The Planning Department 39 is responsive with direct questions as best as they can. 40 41 Project Title: Osmica Applicant: Kurt Martin Location: Tax Parcel No. 23.-1-6.32, 59 42 Emmons Road Anticipated Board action(s) this month: Determination of Modification of 43 Site Plan Project Description: The Applicant proposes amending Site Plan (approved May Page 1 of 13 APPROVED 44 15, 2019) under Land Use Ordinance 701.7 to increase the size of the solar panels from one 40' 45 x 16' array to two 80' x 11' arrays. The property is in the Rural Agriculture (RA) Zoning 46 District. 47 48 Kurt Martin approached the front table to speak with the Planning Board. 49 50 Applicant finalized the design for the Solar panels they would like to install. The Engineering 51 had been on hold while going through site plan process. Back in December 2018, Applicant 52 initially met with an Engineer and was given preliminary numbers based on the NYSEG 53 history for the property. That history did not include air source heat pumps and the 54 anticipated Event Center activity. The current decision was to add a second solar array and 55 reduce the height of each array and make it a little wider to accommodate the wind load. 56 57 Applicant is receptive to extending the buffering a little further to the property pin by the 58 solar array and maybe a little further if needed. 59 60 Question to the Planning Board; is this a significant change in the aesthetic appearance of this 61 particular site plan element including landscape and lighting details. Does the Planning 62 Board thinks this is significant or does it fall under Modification without Planning Board 63 approval? 64 65 The decision is a minor modification without Site Plan approval, giving the Code Officer the 66 judgement to make a determination on extending the buffering as needed under the Land 67 Use Ordinance 701.7.5. 68 69 Motion to give the Code Officer the judgement to make a determination on extending the 70 buffering as needed under the Land Use Ordinance Section 701.7.5 71 Motion by: Deborah Trumbull Seconded by: Jerry Caward (Motion Carried) 72 73 Project Title: N. He had 514 stopped in to use the bathroom while walking his dog at the park. We are fortunate to have 515 Myers Park here in Lansing, NY. 516 517 On that note, CJ added that the Town Board just accepted two sizable anonymous gifts of 518 money for Myers Park. 519 520 The Board discussed better ways to handle public comments. 521 - At the very least comment with"Received, Thank you for your comment" 522 - Possibly"Your comment will become part of the record" 523 - Somehow, educate the public that the Board does not answer the questions during the 524 Public Hearing. The comments and questions are answered and considered after the 525 Public Hearing is closed. 526 - Create an area on the Town Website explaining what happens at Public Hearings and 527 why. 528 - Dean Shea noted that State Law encourages the Planning Boards throughout New 529 York to make their determination and go through the approval process then hold the 530 Public Hearing, with the thought that the Board could change their determination 531 after the hearing if needed. The Lansing Planning Board is thankful that here in 532 Lansing the Public Hearing is held in advance to give the public a chance to speak 533 prior to the determination of the Board. The Board values what the public has to say 534 and finds the comments helpful while going through the mitigation process. The 535 board would prefer not to re-open site plan to amend after the approval process. 536 537 CJ reminded the Board Members that if they have not attended the"Heated Meeting" 538 training there is one tomorrow evening (Tuesday,June 25, 2019) at 6:30 pm. 539 540 Project Title: Sullivan Boundary Line Change Applicant: Mary Sullivan/ Steinhart 541 Location: Tax Parcel 37.1-7-3.23; Drake Road Anticipated Board action(s) this month: 542 Classification of Subdivision Project Description: The Applicant proposes Lot Line 543 Adjustment of the existing +/-6.28-acre parcel. Classification by the Planning Board is 544 requested in accordance with the Town of Lansing Subdivision Local Law Number 3 of 2016. 545 546 Summary of Discussion: 547 - CJ Randall, Planning Director would like the board to review and decide a 548 Classification of Subdivision 549 - Request involves two land locked parcels one with a right a way to enter 550 - This does not fit the normal lot line adjustment as it transfers more than an acre 551 - Applicant would like to sell 2.29 acres to an adjacent property owner Page 12 of 13 APPROVED 552 - The adjacent owner would then consolidate the newly purchased property with their 553 existing lot which has a right a way. Must be consolidated as part of the approval 554 - Not creating a buildable lot 555 556 The Planning Board has no problem with Sullivan Boundary Line Change being classified as 557 a lot line adjustment. 558 559 Planning Board Chair asked if there is anything else to be discussed. 560 561 Adjourned Meeting 562 563 Meeting adjourned at the call of the Planning Board Chair at 8:19 p.m. 564 Minutes taken and executed by Sue Munson. 566 Access to public documents are available online at: Town Website https://www.lansingtown.com Planning Board agendas https://www.lansingtown.com/agendas-meetings-docs Planning Board minutes https://www.lansingtown.com/agendas-meetings-docs Planning Board submittals https://www.lansingtown.com/agendas-meetin sg docs 575 Planning Board Email tolcodes@lansingtown.com Page 13 of 13
