RESOLUTION PB 19-20
PRELIMINARY AND FINAL APPROVAL - SITE PLAN REVIEW
OF TRIPHAMMER COMMERCIAL, 3091-3111 NORTH TRIPHAMMER RD,
TAX PARCEL NO.37.1-3-18
WHEREAS, an Application was submitted for Site Plan approval by S.E.E. Associates,
Owner, Andrew J. Sciarabba, Applicant, for the proposed site construction of a 9,600 sf
single -story mixed -occupancy building (including professional offices; commercial
recreation: indoors; and retail sales, general) and other site improvements including 48
parking spaces on 3.48 acres at 3091-3111 N Triphammer Road, Lansing, New York,
also known as Tax Parcel Number 37.1-3-18 (consolidated for tax purposes with 37.1-3-
17 in 2018), located in the Commercial General Business (B2) District; and
WHEREAS, the applicant's completed site plan considered the additional impacts of
development on the site and stormwater impacts and mitigation systems; and
WHEREAS, this action was determined to be an Unlisted Action for which the Town of
Lansing Planning Board is the sole involved agency for the purposes of a State
Environmental Quality Review Act ("SEQRA") review; and
WHEREAS, 6 NYCRR § 617 of the State Environmental Quality Review Act ("SEQRA")
requires that a Lead Agency be established for conducting environmental review of
projects in accordance with local and state environmental law and the Lead Agency
shall be that local agency which has primary responsibility for approving and funding
or carrying out the action; and
WHEREAS, the Planning Board, being the local agency which has primary
responsibility for approving the action, did on May 13, 2019 declare itself the Lead
Agency for the environmental review, and
WHEREAS, this is a proposed action reviewed under Section 701.0 Site Plan Review of
the Town of Lansing Land Use Ordinance, for which the completed application was
received April 29, 2019; and
WHEREAS, this Board, acting as Lead Agency in environmental review, did on May 13,
2019 and June 10, 2019 and June 24, 2019, review and accept as adequate: Site Plan
(SITE-1) for "Proposed Construction, S.E.E. Associates, 3091 Triphammer Road,
Lansing, NY 14882" prepared by George W. Breuhaus, Architect, and dated 6/14/2019;
"Energy Options Report," prepared by Tompkins County Business Energy Advisors
Program, and dated May 21, 2019; Town of Lansing Notice of Ground Disturbance Area
Tally, and a Short Environmental Assessment Form (SEAF), Part 1, submitted by the
Applicant, and Part 2, prepared by the Lead Agency; and other application materials;

and
WHEREAS, legal notice was published on May 28, 2019 and adjacent property owners
within 600 feet were notified by mail sent on May 23, 2019, and pursuant to Section
701.6.2 of the Land Use Ordinance of the Town of Lansing, the Planning Board held a
Public Hearing on June 10, 2019, which was heard by the Planning Board to assure full
opportunity for citizen participation; and
WHEREAS, the Tompkins County Department of Planning and Sustainability has been
given the opportunity to comment on the proposed action; and ' -- .
WHEREAS, in an May 29, 2019 letter from Katherine Borgella, Tompkins County
Commissioner of Planning, pursuant to §239 -1, -m, and -n of the New York Mate
General Municipal Law determined the local law may have negative inter -community,
or county -wide impacts, and recommended the following modification of the proposal:
To help ensure safe access to and from County Road 122 (North Triphammer
Road) the Tompkins County Highway Department recommends that the project
not reuse the existing access drives, rather they recommend consolidation to just
one location aligned with the opposing driveway across North Triphammer
Road. As a part of the required Highway Permit, County Highway will provide
further guidance on the geometry, of that access point.
To help meet our County's goals of ,reducing greenhouse gas emissions, we
recommend the Town require the applicant to document that they have
considered the four energy elements for new construction projects outline in the
attached Tompkins County Energy Recommendations for New Construction
(2018); and
WHEREAS, the comments were carefully considered by the Planning Board, and
included a review of the "Energy Options Report" prepared by the Tompkins County
Business Energy. Advisors and review of "Environmental Alert: Important
Recommendations for Indoor and Outdoor Lighting (2017)" prepared by the Tompkins
County Environmental Management Council, and the Applicant resubmitted a revised
Site Plan in accordance with the County's recommendation to use the existing curb cut
onto North Triphammer Road; and
WHEREAS, that the Planning Board of the Town of Lansing on June 24, 2019
determined the proposal will result in no significant impact on the environment and
that a Negative Declaration for purposes of Article 8 of the Environmental Conservation
Law be filed in accordance with the provisions of Part 617 of the State Environmental
Quality Review Act; and

