33 One public comment-Why is it that the Planning Board does not always acknowledge
34 communication sent to them? Also, stated that the Clerk was very hurtful during a
35 conversation.

37 The Board Chair said; as a board, we do not always respond to each comment. The comments
38 are taken into consideration when they are making their decisions. The Planning Department
39 is responsive with direct questions as best as they can.

48 Kurt Martin approached the front table to speak with the Planning Board.

50 Applicant finalized the design for the Solar panels they would like to install. The Engineering
51 had been on hold while going through site plan process. Back in December 2018, Applicant
52 initially met with an Engineer and was given preliminary numbers based on the NYSEG
53 history for the property. That history did not include air source heat pumps and the
54 anticipated Event Center activity. The current decision was to add a second solar array and
55 reduce the height of each array and make it a little wider to accommodate the wind load.

57 Applicant is receptive to extending the buffering a little further to the property pin by the
58 solar array and maybe a little further if needed.

60 Question to the Planning Board; is this a significant change in the aesthetic appearance of this
61 particular site plan element including landscape and lighting details. Does the Planning
62 Board thinks this is significant or does it fall under Modification without Planning Board
63 approval?

65 The decision is a minor modification without Site Plan approval, giving the Code Officer the
66 judgement to make a determination on extending the buffering as needed under the Land
67 Use Ordinance 701.7.5.

229 WHEREAS, the Tompkins County Department of Planning and Sustainability has been
230 given the opportunity to comment on the proposed action; and
231
232 WHEREAS, in an May 29, 2019 letter from Katherine Borgella, Tompkins County
233 Commissioner of Planning, pursuant to §239 -1, -m, and -n of the New York State General
234 Municipal Law determined the local law may have negative inter-community, or county-
235 wide impacts, and recommended the following modification of the proposal:
236
237 • To help ensure safe access to and from County Road 122 (North Triphammer Road)
238 the Tompkins County Highway Department recommends that the project not reuse
239 the existing access drives, rather they recommend consolidation to just one location
240 aligned with the opposing driveway across North Triphammer Road. As a part of the
241 required Highway Permit, County Highway will provide further guidance on the
242 geometry of that access point.
243 To help meet our County's goals of reducing greenhouse gas emissions, we
244 recommend the Town require the applicant to document that they have considered the
245 four energy elements for new construction projects outline in the attached Tompkins
246 County Energy Recommendations for New Construction (2018); and
247
248 WHEREAS, the comments were carefully considered by the Planning Board, and included a
249 review of the "Energy Options Report" prepared by the Tompkins County Business Energy
250 Advisors and review of"Environmental Alert: Important Recommendations for Indoor and
251 Outdoor Lighting (2017)" prepared by the Tompkins County Environmental Management
252 Council, and the Applicant resubmitted a revised Site Plan in accordance with the County's
253 recommendation to use the existing curb cut onto North Triphammer Road; and
254
255 WHEREAS, that the Planning Board of the Town of Lansing on June 24, 2019 determined the
256 proposal will result in no significant impact on the environment and that a Negative
257 Declaration for purposes of Article 8 of the Environmental Conservation Law be filed in
258 accordance with the provisions of Part 617 of the State Environmental Quality Review Act;
259 and
260
261 WHEREAS, the Planning Board has again considered and carefully reviewed the
262 requirements of the LUO relative to site plan review, the unique needs of the Town due to
263 the topography, the soil types and distribution, and other natural and man-made features
264 upon and surrounding the area of the proposed site plan, and the Planning Board has also
265 considered the zoning in the area and the project in light of the Towri s Comprehensive Plan
266 and compliance therewith, and as the underlying use is a permitted use in the zone in which
267 located; and
268
269 WHEREAS, on May 13, 2019 and June 10, 2019 and June 24, 2019 the Planning Board duly
270 considered the proposed site plan in accordance with the provisions of LUO § 701.4 et seq.,
271 including concerns addressing site drainage, lighting,nearby residences, landscaping,
272 parking, buffering, screening, driveways, and any potential on and off site environmental
273 impacts, and upon due consideration thereupon and deliberation by the Town of Lansing
274 Planning Board, now therefore be it

