HomeMy WebLinkAbout2018-06-27 special meeting June 27, 2018 1 SPECIAL TOWN BOARD MEETING June 27, 2018 A Special Meeting of the Lansing Town Board was held at the Town Hall Board Room, 29 Auburn Road, Lansing, NY on the above date at 9:05 a.m. The meeting was called to order by the Supervisor, Edward LaVigne, and opened with the Pledge of Allegiance to the flag. Roll call by Deborah K. Munson, Town Clerk, showed the following to be PRESENT: Andra Benson, Councilperson Doug Dake, Councilperson Joseph Wetmore, Councilperson Supervisor, Edward LaVigne ABSENT: Katrina Binkewicz, Councilperson ALSO PRESENT: Guy Krogh, Town Counsel MOTION TO OPEN THE PUBLIC HEARING ON PROPOSED LOCAL LAW #3 OF 2018, AMENDING THE 2018 TOWN OF LANSING LOCAL EARLY RETIREMENT INCENTIVE LAW Councilperson Doug Dake, moved to OPEN THE PUBLIC HEARING ON PROPOSED LOCAL LAW #3 OF 2018, AMENDING THE 2018 TOWN OF LANSING LOCAL EARLY RETIREMENT INCENTIVE LAW at 9:06 am. Councilperson Joseph Wetmore, seconded the motion. All in Favor – 4 Opposed – 0 No one addressed the Town Board. MOTION TO CLOSE PUBLIC HEARING All persons desiring to be heard, having been heard, Supervisor Edward LaVigne, moved to CLOSE THE PUBLIC HEARING ON PROPOSED LOCAL LAW #3 OF 2018, AMENDING THE 2018 TOWN OF LANSING LOCAL EARLY RETIREMENT INCENTIVE LAW at 9:07 am. Councilperson Joseph Wetmore, seconded the motion. All in Favor – 4 Opposed – 0 RESOLUTION ADOPTING LOCAL LAW #3 OF 2018, AMENDING THE 2018 TOWN OF LANSING LOCAL EARLY RETIREMENT INCENTIVE LAW RESOLUTION 18-107 RESOLUTION ADOPTING LOCAL LAW #3 OF 2018, AMENDING THE 2018 TOWN OF LANSING LOCAL EARLY RETIREMENT INCENTIVE LAW The following Resolution was duly presented for consideration by the Town Board: WHEREAS, the Town of Lansing has been continually examining the structure of its workforce and endeavored to share services, combine positons, cross-train employees, and otherwise restructure the workforce and reduce the number of employees to reduce costs and create greater overall efficiency in municipal operations without sacrificing needed services or response times, and over such decades various organizational plans were created and generally approved as templates to guide such plans and future growth, and at various times positions have been created and filled, as well as amended, to implement and help implement such plans; and WHEREAS, in order to achieve the goals identified for this plan and to encourage participation and provide for an actual benefit from such program to employees and the Town, the Town has learned that it needs to change the terms of the program; and WHEREAS, this matter has again been reviewed and it remains a Type II Action under SEQRA such that no environmental review is mandated or required; and June 27, 2018 2 WHEREAS, a public hearing upon such local law was duly held at the Lansing Town Hall, 29 Auburn Road, Lansing, New York on the 27th day of June, 2018, at 9:00 am, to consider the adoption of proposed Local Law #3 of 2018, and all testimony and evidence presented thereat, if any, was duly considered, and upon due deliberation thereupon, the Town Board of the Town of Lansing has thus resolved as follows: 1. Local Law #3 of 2018 be and hereby is approved and adopted in the form as presented to this meeting, and in such form “be it so enacted.” 2. In accord with the Municipal Home Rule Law the final adopted version of this local law shall be filed with the Town Clerk, and the said Town Clerk shall within 20 days hereof file the same with the New York State Department of State, Division of Corporations, State Records and Uniform Commercial Code, One Commerce Plaza, 99 Washington Avenue, Albany, New York 12231, as required by Municipal Home Rule Law. The question of the adoption of such proposed Resolution was duly motioned by Councilperson Doug Dake, duly seconded by Councilperson Andra Benson, and put to a roll call vote with the following results: Councilperson Andra Benson - Aye Councilperson Doug Dake - Aye Councilperson Joseph Wetmore - Aye Supervisor Edward LaVigne - Aye Accordingly, the foregoing Resolution was approved, carried, and duly adopted on June 27, 2018. TOWN OF LANSING, TOMPKINS COUNTY, NEW YORK LOCAL LAW NUMBER 3 OF 2018 A LOCAL LAW TO AMEND THE 2018 LOCAL RETIREMENT INCENTIVE PROGRAM BY AMENDING LOCAL LAW #2 OF 2018 Be it enacted by the Town of Lansing as follows: SECTION 1: Section 2 of Local Law #2 of 2018 be and hereby is amended to read as follows: SECTION 2: OPEN ELECTION PERIOD: The Town of Lansing hereby elects to provide all eligible employees (as below-defined) with a retirement incentive program with an open and binding enrollment period commencing upon the date of adoption of this local law and ending at midnight