MOTION TO APPROVE THE PLANNING BOARD MINUTES FOR TUNE 25, 2018 MEETING Larry Sharpsteen made a motion TO APPROVE THE JUNE 25, 2018 MINUTES. Jerry Caward seconded the motion. All in Favor - 7 Opposed - 0 FLOOR OPEN FOR COMMENTS/CONCERNS OTHER THAN WHAT IS ON THE AGENDA No Public Comments CONSIDERATION OF A SITE PLAN FROM NYSEG FOR A PROPOSED PUBLIC UTILITY MONOPOLE TOWER ON 10 TOWN BARN ROAD, TAX PARCEL #30.4- 16.11. TO INSTALL A 100' MONOPOLE TOWER AND ANTENNAS WITHIN A +/- 720 FT2 (18' X 40') TOWER BASE AREA INCLUDING A +/-60 FT2 (6' X 10') Page 1 of 7 APPROVED EQUIPMENT SHELTER. ACCESS VIA +/-350' ACCESS ROAD/UTILITY EASEMENT FROM TOWN BARN ROAD. A public hearing was published on June 26, 2018 in the Ithaca Journal. The 600' parcel notices were mailed on June 26, 2018 along with posting the notice and documents on the Town of Lansing Website. The Town of Lansing has reviewed the site plan, location and fall zone and has decided this project would be an exempt land use. The environmental assessment forms part 2 and 3 will still need to be reviewed. The project is considered an unlisted action. Josh Silver from The Murray Law Firm is here representing NYSEG. Mike Long, Town of Lansing Planner has been working with them for over a year. The initial plan was to put the pole right at the substation. The Planning Board recommendation was to look for alternate sites. They worked together and spent a lot of time looking for alternative sites. The Town Barn Road was a perfect location. The Town Barn property is already disturbed (Highway Department site) and would be the lowest impact location they could find. NYSEG is creating an energy smart grid with cutting edge technology that will track the flow of energy. The Town of Lansing may decide to use the County of Monroe's Balancing Test. Guy Krogh the Town Attorney described, certain actions undertaken by a government under the government purpose standards, are exempt from internal review. It is on Town Land therefore it is already under governmental review. It is for a state purpose and it is a communication tower. The purpose is for public utilities. Every factor in the Monroe Balancing Test has weighed in favor of this being exempt from zoning review. However, Krogh added, I do not make the determination the Planning Board does after reviewing the SEQRA. The Environmental Assessment Mapper shows the area of the project is outside of the wetland area. The Planning Board reviewed the Environmental Impact Assessment Form Part 2 and 3. The proposed action will not result in any significant adverse environmental impacts. MOTION FINDING A NEGATIVE DECLARATION ON THE NYSEG CELL TOWER TO BE LOCATED AT 10 TOWN BARN ROAD Deborah Trumbull made a motion FINDING A NEGATIVE DECLARATION ON THE NYSEG CELL TOWER. Larry Sharpsteen seconded the motion. All in Favor - 7 Opposed - 0 Page 2 of 7 APPROVED At this time, the Board is waiving the Public Hearing portion of the meeting as the project meets all the guidelines of the County of Monroe's Balancing Test for governmental purpose standards. MOTION TO GRANT IMMUNITY FROM ZONING REVIEW AND GRANT/APPROVE A SITE PLAN INSPECTION PERMIT PURSUANT TO THE LEASE AND THEN EXTEND THE UTILITIES AS NEEDED Deborah Trumbull made a motion to GRANT IMMUNITY FROM ZONING REVIEW AND GRANT/APPROVE A SITE PLAN INSPECTION PERMIT PURSUANT TO THE LEASE AND THEN EXTEND THE UTILITIES AS NEEDED. Al Fiorille seconded the motion. All in Favor - 7 Opposed - 0 DEVELOPERS DISCUSSION WITH CAYUGA VISTA APARTMENTS - PROPOSING TWO APARTMENT BUILDINGS WITH A TOTAL OF 16 UNITS TO BE LOCATED BETWEEN JUMP AROUND INFLATEABLES AND IMR TESTING. ON THE CORNER OF WOODSEDGE DRIVE AND CAYUGA VISTA DRIVE,TAX PARCELS # 37.1-2-53.27, 37.1-2-53.28, 37.1-2-53.29 Gary Bush the applicants engineer handed out updated drawings dated 7/9/2018 that will be posted on the website tomorrow. Summary of Discussion: • The three parcels would have to be purchased by the applicant and joined together into one parcel. • Unlike what the Ithaca Voice asserted,the narrow lines on the green space are not solar panels,they represent the septic system/leach field areas. o The darker lines are where the septic system would be located and the lighter lines are where the replacement septic systems would be located if needed. • The retention pond is located in the upper left side of the ST1 drawing. • The complex provides a"U" shaped drive through. • There is enough outside parking for two vehicles per unit. • The two buildings will house 16 units (8 per building). • Handicap Access to each of the buildings. • Every unit will provide washer/dryer hook ups. • Mini Garages are 10' X 12' and meant more for added storage instead of parking a car. • 2-hour fire separation between dwellings. • The single story Handicap Accessible Apartments will have larger garages capable of storing a Handicap vehicle