276 RESOLVED, that the Planning Board of the Town of Lansing does hereby grant Preliminary
277 and Final Site Plan approval for Town of Lansing Tax Parcel Numbers 37.1-3-18 for S.E.E.
278 Associates, Owner, Andrew J. Sciarabba, Applicant, subject to the following conditions:
279
280 1. In accordance with LUO § 701.10, this site plan approval is valid for only 36 months
281 from the date hereof, and the applicant/owner is required to commence and
282 substantially complete the construction or other activities for which the site plan is
283 applicable within said 36 months or this approval shall, unless extended upon
284 application timely made, expire, lapse, and be of no further validity, force or effect.
285 2. The applicant will be required to obtain Bolton Point water permit for a new water
286 service and meter to connect to the existing Consolidated Water District Mains, as well
287 as a Tompkins County Health Department Onsite Wastewater Treatment System
288 (OWTS) permit,both as pre-conditions to obtaining any building permit and a
289 Certificate of Occupancy ("CO").
290 3. Building Permits will be required to construct the approved building and site facilities
291 and such plans must meet all code requirements, including the sealing of plans by a
292 licensed engineer or architect, and be constructed in compliance with all state and
293 local building code requirements.
294 4. All existing and proposed trees (including as shown on the Site Plan labeled SITE-1
295 described above) shall be maintained as healthy and natural non-invasive vegetation
296 designed to provide both visual and sound buffering. Existing and new trees shall be
297 properly maintained and any dead, diseased, or dying trees shall be promptly
298 replaced.
299 5. All parking layouts, screening, dark sky lighting, and other site conditions listed in
300 Site Plan (SITE-1) for "Proposed Construction, S.E.E. Associates, 3091 Triphammer
301 Road, Lansing, NY 14882" prepared by George W. Breuhaus, Architect, and dated
302 6/14/2019, shall be adhered to and complied with, and any questions or
303 interpretations as to the applications of such requirements shall be approved by the
304 Code Enforcement Officer, upon verification of compliance by developer-owner.
305 6. Tax Parcel Number 37.1-3-18 and 37.1-3-17 are forever merged as a single parcel, and
306 any future lot line or subdivision is subject to review and approval as a subdivision by
307 the Town.
308 7. The applicant must be issued a Sign Permit in compliance with the Towns Sign Local
309 Law (#1 of 2014) in order to erect, install, build, place, emplace, site, or substantially
310 rebuild or repair any Sign.
311 8. Modification of vehicular ingress and egress requires Modification of Site Plan by the
312 Planning Board.

348 - Larry Sharpsteen, Planning Board Member made a notation that he is doing a water
349 test on this property as a favor to the seller of the property. No financial arrangements
350 are involved. If the Board would like him to recuse himself and sit in the audience, he
351 will. The Board was comfortable with Larry staying on as a voting member.
352 - Applicants are purchasing the property at 144 Locke Rd and they would like to
353 subdivide the back 12 acres with the intent to sell it to Willet Dairy.
354 - The stamped plans to subdivide will not be filed with the County Clerk until closing
355 for the purchase of the property at 144 Locke Rd.
356 - In the future, the Applicant may further subdivide the front 5.93 acres of the parcel to
357 create one additional lot.

