Hinderliter Paul Southard 23 24 The Planning Board had a working meeting from 5:30 p.m. to 6:30 p.m. public is always 25 welcome to attend and observe. 26 27 Chair Jerry Caward opened the meeting at 6:31 p.m. 28 29 Privilege of the Floor 30 No Public Comments 31 32 Motion to approve the planning board minutes for May 13, 2019 meeting 33 Motion by: Larry Sharpsteen Seconded by: Deborah Trumbull (Motion Carried) 34 35 Town Board Liaison Report for the May Town Board Meeting 36 - Cayuga Power Plant is under consideration for a Data Center this would create 30 to 37 40 jobs in addition to a 15 megawatt Solar Farm on 75 acres (owned by Company). 38 - Discussion about the flood plain specifically relating to the Lansing Rod &Gun. 39 Learning what the board can do and cannot do. 40 - Resolution for Public Hearing-Warren Road Sewer Ext #1 - NYS DOT. Page 1 of 6 APPROVED 41 - Resolution updating the Intermunicipal Agreement with the Village of Lansing & 42 Cayuga Heights for a sewer district. 43 - Resolution allowing Supervisor Edward LaVigne to sign for the Myers Park tree- 44 planting grant. Also, Ed can sign the use commission agreement between the 45 Cooperative Extension and the Town of Lansing. 46 - Several other Resolutions, some involve seasonal employees. 47 - State Comptroller approved the Consolidated Water District (CWD) Ext #3 48 - NYS Town Clerks Association recognized Debbie Munson, Town Clerk as a registered 49 municipal clerk. 50 51 The Planning Board asked Doug Dake for an update on the soil samples that Katrina took by 52 Salmon Creek. Joe Wetmore answered with; Katrina will be presenting the results very soon. 53 There was no Lead in any of the samples although there are various heavy metals that were 54 present. At the Town Board Meeting Councilperson Joseph Wetmore stated he had twelve 55 emails with concerns to not allow toxic substances in the flood plain land. General concerns 56 are the Lansing Rod &Gun club, once a year evaluation to determine the flood plain and any 57 in-appropriate uses should be stopped. Councilperson Katrina Binkewicz stated, look at 58 zoning larger scale for all things in appropriate in the flood plain areas. CJ Randall Planning 59 Director noted she has not seen any of these emails. County is currently updating their 60 hazard mitigation plan. Town of Lansing can update Flood Damage Prevention Law and 61 participate in the Community Rating System. (CRS) pertains to the national flood insurance 62 program. Guy Krogh, Legal Counsel states flood plain laws deal with new construction to 63 protect downstream properties. He has not seen the emails mentioned by Joe but flood plain 64 laws do not regulate many activities. Supervisor Ed LaVigne stated that CJ Randall's first 65 priority is Solar, Town Board needs to share these letters with CJ and the subject should be 66 discussed with the Planning Board. 67 68 Planning Board notes that you have to be careful with the word toxic, there is solar 69 equipment that could pose a problem, there is agricultural practices that could be interpreted 70 as toxic as well as animal waste which can contain traces of heavy metals. A balance needs to 71 be figured out. 72 73 May 28, 2019 the Public Hearing Notice for the Triphammer Office Complex project was 74 published. On May 23,2019,the 600' parcel notices were mailed to property owners on the 75 list provided by the County. 76 77 Project Title: N. Triphammer Office Complex Applicant: Andrew J. Sciarabba for S.E.E. 78 Associates Location: Tax Parcel 37.1-3-18 Project Description: The Applicant proposes 79 construction of a 12,000 sf single-story mixed-occupancy building and other site improvements 80 including 48 parking spaces on 3.48 acres on N Triphammer Rd between Franklyn Drive and Peruville 81 Rd. The property is in the Commercial Mixed Use (13-2) Zoning District. 82 83 Motion to open the Public Hearing for the N. Triphammer Office Complex at 6:42pm 84 Motion by: Larry Sharpsteen Seconded by: Lin Davidson (Motion Carried) Page 2 of 6 APPROVED 85 Chair invited the Applicant, Andy Sciarabba and Architect George Breuhaus up to the table 86 for discussion. 