WHEREAS, the Planning Board has again considered and carefully reviewed the
requirements of the LUO relative to site plan review, the unique needs of the Town due
to the topography, the soil types and distribution, and other natural and man-made
features upon and surrounding the area of the proposed site plan, and the Planning
Board has also considered the zoning in the area and the project in light of the Town s
Comprehensive Plan and compliance therewith, and as the underlying use is a
permitted use in the zone in which located; and
WHEREAS, on May 13, 2019 and June 10, 2019 and June 24, 2019 the Planning Board
duly considered the proposed site plan in accordance with the provisions of LUO §
701.4 et seq., including concerns addressing site drainage, lighting, nearby residences,
landscaping, parking, buffering, screening, driveways, and any potential on and off site
environmental impacts, and upon due consideration thereupon and deliberation by the
Town of Lansing Planning Board, now therefore be it
RESOLVED, that the Planning Board of the Town of Lansing does hereby grant
Preliminary and Final Site Plan approval for Town of Lansing Tax Parcel Numbers 37.1-
3-18 for S.E.E. Associates, Owner, Andrew J. Sciarabba, Applicant, subject to the
following conditions:
1. In accordance with LUO § 701.10, this site plan approval is valid for only 36
months from the date hereof, and the applicant/ owner is required to commence
and substantially complete the construction or other activities for which the site
plan is applicable within'said 36 months or this approval shall, unless extended
upon application timer made,.expire, lapse, and be of no further validity, force
or effect.
2. The applicant will be required to obtain Bolton Point water permit for anew
water service and meter to connect to the existing Consolidated Water District
Mains, as well as a°Tompkins County Health Department Onsite Wastewater
Treatment System (OWTS) permit, both as pre -conditions to obtaining any
building4ermit and a Certificate of Occupancy ("CO").
�3. Building Pernits will be required to construct the approved building and site
`fa'cilities and such plans must meet all code requirements, including the sealing
of plans`by a licensed engineer or architect, and be constructed in compliance
with all state and local building code requirements.
4. All existing and proposed trees (including as shown on the Site Plan labeled
SITE-1 described above) shall be maintained as healthy and natural non-invasive
vegetation designed to provide both visual and sound buffering. Existing and
new trees shall be properly maintained and any dead, diseased, or dying trees
shall be promptly replaced.
5. All parking layouts, screening, dark sky lighting, and other site conditions listed
in Site Plan (SITE-1) for "Proposed Construction, S.E.E. Associates, 3091

Triphammer Road, Lansing, NY 14882" prepared by George W. Breuhaus,
Architect, and dated 6/14/2019, shall be adhered to and complied with, and any
questions or interpretations as to the applications of such requirements shall be
approved by the Code Enforcement Officer, upon verification of compliance by
developer -owner.
6. Tax Parcel Number 37.1-3-18 and 37.1-3-17 are forever merged as a single parcel,
and any future lot line or subdivision is subject to review and approval as a
subdivision by the Town.
7. The applicant must be issued a Sign Permit in compliance with the Towri s Sign
Local Law (#1 of 2014) in order to erect, install, build, place, emplace, site, or
substantially rebuild or repair any Sign.
8. Modification of vehicular ingress and egress requires Modification of Site Plan
by the Planning Board. . `f
