REGULAR TOWN BOARD MEETING
October 17, 2018
A Regular Meeting of the Lansing Town Board was held at the Town Hall Board Room,
29 Auburn Road, Lansing, NY on the above date at 6:29 p.m. The meeting was called to
order by the Supervisor, Edward LaVigne, and opened with the Pledge of Allegiance to
the flag. Roll call by Deborah K. Munson, Town Clerk, showed the following to be

Patrick Jordan, handed out the following Town of Lansing draft documents to the Town

Independent Auditor’s Report
Mr. Jordan, reviewed the draft Overview of 2017 Audit and stated: “Unmodified opinion
on the Town of Lansing’s basic financial statements for the year ended December 31,
2017”. He noted, “unmodified opinion” is the opinion you want to have.
Mr. Jordan, reported there was a separate report for the Justice Courts. He stated: “The
results of tests indicate, for the transactions tested, the Justice Courts complied with the
terms and conditions of the requirements”.
Mr. Jordan, stated the Town adopted the GASB (Government Auditing Standard Board)
34, 68 and 75. He noted, GASB sets all the reporting guidelines.
Supervisor, Edward LaVigne, requested the Town Board e-mail Mr. Jordan and copy
everyone on the Town Board and the Town Bookkeeper, Charmagne Rumgay, with any
questions they may have, prior to the next Town Board meeting.
LANSING COMMUNITY LIBRARY REPORT – CHRISTINE EISENHUT

November 2-3.
5. Our Broken Immigration System and How to Fix It – November 14th at 7:00pm
Stephen Yale-Loeher professor of immigration law practice at Cornell Law School

6. After School Fiber Arts Program – for Middle School students begins 11/27 and
the following three Tuesdays from 2:45-4:30pm.
7. On Display September and October – the artwork of Peg Connelly – Masks!
Ongoing programs at the library:
a. T’ai Chi – Tuesdays 11:30 – 12:30 and Thursdays 2:30-3:30
b. Story Time – Tuesdays 1pm, Thursdays 10am. Letter Bird is Miss Katie’s new
helper!

After a great summer of programing including “Lake Life”, Primitives 101, Get
Lost, Iron Chef, Funky Furniture, DIY, Backpacking, and Sky’s the Limit, fall
programs are in full swing.
Fall programs include Photo Fanatics, Outdoor Adventures, Salmon Creekers,
Loose Threads and Tied Ends.
Youth Employment program is ramping up for the school year. Besides the usual
sites (Rec. Dept., Library, Youth Services, etc.) there are some new work sites for
the school year that include the Athletic Dept., Drama Dept., and English
Language Arts.
The Youth Commission is working on a parent survey to be distributed in early
2019.
The Youth Commission is considering participating in the Tompkins County
Youth Services Department’s “Pitch Contest” in early 2019.
The County Administrator has recommended a 2% increase in County Youth
Service Funds for 2019, $358.00 for the Town of Lansing.

Hello and thank you for having me again and for your time.
Governor Andrew Cuomo was at the airport yesterday for a ribbon cutting. Construction
has begun on the $24.7 million expansion of the Ithaca Tompkins Regional Airport. The

