(tasting room, production area, kitchen, 46 walk in coolers and bathrooms) 47 - Sizable outdoor space with play structures that the insurance company will allow 48 (would like it to be a fun place for kids and parents) 49 - Applicant would like to host festivals or events 50 - Grain is currently delivered in pallets as needed 51 - The walk-in cooler might be located outside with screening 52 - Ideally Applicant would like to reduce grade height of the new fill by about 2' by 53 tapering off the sides with a gradual decline 54 - View of Milton Meadows is mostly the roof of the Community Center 55 - Driveway entrance is about 150' from Ridge Road 56 - Applicant would like to bring in someone to run the kitchen 57 - Phase I is to complete the slab and the building shell before winter, if the Engineering 58 and Site Plan can get completed in a timely manner 59 - Applicant would like to open the Brewery next year around this time 60 - The second level deck would not need to be handicap accessible there is plenty of first 61 floor patio and indoor space. Insurance company will dictate if applicant keeps the 62 second floor deck 63 - Close of business day will be around 9 pm. The property is in the 85 Commercial Mixed Use (B1) Zoning District. This is a Type II Action under the State 86 Environmental Quality Review Act 6 NYCRR 617.5(c)(12). 87 88 Public Hearing was published on July 11, 2019 as required by Law. 600' parcel notices mailed 89 on July 10, 2019. 90 91 Motion to Open the Public Hearing for Quality Shed Site Plan at 7:05 pm 92 Motioned by: Lin Davidson Seconded by: Dean Shea (Motion Carried) 93 94 Dale Martin approached the front table for discussion with the Planning Board. 95 96 Summary of Discussion: 97 - Shed Display of 20 to 30 sheds on the corner of East Shore Drive and Ridge Road 98 - The parking lot access will be reduced to a 60' entrance with a barrier high enough to 99 see above the snow in the winter. Acceptable barriers may consist of (but are not 100 limited to) railroad ties, boulders or split rail fencing 101 - Parking spaces will be designated for customer use with ample turn a round area 102 - Signs will be compliant to the Local Sign Law and will direct interested parties to the 103 office 104 - Low traffic impact, it is rare to have more than two cars at a time in the parking lot 105 - Existing trees will remain on the property 106 107 Public Comment: 108 - The property has been neglected for some time, which is bothersome for the Town of 109 Lansing in general. That intersection is the gateway to Lansing and part of the Scenic 110 by way. SHORE DRIVE, 142 TAX PARCEL NO. 31.-6-14 143 144 WHEREAS, an Application was submitted for Site Plan approval by Dale Martin, Applicant, 145 Marion M. George, Owner, to repurpose the site for the non-permanent placement of a 146 display lot for retail sale of approximately 25-30 lawn and garden storage sheds on 1.78 acres 147 at 2080 E. Shore Drive, Lansing, New York, also known as Tax Parcel Number 31.-6-14, 148 located in the Commercial Mixed Use Zoning District (B1); and 149 150 WHEREAS, this action allowing placement of minor accessory/appurtenant residential 151 structures was determined to be a Type II Action under 6 NYCRR § 615 (c)(12) of the State 152 Environmental Quality Review Act ("SEQRA"); and 153 154 WHEREAS, this is a proposed action reviewed under Section 701.0 Site Plan Review of the 155 Town of Lansing Land Use Ordinance,for which the completed application was received June 156 20, 2019; and 157 158 WHEREAS, this Board did on July 22, 2019, review and accept as adequate: Sketch of Tax 159 Parcel Number 31.-6-14 dated July 22, 2019; correspondence from New York State 160 Department of Transportation confirming no Highway Work Permit is needed for placement 161 of barriers, dated July 16, 2019; and other application materials; and 162 163 WHEREAS, adjacent property owners within 600 feet were notified by mail on June 26, 2019 164 and notice of Public Hearing was published on July 11, 2019; and 165 166 WHEREAS, this action is exempt from New York State General Municipal Law §239 -1, -m, 167 and -n referral requirements as there is no change in commercial use in the existing building 168 and the action does not involve any change in building footprint or change in vehicular 169 access on a State or County highway are excluded per an Inter-Governmental 170 Agreement between the Tompkins County Planning Department and the Town of Lansing 171 dated December 17, 2003; and Page 4 of 10 APPROVED 172 173 WHEREAS, the Planning Board has again considered and carefully reviewed the 174 requirements of the LUO relative to site plan review, the unique needs of the Town due to 175 the topography, the soil types and distribution, and other natural and man-made features 176 upon and surrounding the area of the proposed site plan, and the Planning Board has also 177 considered the zoning in the area and the project in light of the Towri s Comprehensive Plan 178 and compliance therewith, and as the underlying use is a permitted use in the zone in which 179 located; and 180 181 WHEREAS, on July 22, 2019 the Planning Board duly held a public hearing considered the 182 proposed site plan in accordance with the provisions of LUO § 701.4 et seq., including 183 concerns addressing site drainage, lighting, nearby residences, landscaping, parking, 184 buffering, screening, driveways, and any potential on and off site environmental impacts, 185 and upon due consideration thereupon and deliberation by the Town of Lansing Planning 186 Board, now therefore be it 187 188 RESOLVED, that the Planning Board of the Town of Lansing does hereby grant Preliminary 189 and Final Site Plan approval for Town of Lansing Tax Parcel Number 31.