The Town has new microphones, so we will see 38 tonight how it goes. Ed hopes that the public can hear the discussion better than in the past. 39 Training for the Board Members will be scheduled when it is appropriate for all three Boards 40 to meet. CJ Randall and Ed LaVigne are working on the timing. Tonight and June 10, 2019, 41 the Planning Board will have a working session from 5:30 to 6:30 after that, the regular 42 agenda items will begin. Reminder of"the Rules of the Privilege of the Floor", Ed kindly asks 43 that if people want to have a conversation to please take it out to the hallway. These are all Page 1 of 10 APPROVED 44 teachable moments and as we go forward, there will be a better understanding. Copies of the 45 current Land Use Ordinance (LUO) are online for public access. When the Planning Board 46 has a final draft ready for public review it will be posted online and a Public Hearing will be 47 set for public input to be given. There will be a public hearing at the Planning Board level 48 prior to recommending LUO to the Town Board. Location: 59 Emmons Road, Tax Parcel No. 23.-1- 59 6.32. Project Description: The Applicant proposes a Bed and Breakfast Facility and Banquet 60 Hall/Reception Venue. The property is in the Rural Agricultural (RA) Zoning District. This is 61 an unlisted action under the State Environmental Quality Review Act. 62 63 The Planning Board has reviewed the letters sent to the Board. The Board Response; 64 - The board feels that they will mitigate concerns as much as legally possible 65 - Any trees or buffers will be replaced in a timely manner if they die or are diseased 66 - If a plant species fails to thrive on the property the owner can replace with a hardier 67 species 68 - Code Officer agreed to oversee the final choices of buffer plantings 69 - The board would like to see engineered applications of materials added inside the 70 barn to absorb some of the amplified music 71 - The board is pleased with the 12' high Parking Lot Dark Sky Lighting 72 - The board requests the parking lights be turned off after the event is over either by 73 timer or manually 74 - Applicants agree to stop amplified music on non- school nights at 11 p.m. with clean 75 up until midnight. The board reviewed Resolution 19-16. 79 80 RESOLUTION PB 19-16 81 82 STATE ENVIRONMENTAL QUALITY REVIEW RESOLUTION MAKING NEGATIVE 83 DECLARATION OF ENVIRONMENTAL IMPACT FOR 84 OSMICA-SPRING TRAIL FARM, LLC AT 59 EMMONS ROAD 85 86 WHEREAS,an Application was submitted by Kurt Martin of OSMICA,LLC also of Spring Trail Farm, 87 LLC for site plan approval for the proposed construction of site improvements at an existing residential 88 and barns buildings located at 59 Emmons Road, Lansing, New York, also known as TPN 23.-1-6.32, 89 located in the RA - Rural Agriculture Zone and consisting of approximately 19.01± acres, and such Page 2 of 10 APPROVED 90 proposal more specifically will use the existing house as a Bed and Breakfast and convert the existing 91 barn to an Banquet Hall/Reception Venue with additional parking area; and 92 93 WHEREAS,this proposed action is an Unlisted Action for which the Town of Lansing Planning Board 94 is the sole involved agency for the purposes of a State Environmental Quality Review Act ("SEQRA") 95 review, and the Planning Board undertook as Lead Agency an uncoordinated review of the Full 96 Environmental Assessment Form ("FEAF") Part 1 and Short Environmental Assessment Forms 97 ("SEAF") Parts 2 and 3 under SEQRA; and 98 99 WHEREAS, the requisite General Municipal Law § 239 referrals were duly made, and the reply and 100 recommendations of Tompkins County Department of Planning & Sustainability are reflected in their 101 letter dated January 2, 2019,none of which concerns affect this environmental review, and the Planning 102 Board further finds that the existing agricultural and farm operations will not be impacted by the project 103 because the crop fields are planned to continue to be utilized and it is within an RA—Rural Agriculture 104 Zone; and 105 106 WHEREAS,a stormwater review considered the additional impacts of the total new impervious surface 107 being installed (30,042 sf for new parking, driveway widening, and walks, and a total of 8,464 sf of 108 additional area will be disturbed and regraded/seeded as a result of installing the septic system, utility 109 entrances, and drainage swale from the new parking area)which amounts to a total disturbance of 38,506 110 sf, or .88 acres., which is below the threshold for review under the Town's Stormwater Local Law; and 111 112 WHEREAS, on April 8, 2019 and May 13, 2019, the Town of Lansing