The Planning Board asked Doug Dake for an update on the soil samples that Katrina took by
Salmon Creek. Joe Wetmore answered with; Katrina will be presenting the results very soon.
There was no Lead in any of the samples although there are various heavy metals that were
present. At the Town Board Meeting Councilperson Joseph Wetmore stated he had twelve
emails with concerns to not allow toxic substances in the flood plain land. General concerns
are the Lansing Rod &Gun club, once a year evaluation to determine the flood plain and any
in-appropriate uses should be stopped. Councilperson Katrina Binkewicz stated, look at
zoning larger scale for all things in appropriate in the flood plain areas. CJ Randall Planning
Director noted she has not seen any of these emails. County is currently updating their
hazard mitigation plan. Town of Lansing can update Flood Damage Prevention Law and
participate in the Community Rating System. (CRS) pertains to the national flood insurance
program. Guy Krogh, Legal Counsel states flood plain laws deal with new construction to
protect downstream properties. He has not seen the emails mentioned by Joe but flood plain
laws do not regulate many activities. Supervisor Ed LaVigne stated that CJ Randall's first
priority is Solar, Town Board needs to share these letters with CJ and the subject should be
discussed with the Planning Board.

Planning Board notes that you have to be careful with the word toxic, there is solar
equipment that could pose a problem, there is agricultural practices that could be interpreted
as toxic as well as animal waste which can contain traces of heavy metals. A balance needs to
be figured out.

May 28, 2019 the Public Hearing Notice for the Triphammer Office Complex project was

APPROVED
Chair invited the Applicant, Andy Sciarabba and Architect George Breuhaus up to the table
for discussion.

Summary of the discussion:
- Proposed Commercial Building for mixed use; doctors, accountant ...
- Discussed possible ways to reduce the land disturbance
o Reducing some of the parking spots
o Sharing the Dumpster with the Applicant's commercial business next door
o The trees scheduled to be removed will be cut down, but will leave the stumps
o Moving building closer to the property border by the ATM machines will
reduce the number of trees to be removed
o Contractor employees can park next door by the ATM reducing ground
disturbance
o Driveway on the North side of N. Triphammer parcel is grown over and large
boulders will be placed to deter traffic use, like the adjacent property
- Other items discussed
o 12,000 sq. ft. building with up to six tenants. Interior will be designed as tenants
sign leases
o Site Plan Review requires Dark Sky Compliant Lighting outside with a
maximum of 3,200 Kelvin but as close to 2,700 Kelvin as possible and still
provide safety
o Curb cut will stay on Franklyn Drive for access to maintain the lawn
o Stormwater Drainage should be considered in this site plan
o Lit sign will be located by entrance to the parking lot with a timer to turn off.
The sign will comply with Lansing Sign Law
o Applicant has explored energy options, most were too expensive to go with
■ Heat pumps will not keep up with temperatures below 2 degrees and
would require a secondary backup system
■ Geothermal is too expensive and would create more ground disturbance
■ Applicant decided to use roof top units with economizers for heat and
air-conditioning, which will give the flexibility needed for the final
buildout for each tenant. Burners on the units are 78 to 80 % efficient.
The units will also bring in fresh air through the roof top units as needed
which heat pumps are not able to supply
■ Insulation Foam on interior side of the exterior walls to prevent drafts
■ R49 insulation in the trusses
■ Applicant feels by adding new businesses in Lansing it will cut down on
mileage for the local residence
o Building Codes today will also make the building energy efficient with all the
new regulations
APPROVED
o Trees on the land immediately by the Franklyn driveway area will not be taken
down
o Four light poles in the parking lot (Dark Sky Compliant)
o Foundation of the new building will be elevated above the grade of
Triphammer Rd
o Possibly sharing the adjacent properties Dumpsters, same owner for both
properties. Applicant will need to provide sidewalk or stepping stones for
tenant access
- Items to show on Final Site Plan
o Dumpster location with access path to get to it
o Show what types of trees that will be planted by the roadside
o Location and access for propane tank
o Reduction of parking area
o Move septic closer to the building could reduce disturbance even more
o The updated site plan should reflect the current date

If the parking lot size is reduced, the applicant may have to apply for a variance with the
ZBA.
The code officer, Lynn Day asked what happens five years down the road and Applicant
decides to develop the Franklyn Drive portion that is currently vacant causing more land
disturbance. The developer may have to account for this project and the new project and go
through the full SWPPP process. There is no cut off; even if it is 10 years down the road, they

will still have to go through the process if they develop the rest of the property. At this time,
a simple bio-retention would be acceptable.

If the board makes a determination that, they need 200 sq. ft. of parking than they need 60
parking spaces not 48.

Possibly share with the parking from the adjacent building if the parking is considered in
excess of what their needs are. Parking utilization is approximately 50 % on the adjacent
property.