-6-14 for Quality 190 Sheds, Applicant, Marion M. George, Owner, subject to the following conditions: 191 192 1. No structures may be permanently emplaced or affixed. 193 2. In accordance with LUO § 701.10, this site plan approval is valid for only 36 months 194 from the date hereof. 195 3. This is an Unlisted Action under the State Environmental Quality Review Act and 231 is subject to environmental review. and other application materials; and 346 347 WHEREAS, a negative declaration of environmental impacts was duly issued under the State 348 Environmental Quality Review Act (SEQRA) in respect of this action, and it is further noted 349 that this action is exempt from the General Municipal Law County Planning referral 350 requirements of General Municipal Law ("GML") §§ 239-1, 239-m, and 239-n through an 351 Inter-Governmental Agreement between the Tompkins County Planning Department and 352 the Town of Lansing dated December 17, 2003, as "residential subdivisions of fewer than 5 353 lots all of which comply with local zoning standards and Tompkins County Sanitary Code 354 requirements, and do not involve new local roads or streets directly accessing a State or 355 county road" are excluded from GML referral requirements; and 356 357 WHEREAS, on July 22, 2019, the Planning Board reviewed and considered the 358 aforementioned subdivision application in the Lansing Town Hall, 29 Auburn Road, Lansing, 359 New York 14882 and duly held a public hearing on the Minor Subdivision application, and Page 8 of 10 APPROVED 360 all evidence and comments were considered, along and together with the requirements of the 361 Towns subdivision regulations, existing development in the surrounding area, the public 362 facilities and services available, the Planned Development Area (PDA) #1 Local Law and 363 amendments, the Towns Comprehensive Plan and the Land Use Ordinance, site 364 characteristics and issues, and any potential on and off site environmental impacts; and 365 366 WHEREAS,upon due consideration and deliberation by the Town of Lansing Planning Board, 367 now therefore be it 368 369 RESOLVED, that the Town of Lansing Planning Board grants Final Plat Approval of the 370 Application for a four-lot subdivision of certain land on 40 Village Place, 113 & 117 Village 371 Circle, Lansing, New York, when so amended in accordance with the following conditions: 372 373 1. Final Plat Notes shall indicate that until the Village Place roadway extension is 374 improved, offered for dedication, and accepted by the Town, the roadway will 375 be and remain a private road and all maintenance and repair, including snow 376 and ice management and removal, is and remains the sole responsibility of the 377 developer. 378 2. If Village Solars, LLC can afford to acquire the other half of the Page 9 of 10 APPROVED 407 PDA from the Estate it gives them the opportunity to move the Community Center and 408 make it larger and more centrally located for all the tenants 409 - Applicant is asking to start building"M", also known"119", before the 410 Community Center is built 411 - The original proposal of the Community Center has a small restaurant or cafe bar, a small 412 exercise room, the rental office and a some office space for some of the tenants with 20 413 apartments on the 2nd and 3rd floors 414 - The larger Community Center the Applicant would like to propose (if they acquire the 415 other half of the PDA) would have a full size restaurant, larger recreation center, possibly 416 a pool and would be centrally located. The larger CC would trigger an amendment to the 417 PDA 418 - Anticipated construction of the Community Center -whether it is the original proposal or 419 the larger centrally located proposal -will be estimated to start next summer 420 - The Planning Board would like to see more of a commitment from the Applicant, like 421 providing some interim solutions for the tenants with some additional amenities until 422 the Community Center is built, like a food truck or ice cream truck or hire a band 423 periodically 424 - Planning Board would add a condition to the waiver, that Buildings 2, 22 and 117 will 425 only receive building permits after the completion of the Community Center. 426 - Planning Board would also allow Village Solars to apply for a building permit for 427 building 119 (previously known as building"M") 428 - The Planning Board extensively considered the third waiver for the Community Center 429 before recommending to the Town Board. 430 431 Motion recommending the Town Board to Extend the Completion Date of Village Solars 432 Community Center to December 31, 2021 with a condition that Buildings 2, 22 and 117 will 433 only receive building permits after the completion of the Community Center.