Planning Board, in performing 113 its reviewing agency functions in conducting an environmental review in accordance with Article 8 of 114 the New York State Environmental Conservation Law and SEQRA regulations: (i)pursued its thorough 115 review of the project and the Applicant's FEAF Part 1, as well as a review of all other documents 116 prepared and submitted with respect to this proposed action; and (ii) thoroughly analyzed the potential 117 relevant areas of environmental concern of the project to determine if the proposed action may have any 118 moderate or significant adverse impacts on the environment, including the criteria identified in 6 119 NYCRR § 617.7(c); and (iii) reviewed the FEAF Part 1 and SEAF Parts 2 and 3 on the record; and 120 121 WHEREAS, each identified potential environmental impact was analyzed and duly considered by the 122 Planning Board in relation to the question of whether any potential environmental impacts were so 123 probable of occurring or so significant as to require a positive declaration, and after weighing the above 124 and all other potential impacts arising from or in connection with this project, and after also considering: 125 (i) the probability of each potential impact occurring; (ii) the duration of each potential impact; (iii) the 126 irreversibility of each potential impact, including permanently lost resources of value; (iv)whether each 127 potential impact can or will be controlled or mitigated by permitting or other processes; (v) the regional 128 consequence of the potential impacts; (vi) the potential for each impact to be or become inconsistent 129 with the Town's Comprehensive Plan and local needs and goals; and(vii)whether any known objections 130 to the Project relate to any of the identified potential impacts,the Planning Board found that these factors 131 did not cause any potential impact to be or be likely to become a moderate or significant impact such 132 that a negative declaration will be issued. 133 134 NOW, THEREFORE,BE IT RESOLVED AS FOLLOWS: 135 136 1. After consideration of the potential environmental impacts, including those reviewed in accord 137 with 6 NYCRR § 617.7(c),the Planning Board finds that the proposed action of approving the proposed 138 commercial site plan and its minor improvements, based upon the site plan as submitted, will Page 3 of 10 APPROVED 139 individually and cumulatively have no moderate or significant negative environmental consequences or 140 impacts. 141 142 2. This declaration is made in accord with Article 8 of the New York State Environmental 143 Conservation Law and SEQRA regulations promulgated thereunder, and accordingly, the Planning 144 Board of the Town of Lansing, based upon: (i) its thorough review of the SEAF, and any and all other 145 documents prepared and submitted with respect to this proposed action and its environmental review; 146 (ii) its thorough review of the potential relevant areas of environmental concern to determine if the 147 proposed action may have any moderate or significant adverse impact on the environment, including, 148 but not limited to, the criteria identified in 6 NYCRR § 617.7(c); and (iii) its completion of the SEAF, 149 including the findings noted therein(if any, and which findings are incorporated herein as if set forth at 150 length),hereby makes a negative determination of environmental significance("Negative Declaration") 151 in accordance with SEQRA for the above referenced proposed actions, and determines that an 152 Environmental Impact Statement is therefore not required. 153 154 3. Davidson—Aye 166 Al Fiorille—Aye 167 Larry Sharpsteen—Aye 168 Dean Shea - Aye 169 Deborah Trumbull-Aye MGerald Caward,Jr.— Aye 173 Received and filed in the Lansing Town Clerk's Office 174 175 RESOLUTION PB 19-17 176 177 RESOLUTION APPROVING AND ISSUING FINAL SITE PLAN APPROVAL FOR 178 "OSMICA— SPRING TRAIL FARM, LLC - 59 EMMONS ROAD 179 180 WHEREAS,an Application was submitted by Kurt Martin of OSMICA,LLC also of Spring Trail Farm, 181 LLC for site plan approval for the proposed construction of site improvements at an existing residential 182 and barns buildings located at 59 Emmons Road, Lansing, New York, also known as TPN 23.