project, set to be complete in late 2019, will expand the terminal by nearly 50 percent,
including the addition of a new U.S. Customs and Border Protection building that will
transform the airport into Ithaca Tompkins International Airport.
The Legislature, by unanimous vote adopted amendments to the County Administrator’s
2019 Recommended Budget and the Capital Program for the next five years. The
amended budget increases the County tax levy 1.54%, which compares to 1.43% in the
Administrator’s budget and is lower than the Legislature’s 2.2% levy goal for 2019. The
recommended county-wide average tax rate of $6.40 per thousand, 18 cents less than
2018, is a decrease of 2.64%, representing an increase of $13.90 in the tax bill for the
median-valued $185,000 home. The amended Tentative Budget also contains a $3
increase in the County’s annual Solid Waste Fee, to $58. Tompkins County’s State
calculated 2019 Tax Cap is just under 5%.
Also in the budget, Legislator Dan Klein put forward an amendment that passed
increasing the sales tax projection by $150,000. Mr. Klein said, “Our sales taxes are
booming, our casino revenues are above budget, and the County’s fund balance stands at
$37 million…Our budget is in great shape because of the conservative decisions we’ve
made over the years…This is giving a little bit back.” County Administrator Jason
Molino advised that the change in projection would be at a margin of risk, but that, all in
all, he believes it safe.
And parks! We continued to debate my $23,000 request for one-time funding for Town
and Village parks. In the end, we approved by a 13-1 margin a revised proposal from me
for $50,000 in one-time funding for a Park Fund to be administered by the Department of
Planning and Sustainability. Each Town and Village in Tompkins County can apply for a
grant of up to $5,000 from the fund for infrastructure planning/improvements to its
publicly managed or supported parks.
The 2019 Recommended Budget, along with amendments to date and other budget-related
information, is posted at the budget page of the County web site at
www.TompkinsCountyNY.gov/ctyadmin/2019budget.
Also at last night’s meeting, we authorized bonding, if needed to support the local share
of the $24.7 million terminal expansion project at Ithaca Tompkins Regional Airport.
The action authorizes the issuance of up to $10 million in serial bonds and notes, as
needed, for underwriting the expense not funded through the $14.4 million New York
State grant awarded through the State’s Upstate Airport Revitalization Program.
We unanimously approved the appointment of Schelley Michell-Nunn to the Tompkins
Cortland Community College Board of Trustees, filling the unexpired term of Chad
Coates.
We also authorized Tompkins County to enter into an intermunicipal agreement to form a
Local Development Corporation for the joint establishment of a Specialized Secure
Detention Facility to comply with “Raise the Age” laws, which increased the age of
criminal responsibility beginning this month.
Tompkins County is part of an 11-county coalition seeking to establish the Specialized
Secure Detention Facility for the greater Southern Tier. The intermunicipal agreement
involving the 11 counties is the first step toward creating the LDC, which will
recommend how to develop, establish, operate, maintain, and fund such a facility.
Earlier this month we voted to take the next step in accessing grant funds awarded to
Tompkins Consolidated Area Transit (TCAT) to acquire three electric transit buses and
related equipment. The County will be applying for $2.3 million under the Federal
Transit Administration’s competitive Low and No-emission Electric Transit Bus Program
for new electric buses.

PARKS AND RECREATION REPORT – PATRICK TYRRELL

RECREATION
Our current program offerings are Jump Around, Gymnastics, Basketball,
Bowling, Art, Skiing, Indoor Soccer, Volleyball, Adult Open Swim, Adult Cardio
Step, Adult Yoga Chi and Adult Strength and Stretch.
Fall Soccer has ended. Travel, club and school teams will still be practicing here
through the first week of Nov.
The Strong as Heck Soccer Tournament on Columbus Day was a huge success.
Both the varsity and youth cross-country races held at the Lansing Trails went
very well.
With the weather (rain) we are behind schedule on several projects we would like
to complete before the weather turns.
PARKS
We have completed the installation of the sunshade donated by Dr. Josie
McAllister with help from SDM Landscaping. It is located in the tot lot of the
playground.
Camping ended for the season on Columbus Day.
Pavilions are still being rented.
We will be turning the water off for the season sometime during the first week of
Nov.
HIGHWAY SUPERINTENDENT REPORT – CHARLIE “CRICKET” PURCELL
Cricket reported the following:
Consolidated Water District Extension #4 (CWDX4) - Drake Road

Restoration work still to be done
Under budget
Commended the highway workers for their work on this project
Shoulder work – completed
Supervisor, Edward LaVigne, thanked the highway workers for their hard work. He
noted, “Cricket” has crews working in several different areas.

