted Action under the State Environmental Quality Review Act and is subject to environmental review; and WHEREAS, this Board, acting as Lead Agency in environmental review, did on September 9, 2019 review and accept as adequate: a Short Environmental Assessment Form (SEAF), Part 1, submitted by the Applicant, and Part 2, prepared by the Planning Administrator; a subdivision plat entitled "Subdivision Plat - Showing Lands of Lansing Associates Located on Peruville Road - Town of Lansing, Tompkins County, New York," prepared by T.G. Miller, P.C. and dated 8/4/2019; and other application materials; and WHEREAS, the Planning Board recognizes that information received and reviewed for this Minor Subdivision indicates the resultant parcels conform to area requirements in the B2 (General Commercial) Zoning District; and WHEREAS, this action was referred to Tompkins County Department of Planning and Sustainability under the referral requirements of General Municipal Law ("GML") §§ 239-1, 239-m, and 239-n [submitted Aug 26 2019]; and Page 1 of 3 WHEREAS, on September 9, 2019, the Planning Board reviewed and considered the aforementioned subdivision application in the Lansing Town Hall, 29 Auburn Road, Lansing, New York 14882 and duly held a Public Hearing on the Minor Subdivision application, and all evidence and comments were considered, along and together with the requirements of the Town's subdivision regulations, existing development in the surrounding area, the public facilities and services available, the Town's Comprehensive Plan and the Land Use Ordinance, site characteristics and issues, and any potential on- and off -site environmental impacts; and WHEREAS, upon due consideration and deliberation by the Town of Lansing Planning Board, now therefore be it RESOLVED, that the Town of Lansing Planning Board grants Final Plat Approval of the Application for a two -lot subdivision of certain Lands of Lansing Associates Located on Peruville Road, Lansing, New York, subject to the following conditions: 1. No building permits may be applied for or issued for the subject parcels until the following waterline and utility easements are properly executed and properly filed of record in the County Clerk's office: a. A 20'-wide water main and utility easement running southerly from Town Barn Road is filed, giving applicant the right to run any needed service lines to the subdivided parcels along the line demarking the boundary line between the parcels owned by the Lansing Market Realty, LLC and Morabito Holdings, as shown in and upon the Subdivision Plat map. b. A 20'-wide water main and utility easement and right-of-way for the installation of water mains, related appurtenances, and other utilities and town facilities, running along the southern boundary of the subdivided parcels (being Parcel 1 and Parcel 2, as shown upon the Subdivision Plat map, being now also each part of TPN 30.-1-16.22), such easement area being immediately to the northerly boundary of the highway right-of-way for Peruville Road, is filed in a form to be reasonably approved by the Town of Lansing, granting the Town of Lansing and the Consolidated Water District the right to use and install water mains, utilities and any related appurtenances within and along such easement. 2. Parcel 1 remains a raised -bed septic area for the benefit of adjacent Tax Parcel 30.4-16.4 as per Planning Board Resolution No. 09-87. 3. The sealing and endorsement of such Minor Subdivision Final Plat by the Planning Board Chair, thereafter presenting and obtaining the signing of the plat by Tompkins County Assessment Department stamp followed by filing in the Tompkins County Clerk's Office, followed by provision of proof of such filing within the time limit requirements with the Town of Lansing Code Enforcement Office. Obtaining the necessary curb-cut/work permits from the appropriate State, County or local Highway Department(s) for any future driveways connecting with Peruville Road, as well as for any culverts that are to be installed in conjunction with such driveways.
