Chairperson Tom Ellis called the Planning Board Meeting to order at 6:32 PM. Chairperson Tom Ellis Enacted Dean Shea as a voting member tonight due to absences. MOTION TO APPROVE THE PLANNING BOARD MINUTES FOR MARCH 12, 2018 MEETING Larry Sharpsteen made a motion to APPROVE THE MARCH 12, 2018 minutes with amendments. Sandy Dennis Conlon seconded the motion. All in Favor - 6 All Opposed - 0 11Page APPROVED CONTINUED PUBLIC HEARING FOR CONSIDERATION OF AN APPLICATION MADE BY LANSING ROD & GUN FOR SITE PLAN APPROVAL TO RELOCATE TRAP FIELD/SHOOTING RANGE - 55 SALMON CREEK ROAD - TAX PARCEL #26.-7-1 IN THE (RA) RUAL AGRICULTURAL ZONE Chairperson Tom Ellis re-opened the floor for more public comments that have not been brought up last meeting. • Question on the Letter from the EPA-Will be discussed later in the meeting • Ruzicka located at 101 Salmon Creek Road is concerned about possible liability for any contamination that might leach down onto her property and any assessment of noise levels. o The Gun Club will have to establish periodic soil testing • Another Resident referenced the EPA Letter asking for detail about the how the flooding affected the original plan to put up Shot Curtains and why it is no longer viable. Larry Sharpsteen made a motion to CLOSE THE PUBLIC HEARING at 7:46 pm. Jerry Caward seconded the motion. All in Favor - 6 All Opposed - 0 Summary of the Planning Board Discussion: • How can the remediation be completed in the area where the trees are proposed to be cleared? o The stumps will cause issues with soil cleaning. (The top two feet of earth is cleaned). o Should the Shots even be allowed to reach that area? • Need an explanation on how close remediation can be to the wetland area. o DEC and the State might have different opinions? o Need more information of the required buffer area. • We need ballistics charts that tell us exactly what the range of those trap loads will be and definitively what the farthest reach is. What the height they are shooting the clay pigeons and the trajectory path. • There are 7/8 to 1 -1/8 ounces in a trap shot shell. • The Lansing Planning Board is officially Lead Agency. We have concurrence with the DEC, EPA and the Town of Lansing Town Board. • The area is located within the 100 year flood plan. o The board will need more information. • The board would like to see a quote for the lead remediation of the existing range and for the new location. • It is in the best interest of the neighboring residence to keep the club open. If they close,it will immediately be considered a toxic waste site. Once it is deemed toxic,residence within a 1/2 2 1 P a g e APPROVED mile might have a problem getting a second mortgage or selling as it will have to be disclosed to the banks and or buyer. • Guy Krogh's clarification of the acronyms in the EPA letter. CWA-Clean Water Act;RCRA- Resource Conservation and Recovery Act; CERCLA-Comprehensive Environmental Response Compensation,and Liability Act;TCRA-Toxic Control Recovery Act;TSCA-Toxic Substance Control Act. o They all work in different ways. o The Town of Lansing Planning Board does not have the authority to enforce an environmental cleanup that would be enforced by State Authority. o There are all sorts of strange overlaps but the main thing to understand here is that the EPA is only here on a limited slice of enforcement that they look at under RCRA. o Where DEC comes in on this and what they have to say about various things that come into play under SEQRA is something we are about to learn. o An Environmental Engineer may need to be hired at the cost of The Rod&Gun Club. o The SEQRA will probably be a positive declaration (moderate to potential large impact) in which case it will possibly trigger an EIS (Environmental Impact Statement). o The Planning Board would like to meet directly with the club and see if they can guide them through the process and encourage them to take the steps necessary to move forward in the best direction. The process is a complicated one. o The Planning Board is the Permitting Agency. The DEC is an involved Agency but we still do not know the extent of their process. o Repositioning the existing range and adding the Shot Curtains would be more desirable all around and less expensive in the end. The consideration for the Lansing Rod &Gun is postponed until all the requested information from the last meeting is in hand. Keep an eye on the Planning Board Agendas, posted online or call the code office. It could be next month or several months away, but it will be listed on the Agenda when we discuss Lansing Rod &Gun. REVIEW OF THE 7th REVISION OF THE ALTERNATIVE, SOLAR AND WIND ENERGY SYSTEMS AND FACILITIES LAW Notes on changes: 1. I looked up micro hydro and it is over 5kW to 100kW, whereas Pico hydro is under 5kW, so I went with Pico hydro for our use. 2. I added definition for hydroelectric 3. I added the primary purpose of sale of electricity to both large-scale wind and large scale solar definitions 3 1 P a g e APPROVED 4. I left solar thermal definition unchanged as it makes sense as written. 5. Section 4C was changed to reference sections 9 & 10 6. In section 5 II B 11 eliminated "the code required power serving a building or tied into" 7. Section 7 T last sentence "made is such" changed to "made in such" 8. I added to Section 9 letter M for breakaway, telescoping or other types of towers reducing fall zones within a property to utilities, buildings or infrastructure 9. I added to Section 10 letter D 4 for breakaway, telescoping or other types of towers reducing fall zones within a property to utilities,buildings or infrastructure 10. Section 11 allows hydropower in all zones but restricts alternate systems other than hydro, wind or solar (ie methane generators, etc.) to zones IR& RA. 11. Section 12 changes to large lots and makes it a right to place a small-scale system anywhere on the property subject to 500' setback or fall zone requirements within the property. Version 8 will be posted on the Town Website under Planning Board Docs 4-9-2018 MIKE LONG REVIEWS PLANNING UPDATES • Cayuga Orchards Sign was reviewed by the ZBA on March 20, 2018. They approved the two-sided sign on North Triphammer Road. The sign on Liberty Lane would need to meet the sign law requirements. Cayuga Orchards Site Modification for the Sign will be on April 9, 2018 Planning Board Meeting. Chairman Tom Ellis closed the meeting at 8:25 PM. 4 1 P a g e