ENGINEER’S REPORT – DAVE HERRICK
No report.
AGRICULTURE COMMITTEE REPORT – CONNIE WILCOX
No Agriculture Committee Meeting and no report.
PRIVILEGE OF THE FLOOR
Two residents spoke about the solar project on Jerry Smith Road. They are not against
the project, but their families live next door and they have the following concerns:
What about water run off control
What happens when solar panels break-where does the material go
Environmental impact on deer, etc.
They requested the Town Board approve a resolution for a moratorium on large scale
solar projects.
One resident spoke about re-zoning Kohlenberg’s property on the corner of Myers Road
and Ridge Road. They stated, the Planning Board recommended the zoning change to
correct a mistake that was previously made and wondered why it had not been approved
by the Town Board. They noted, the Town needs to take care of the residents.
One resident spoke about honoring two (2) Lansing veterans:
Stanley Burke – Korean War Veteran, Prisoner of War
Gus Isaac – WWII Decorated Veteran
One resident stated the Kohlenberg’s property can still exist as is (without a zoning
change); nothing has been taken away from the owner.
Patrick Tyrrell thanked Ted Laux for videotaping the meetings and providing Pat with the
videos to put on the website.
LANSING ROD AND GUN UPDATE (LR&G)
Supervisor, Edward LaVigne, stated there are two (2) separate issues:
EPA is working with LR&G on the environmental concern
The Town is dealing with the zoning issue
Town Counsel, Guy Krogh, reported the following:
Cleanup of lead
o Town of Lansing does not have authority to order cleanup of lead
o This is a federal issue
o The land owner agreed to make changes and comply with certain EPA
requirements
EPA has issued consent order
o Goal to end deposition of lead in wetlands and the creek
Application is different than what was submitted months ago
Supervisor, Edward LaVigne, stated Lynn Day’s presentation is for clarity on this
sensitive concern; this is not the Town’s normal procedure for issuing building permits.
Lynn Day, Zoning / Code / Fire Enforcement Officer, reported the following:
The Town is dealing with the zoning issue
o Based on the Land Use Ordinance
LR&G plan:
o Swap two (2) trap houses with two (2) rifle ranges
o Remove shooting pavilion and trap houses
o Build warming hut and two (2) new trap houses
o Shoot in the bank, reducing the footprint of the project
o Put trees in for buffer
Town Engineer has reviewed the Storm Water Erosion Plan

Reviewed Article X – Nonconforming Uses – and reported his responses
Building permit was issued today - with specific conditions:
o Allowed to:
Put fence up for storm water control
Put tree buffer in
Remove pavilion
o Not allowed to:
Clear any land or do new construction until DEC approval is

Lynn Day read the following letter, which he wrote on October 12, 2018, as he showed
different areas on the Overall Site Plan and Stormwater Erosion Control Plan Map.

LR&G tested their water and soil and they were fine
Bolton Point’s water was tested and it was fine
Property owners can test their own water

PROPOSED 2019 BUDGETS
The following Resolution was duly presented for consideration by the Town Board:
RESOLVED, that the Town Board of the Town of Lansing has prepared the Assessment
Rolls of parcels of land included in the Lansing Consolidated Water District (“CWD”),
CWD Extensions 1, 2, and 4 (Lansing Station Road and Drake Road) and for lands
within Lighting Districts Numbers 1, 2, and 3, (Ludlowville, Warren Road, and
Lakewatch), and for the Lansing Drainage Districts Numbers 1, 2, 4, 5, 6, 7, and 8
(Pheasant Meadows, Whispering Pines, Lake Forest, Farm Pond Circle, Lansing
Commons, Woodland Park, and Cayuga Way), and the Lansing Sewer Districts (Cherry
Road and Warren Road) (all together, the “Districts”), and the Town has apportioned and
assessed upon such parcels of land in proportion in the amount of benefits the
improvements shall confer upon the same the cost chargeable to said Districts in
connection with the construction and capital costs of the providing of public water,
lighting, stormwater management and drainage, and sewer transportation and treatment
payable in the year 2019 and therefore, pursuant to § 239 of the Town Law, the Town
Board shall hold a Public Hearing at the Lansing Town Hall, 29 Auburn Road, Lansing,
New York 14882, at 6:31 p.m., on the 7th day of November, 2018 to hear and consider
any objections which may be made to said roll.
The question of the adoption of such proposed Resolution was duly motioned by
Councilperson Andra Benson, duly seconded by Councilperson Doug Dake, and put to a
roll call vote with the following results:

NOTICE IS HEREBY GIVEN, that the preliminary budget of the Town of Lansing,
Tompkins County, New York for the fiscal year beginning January 1, 2019, has been
completed and filed in the office of the Town Clerk of said Town, where it is available
for inspection by any interested persons at all reasonable hours; and
FURTHER NOTICE IS HEREBY GIVEN, that the Town Board of the Town of
Lansing will meet and review said preliminary budget and hold a Public Hearing thereon
at the Lansing Town Hall, 29 Auburn Road, Lansing, New York 14882, at 6:33 p.m. on
the 7th day of November, 2018 and that at such hearing any person may be heard in favor
of or against the preliminary budget as compiled or for or against any items therein
contained; and