87 88 Summary of the discussion: 89 - Proposed Commercial Building for mixed use; doctors, accountant ... 90 - Discussed possible ways to reduce the land disturbance 91 o Reducing some of the parking spots 92 o Sharing the Dumpster with the Applicant's commercial business next door 93 o The trees scheduled to be removed will be cut down,but will leave the stumps 94 o Moving building closer to the property border by the ATM machines will 95 reduce the number of trees to be removed 96 o Contractor employees can park next door by the ATM reducing ground 97 disturbance 98 o Driveway on the North side of N. Triphammer parcel is grown over and large 99 boulders will be placed to deter traffic use, like the adjacent property 100 - Other items discussed 101 o 12,000 sq. ft. building with up to six tenants. Interior will be designed as tenants 102 sign leases 103 o Site Plan Review requires Dark Sky Compliant Lighting outside with a 104 maximum of 3,200 Kelvin but as close to 2,700 Kelvin as possible and still 105 provide safety 106 o Curb cut will stay on Franklyn Drive for access to maintain the lawn 107 o Stormwater Drainage should be considered in this site plan 108 o Lit sign will be located by entrance to the parking lot with a timer to turn off. 109 The sign will comply with Lansing Sign Law 110 o Applicant has explored energy options, most were too expensive to go with 111 ■ Heat pumps will not keep up with temperatures below 2 degrees and 112 would require a secondary backup system 113 ■ Geothermal is too expensive and would create more ground disturbance 114 ■ Applicant decided to use roof top units with economizers for heat and 115 air-conditioning, which will give the flexibility needed for the final 116 buildout for each tenant. Burners on the units are 78 to 80 % efficient. 117 The units will also bring in fresh air through the roof top units as needed 118 which heat pumps are not able to supply 119 ■ Insulation Foam on interior side of the exterior walls to prevent drafts 120 ■ R49 insulation in the trusses 121 ■ Applicant feels by adding new businesses in Lansing it will cut down on 122 mileage for the local residence 123 o Building Codes today will also make the building energy efficient with all the 124 new regulations Page 3 of 6 APPROVED 125 o Trees on the land immediately by the Franklyn driveway area will not be taken 126 down 127 o Four light poles in the parking lot (Dark Sky Compliant) 128 o Foundation of the new building will be elevated above the grade of 129 Triphammer Rd 130 o Possibly sharing the adjacent properties Dumpsters, same owner for both 131 properties. Neighbor was asked if Crossroads was a noise issue. The developer may have to account for this project and the new project and go 181 through the full SWPPP process. There is no cut off; even if it is 10 years down the road, they Page 5 of 6 APPROVED 182 will still have to go through the process if they develop the rest of the property. At this time, 183 a simple bio-retention would be acceptable. 184 185 If the board makes a determination that, they need 200 sq. ft. of parking than they need 60 186 parking spaces not 48. 187 188 Possibly share with the parking from the adjacent building if the parking is considered in 189 excess of what their needs are. Parking utilization is approximately 50 % on the adjacent 190 property. 191 192 Planners Update 193 - We have received five applications for the Conservation Advisory Council (CAC). 194 o The CAC can submit written comments to the Planning Board and/or Town 195 Board on any given project from the lens of environmental review 196 o The applications will be passed onto the Town Board for review 197 - Discussion with Milton Meadows, they are getting ready open up the Lottery for the 198 initial tenants 199 - Discussion of inclusion of the Mattoon/Kingdom Farm to be brought into the County 200 designation as in the Ag District 201 - We are involved with the Incremental Development Alliance - they are doing an 202 overlook of the Town Center. We will need a couple of people to be involved in that 203 alliance.