447 WHEREAS, this is a proposed action reviewed under Local Law 3 of 2016, Subdivision Rules
448 and Regulations of the Town of Lansing for which the completed application was received
449 June 7, 2019; and

451 WHEREAS, the Planning Board has considered and carefully reviewed the requirements of
452 the Towri s local laws relative to subdivisions and the unique needs of the Town due to the
453 topography, the soil types and distributions, and other natural and man-made features upon
454 and surrounding the area of the proposed subdivision, and the Planning Board has also
455 considered the Towri s Comprehensive Plan and compliance therewith; and
456
457 WHEREAS, this Board, acting as Lead Agency in environmental review, did on June 24,
458 2019, review and accept as adequate: "Subdivision - Lands of Mary H. Merrill" prepared by
459 Owasco Land Surveying and dated May 30, 2019; an Agricultural Data Statement and Short

460 Environmental Assessment Form (SEAF), Part 1, submitted by the Applicant, and Part 2,
461 prepared by the Planning Board; and other application materials; and

463 WHEREAS, a negative declaration of environmental impacts was duly issued under the State
464 Environmental Quality Review Act (SEQRA) in respect of this action, and it is further noted
465 that this action is exempt from the General Municipal Law County Planning referral
466 requirements of General Municipal Law ("GML") §§ 239-1, 239-m, and 239-n through an
467 Inter-Governmental Agreement between the Tompkins County Planning Department and
468 the Town of Lansing dated December 17, 2003, as "residential subdivisions of fewer than 5
469 lots all of which comply with local zoning standards and Tompkins County Sanitary Code
470 requirements, and do not involve new local roads or streets directly accessing a State or
471 county road" are excluded from GML referral requirements; and
472
473 WHEREAS, on June 24, 2019, the Planning Board reviewed and considered the
474 aforementioned subdivision application in the Lansing Town Hall, 29 Auburn Road, Lansing,
475 New York 14882 and duly held a public hearing on the Minor subdivision application or its
476 SEQRA review, and all evidence and comments were considered, along and together with
477 the requirements of the Towns subdivision regulations, existing development in the
478 surrounding area, the public facilities and services available, the Towns Comprehensive Plan
479 and the Land Use Ordinance, site characteristics and issues, and any potential on and off site
480 environmental impacts; and

482 WHEREAS,upon due consideration and deliberation by the Town of Lansing Planning Board,
483 now therefore be it

485 RESOLVED, that the Town of Lansing Planning Board grants Final Plat Approval of the
486 Application for a two-lot subdivision of certain land on Locke Road, Lansing, New York, and
487 that the afore-described survey map shall suffice as a Final Plat when so amended in
488 accordance with the following conditions:

490 1. The sealing and endorsement of such Minor Subdivision Final Plat by the Planning
491 Board Chair, thereafter presenting and obtaining the signing of the plat by Tompkins County
492 Assessment Department stamp followed by filing in the Tompkins County Clerk's Office,
493 followed by provision of proof of such filing within the time limit requirements with the Town
494 of Lansing Code Enforcement Office.

513 Lin Davidson made a comment on how clean the meri s bathroom is at Myers Park. He had
514 stopped in to use the bathroom while walking his dog at the park. We are fortunate to have
515 Myers Park here in Lansing, NY.

517 On that note, CJ added that the Town Board just accepted two sizable anonymous gifts of
518 money for Myers Park.

520 The Board discussed better ways to handle public comments.
521 - At the very least comment with"Received, Thank you for your comment"
522 - Possibly"Your comment will become part of the record"
523 - Somehow, educate the public that the Board does not answer the questions during the
524 Public Hearing. The comments and questions are answered and considered after the
525 Public Hearing is closed.
526 - Create an area on the Town Website explaining what happens at Public Hearings and
527 why.
528 - Dean Shea noted that State Law encourages the Planning Boards throughout New
529 York to make their determination and go through the approval process then hold the
530 Public Hearing, with the thought that the Board could change their determination
531 after the hearing if needed. The Lansing Planning Board is thankful that here in
532 Lansing the Public Hearing is held in advance to give the public a chance to speak
533 prior to the determination of the Board. The Board values what the public has to say
534 and finds the comments helpful while going through the mitigation process. The
535 board would prefer not to re-open site plan to amend after the approval process.

537 CJ reminded the Board Members that if they have not attended the"Heated Meeting"
538 training there is one tomorrow evening (Tuesday,June 25, 2019) at 6:30 pm.