IN AND FOR THE HIGHWAY DEPARTMENT AND
SELECTING PROBATIONARY PERIOD THEREFOR
The following Resolution was duly presented for consideration by the Town Board:
WHEREAS, there is a need for a laborer at the Town of Lansing Highway Department,
and
WHEREAS, said position has been classified and deemed as a Civil Service Laborer
position by the Tompkins County Department of Personnel; and
WHEREAS, Brandon Gavitt has been identified as a qualified candidate; and
WHEREAS, the Highway Superintendent has recommended that Brandon Gavitt be hired
as a laborer at the Town of Lansing Highway Department; and
WHEREAS, upon a review and discussion of the matter, the Town Board of the Town of
Lansing has hereby:
RESOLVED, that Brandon Gavitt be and hereb y is approved to be employed as a laborer,
Grade A, Step 1, in the Town of Lansing Highway Department, effective November 1,
2018, at a rate of $16.91 per hour, 40 hours per week, and all Town perquisites and
benefits as are available to such position; and it is further
RESOLVED, that the probationary period be and hereby is scheduled for 26 weeks; and
it is further
RESOLVED, that the appropriate Town officer be and hereby is authorized to make such
changes to the Towns’ employment and civil service rosters, to file the required Civil
Service forms to effect such changes per this Resolution, and to file Form 428s, if
required.

WHEREAS, said position, Part-Time Recreation Assistant, for the Lansing Drop In
Program was sought to be filled; and
WHEREAS, an acceptable and qualified individual was located, and is therefore
proposed to be hired to fulfill such job requirement; and
WHEREAS, after review and discussion of such proposal, the Town Board of the Town
of Lansing has hereby
RESOLVED, that Jolyn Howland be and hereby is approved to be employed as a Town
of Lansing Grade 2 Employee, as Part-Time Recreation Assistant, to act in a substitute
capacity for the Lansing Drop In Program, with such employment to commence October
8, 2018 at the rate of $12.22 per hour.
The question of the adoption of such proposed Resolution was duly motioned by

The following Resolution was duly presented for consideration by the Town Board:

WHEREAS, residents along Lansing Station Road, from the end of the Algerine Road-
Lansing Station District Extension southerly along the shoreline and the railroad tracks,
have requested a municipal water extension for years, three feasibility studies have been
undertaken over the past decade, and several times petitions were circulated to determine
support, with due regard for the ball-park rule of a 75% informal approval rate of an
estimated expense for residents in such proposed extension, and the most recent update
and petition shows over 90% support based upon currently updated feasibility and cost
studies undertaken by the Town Engineer; and
WHEREAS, the Water and Sewer Advisory Committee, working with the Town and
Town Engineers and residents, has developed a map of a proposed service area, and the
same has been examined and deemed feasible, with cost to depend upon the approval and
waivers of the railroad for line crossings by underground water lines, and the WS AB
unanimously approved moving forward, with a note to the Town Board that there is a
potential high cost per EDU for this district and, while its approval by residents may be
likely based on very high current levels of support at such number, approval by the State
Comptroller is not assured; and
WHEREAS, the creation of such proposed Consolidated Water District Extension NO. 6
is found to be feasible and deserving of official study and, given the needs and desires of
the residents, such extension is deemed to be in the public interest and in the interest of
the affected property owners proposed to be included in such district, including due to
sub-standard water conditions in the area, inadequate water supplies in the area, the need
to protect Cayuga Lake and eliminate lake source water and lakeside wells, as well as the
issues arising with algae blooms, hypoxic/anoxic waters, and toxins both found and
placed in Cayuga Lake (including, for example, herbicides to try to control invasive
water species), the Town now desires to fully examine the construction and costs of such
a proposed district, and accordingly, based upon due deliberation thereupon, the Town
Board of the Town of Lansing has hereby
RESOLVED, that the Town Board of the Town of Lansing hereby directs the Town
Engineer to proceed with the preparation of a Map, Plan and Report (“MPR”) pursuant to
Town Law §§ 209-c and 209-d relative to the proposed Consolidated Water District
Extension No. 6 (Lansing Station Road); and it is further
RESOLVED, that a SEQRA FEAF be developed and undertaken to inform the scope and
cost of such proposed district, and that the Town Engineer thereafter prepare such official
Map, Plan and Report (“MPR”) for the proposed district for consideration by the Town
Board and residents, and that the cost of all of the same be and hereby is approved in an
amount not to exceed $5,000, all as subject to permissive referendum as provided by
Town Law Article 7 and § 209-b.