-1-6.32, 183 located in the RA — Rural Agriculture Zone and consisting of approximately 19.01± acres, and such 184 proposal more specifically will use the existing house as a Bed and Breakfast and convert the existing 185 barn to an Banquet Hall/Reception Venue with additional parking area; and 186 187 WHEREAS,the Planning Board did hold a Public Hearing on this proposed action on January 28,2019, 188 February 25, 2019, March 11, 2019, and March 25, 2019 to receive comments and input from the 189 neighbors and residents and held the public hearing open to accept additional comments; and 190 Page 4 of 10 APPROVED 191 WHEREAS, this proposed action is an Unlisted Action for which the Town of Lansing Planning Board 192 duly issued a Negative Declaration of environmental impacts under SEQRA on May 13, 2019; and 193 194 WHEREAS, a General Municipal Law § 239 referral was delivered to, and a review dated January 2, 195 2019 was received from the Tompkins County Department of Planning & Sustainability, which 196 officially commented that "No Negative inter-community or county-wide impacts" will result for 197 this proposed project; and 198 199 WHEREAS,a stormwater review considered the additional impacts of the total new impervious surface 200 being installed (30,042 sf for new parking, driveway widening, and walks, and a total of 8,464 sf of 201 additional area will be disturbed and regraded/seeded as a result of installing the septic system, utility 202 entrances, and drainage swale from the new parking area)which amounts to a total disturbance of 38,506 203 sf, or .88 acres.,which is below the threshold for review under the Town's Stormwater Local Law; and 204 205 WHEREAS, the Planning Board has again considered and carefully reviewed the requirements of the 206 Land Use Ordinance relative to site plan review, the unique needs of the Town due to the topography, 207 the soil types and distribution, and other natural and man-made features upon and surrounding the area 208 of the proposed site plan, and the Planning Board has also considered the zoning in the area and the 209 project in light of the Town's Comprehensive Plan and compliance therewith, and the Planning Board 210 has again reviewed and considered the aforementioned amended site plan application and determined 211 the fact that no new stormwater controls or permanent practices are triggered, as no SEQRA or 239 212 impacts were found, as the use is a permitted as of right use within the Zone, and as the site plan utilizes 213 an already existing site; and 214 215 WHEREAS, on April 8, 2019 and April 22, 2019 the Planning Board duly considered the proposed 216 site plan in accordance with the provisions of LUO § 701.4 et seq., including concerns addressing site 217 drainage, lighting, nearby residences, landscaping,parking, buffering, screening, driveways, and any 218 potential on and off site environmental impacts, and upon due consideration thereupon and deliberation 219 by the Town of Lansing Planning Board, now therefore be it 220 221 RESOLVED, that the OSMICA — Spring Trail Farm, LLC site plan application for the proposed site 222 plan and landscape improvements located at 59 Emmons Road, Lansing, New York, be and hereby is 223 granted and approved for a period of 36 months from the date of this resolution, subject to the following 224 conditions: 225 1. In accord with LUO § 701.10, this site plan approval is valid for only 36 months from the date 226 hereof, and the applicant/owner is required commence and substantially complete the construction or 227 other activities for which the site plan is applicable within said 36 months or this approval shall,unless 228 extended upon application timely made, expire, lapse, and be of no further validity, force or effect. 229 230 2. Site plan approvals shall include the application materials, as depicted in"Osmica at Spring Trail 231 Farm" Site Plans A & B, version 1.8, both dated 04/29/2019 which documents the proposed ground 232 disturbance, temporary tents, septic fields, parking lot, walkways and drainage, solar panels by and 233 sketches and illustrations as submitted. All lighting fixtures will be "dark sky compliant." Light poles 234 installed in the parking lot will be no taller than 12 feet. The parking lot light lamps will be in 3,000 235 degree Kelvin or less. 236 237 3. Applicant and site users will continue to utilize the existing driveway entrances from Emmons 238 Road and create an additional new 72 car parking lot and currently has an additional 11 parking spaces 239 of which 4 accessible parking spaces, 3 garage parking stalls and accessible walkways. 240 Page 5of10 APPROVED 241 4. Building Permits will be required to construct the approved building improvements and such 242 plans must meet all applicable State of New York code requirements, including the sealing of plans by 243 a licensed engineer or architect,and be constructed in compliance with all building code requirements. 244 The Code Enforcement Officer will determine the building occupancies when the final building plans 245 are reviewed according to the current regulations. 