upon July 16, 2018. Making the election means that the eligible employee has elected and chosen to retire from the Town’s serv ice and employment with the Town effective on or before July 31, 2018. SECTION 2: In all other manners and respects the balance of Local Law #2 of 2018 and the local early retirement incentive program thereby adopted are and remain unchanged, including the dates of election and mandatory retirement from Town service. SECTION 3: This local law shall take effect immediately. RESOLUTION ADOPTING AMENDMENTS TO EMPLOYEE HANDBOOK §§ 803 AND 807 TO CLARIFY AND UPDATE POLICY FOR POST-RETIREMENT HEALTH INSURANCE AND ACCRUED SICK LEAVE BENEFITS AND RELATED CONTRIBUTION RULES FOR INDIVIDUAL AND FAMILY COVERAGES June 27, 2018 3 RESOLUTION 18-108 RESOLUTION ADOPTING AMENDMENTS TO EMPLOYEE HANDBOOK §§ 803 AND 807 TO CLARIFY AND UPDATE POLICY FOR POST-RETIREMENT HEALTH INSURANCE AND ACCRUED SICK LEAVE BENEFITS AND RELATED CONTRIBUTION RULES FOR INDIVIDUAL AND FAMILY COVERAGES The following Resolution was duly presented for consideration by the Town Board: WHEREAS, applying the updated Town Employee Handbook rules to retired individuals required amendment and clarification earlier in 2018, and to further the goal of clarifying the use of post-retirement benefit accruals relative to pre-Medicare benefits, the policy again needed to be updated; and WHEREAS, as presented to this meeting, the policy as reflected in §§ 803 and 807 of the Employee Handbook be amended as proposed, mainly to clarify that post-retirement benefits are not wholly lost upon the retiree attaining Medicare eligibility, but continue for the retiree’s benefit to cover required healthcare cost contributions under the Town’s policy, including for coverage contributions for such retiree’s eligible spouse and dependents until they too attain Medicare eligibility, whereupon then, and at such time, any remaining benefit credits or value duly expire and are lost; and WHEREAS, after due deliberation thereupon, the Town Board of the Town of Lansing has hereby RESOLVED, that the amendments to § 803 and § 807 of the Employee Handbook be and hereby are approved and adopted, and the Employee Handbook shall be updated accordingly. The question of the adoption of such proposed Resolution was duly motioned by Councilperson Joseph Wetmore, duly seconded by Supervisor Edward LaVigne, and put to a roll call vote with the following results: Councilperson Andra Benson - Aye Councilperson Doug Dake - Aye Councilperson Joseph Wetmore - Aye Supervisor Edward LaVigne - Aye Accordingly, the foregoing Resolution was approved, carried, and duly adopted on June 27, 2018. RESOLUTION HIRING PART TIME SEASONAL EMPLOYEE FOR PARKS & RECREATION FOR THE TOWN OF LANSING RESOLUTION 18-109 RESOLUTION HIRING PART TIME SEASONAL EMPLOYEE FOR PARKS & RECREATION FOR THE TOWN OF LANSING The following Resolution was duly presented for consideration by the Town Board: WHEREAS, there is a need for a Recreation Assistant position at the Town of Lansing; and WHEREAS, said position has been classified and deemed as a Civil Service Recreation Assistant position by the Tompkins County Department of Personnel; and WHEREAS, Kennedy Todi has been identified as a qualified Recreation Assistant candidate; and WHEREAS, the Town of Lansing Supervisor has recommended that the above position be filled at the Town of Lansing; and June 27, 2018 4 WHEREAS, upon a review and discussion of the matter, the Town Board of the Town of Lansing has hereby: RESOLVED, that effective June 26, 2018, Kennedy Todi will be paid at a rate of $10.50 per hour, be and hereby is approved to be employed as a Recreation Assistant, in the Town of Lansing; and it is further RESOLVED, that the appropriate Town officer be and hereby is authorized to make such changes to the Towns’ employment and civil service rosters, to file the required Civil Service forms to effect such changes per this Resolution, and to file Form 428s, if required. The question of the adoption of such proposed Resolution was duly motioned by Councilperson Andra Benson, duly seconded by Supervisor Edward LaVigne, and put to a roll call vote with the following results: Councilperson Andra Benson - Aye Councilperson Doug Dake - Aye Councilperson Joseph Wetmore - Aye Supervisor Edward LaVigne - Aye Accordingly, the foregoing Resolution was approved, carried, and duly adopted on June 27, 2018. MOTION TO ENTER CLOSED SESSION Councilperson Joseph Wetmore, moved to ENTER CLOSED SESSION TO SEEK LEGAL ADVICE OF COUNSEL ON A PARTICULAR MATTER AT 9:11 AM. Councilperson Andra Benson, seconded the motion. All in Favor - 4 Opposed - 0 MOTION TO EXIT CLOSED SESSION Supervisor Edward LaVigne, moved to EXIT CLOSED SESSION AT 9:48 AM.