inside. • The Board requested landscaping between buildings and the street. • The Board requested a possible trail that would lead over to the ball fields and the playground. It should be added to the drawings. Page 3 of 7 APPROVED o There would need to be a joint effort, as Woodsedge Apartment is in the middle. • The plan will have evergreens to buffer on the lower side. • Propane tanks in one or two central locations that would be metered for heating the radiant floors. • They had looked into the Heat Pumps but decided it was not the best option for them. Scott would like to be able to fix anything in the units. The heat pump technology is changing so fast and he was skeptical about finding parts in 5 or more years if needed. • Ceiling fans in every room. Most of the tenants will not even put in an air conditioner based on his experience in other rentals units. • An electric hot water tank in each unit. • The residents would have two options for trash removal. They could have free service if they haul their own trash and recycling over to the SDM's no sort facility on Peruville road or they could hire a hauler and purchase disposal tags. • They manage and maintain the properties and do not allow excess items outside of the units. • The parking area will be asphalt with enough room for a large truck to drive around the horseshoe. o The board will have Scott Purcell,Town of Lansing Fire Chief to review the drawings for appropriate fire access. • Proposed Rental Rates are: o One Bedroom$1,350 per month with a larger garage o Two Bedroom$1,450 per month with mini garage o Three Bedroom would be a few hundred more than the two bedroom • The heat and electric cost is expected to average around$110 per month • The newer units he owns seem to be averaging around$400 to$600 a year to heat with propane. Which shows the added benefit of the energy building codes. • Exterior will be Vinyl Siding in a grey or tan tone with Asphalt Shingles. • Instead of Mailboxes,there will be a Cluster Box with a locked box for each unit. • The applicant is in the process of getting septic approval. • Parking lot lighting will be dark sky compliant with LED lights. • There will be canned LED lighting the porch entryways. • A sign will be added to the site plan and might be illuminated. • Normal age demographics seem to be upper 20's to upper 30's with very few kids. o Usually when the family grows in size,they move to a house or leave due to a job transfer. • The Owner does not try to market for any type of person. They try to choose the right tenant that works best with the neighboring tenants. • No bus shelter as there are very few if any school age kids and the closest TCAT bus stop is in front of the Town Hall. Page 4 of 7 APPROVED • Storm Water review is critical. • Septic approval from the Health Department is critical. • Bolton Point will only give one meter per parcel. o The Owner will pay the water bill. • Each unit will have its own water shut offs. • The buildings will be built as slab on grade,with radiant heat up and downstairs. • Electric appliances. • The goal is to start the project November of 2018 at the latest. DISCUSSION ON THE PROCESS FOR UPDATING THE LAND USE ORDINANCE Summary of Discussion: • There are three to four location where the owners are frustrated that the zoning has not been updated. They have been waiting for at least two years or more for the changes to be made so they can proceed with positive changes to their properties that are in line with the Town of Lansing's Comprehensive Plan. • When the IR Zone was created,it included other forms of small business and residential uses. Over time, the description of the zone has changed. • The consensus amongst the Board Members is to re-zone for the three location to reduce hardship on the property owners. To complete the zoning update for the whole town,before considering these specific locations,could take more than two to four years to complete. Thus making their hardship even more burdensome. • The Town Planner and Attorney will draft a recommendation to the Town Board that will be reviewed and possibly approved on July 23,2018. If the Planning Board moves the process over to the Town Board,they will review and hold a public hearing as part of their process. • A small group (Lynn Day, Code Officer;Joseph Wetmore&Doug Dake,Town Board Members;Tom Ellis,Planning Board Chair;Michael Long,Town Planner)will get together and work on the definitions within the Land Use Ordinance. They will create a draft with a track of the changes,to present to the Planning Board. The meetings will be open to the public. Meeting times have not been set up at this time. • It was mentioned,that a projector with slides of what the Planning Board is reviewing on the Land Use Ordinance would be nice for audience attending the meeting. Mike will look into preparing the projector slides.