246 247 5. The applicant will be required to obtain Bolton Point water permit for a new water service and 248 meter to connect to the existing Consolidated Water District Mains, as well as Tompkins County 249 Health Department On-site Wastewater System permit, both as pre-conditions to obtaining any 250 building permit and a Certificate of Occupancy("CO"). 251 252 6. Town of Lansing Highway Work Permit will be required for the proposed driveway to the 253 parking lot area. This will be in compliance with the Town of Lansing Highway design specifications 254 and approved by the Highway Department. There shall be no on-street parking permitted along 255 Emmons Road. 256 257 7. No fireworks shall be allowed unless 5-days' advance notice of such event is provided to the 258 Town. In addition, the applicant has agreed to send notification to neighbors who have provided the 259 town with contact information and have been asked to be notified by e-mail at least 15 days in advance 260 of a fireworks event. All displays and events shall comply with the most current New York State rules 261 for fireworks displays, and each event shall require a permit from the Town as provided for by law, 262 including but not limited to the requirements of Penal Law § 405.00, et seq., the regulations of the 263 State of New York, including but not limited to 12 NYCRR Part 61, and NFPA 1123 and 1126, each 264 as now written or hereafter amended or recodified. 265 266 8. The owner will reside in the Bed and Breakfast whenever it is being used in that capacity 267 according to the current Bed and Breakfast Land Use Ordinance definition. 268 269 9. All existing vegetative buffers (including as shown on the updated site plans described above) 270 shall be maintained as healthy and natural non-invasive vegetation designed to provide both visual and 271 sound buffering.Existing and any new vegetation shall be properly maintained and any dead,diseased, 272 or dying trees or plants shall be promptly replaced, and any tree or plants that, whether singularly or 273 in combination, due to lack of growth, death, recession, disease or other cause, cease to function as 274 buffers shall be replaced in a manner as promotes the goal of such buffer as stated in this site plan 275 approval. This condition shall be deemed to augment and further define prior site plan approval 276 conditions and site plan features hereby or heretofore approved by the Town. 277 278 10. The applicant agrees to end amplified music at 11 pm. 279 280 11. The applicant must be issued a Sign Permit in compliance with the Town's Sign Local Law (#1 281 of 2014)in order to erect,install,build,place,emplace, site,or substantially rebuild or repair any Sign. 282 283 12. Shouldn't we place that 391 restriction on the other properties along the cliff line 392 - Improvements are only allowed inside the dotted lines of each parcel 393 - Concerns with the lots that are on the properties along the cliff line Lots 11 & 16 394 - The Stormwater ponds will be designated into a Drainage District 395 - Drainage Districts will be set up after the Final Plat Approval and conveyed to the 396 Town who would then maintain the stormwater ponds and drainage into the ponds 397 398 Motion to grant a waiver for the Preliminary Plat for Lake Forest Circle 399 Motioned by: Lin Davidson Seconded by: Larry Sharpsteen (Motion Carried) 400 401 Planner Update 402 - The Town Board created a Conservation Advisory Council (CAC) in January 2019. The 403 Town Board may accept applications and appoint members or perhaps just appoint 404 them from a list of people proposed by Joe Wetmore. The CAC is essentially 405 responsible for preparing open space index for the Town and natural resources 406 inventory that can be of some use to the Planning Board; they can be helpful during 407 environmental quality reviews; could be put in charge with monitoring the Towns 408 Conservation Easements (Purchasing Development Rights); they can work on 409 Blueway Trails. 410 - Blueway Trail signs should be installed in Myers Park in the next month or so once the 411 Town Board approved the agreement with County Planning, which we are receiving 412 some final details of what the signs will look like. 413 - There is an emphasis on the NYSERDA Clean Energy Action Plan for the area and the 414 NYSEG Moratorium. NYSERDA are very interested in trying to help us help with the 415 power plant. There is a lot of interesting conversations happening right now. 416 - CJ attended the Symposium on Energy last month 417 - Incremental Development Alliance Group 418 - Lansing Energy issues group.
