The Deputy Supervisor called the meeting to order and took the Roll Call. A. Scott Pinney Matt Besemer Marty Christopher Bud Shattuck Connie Wilcox Bonny Boles Guy Krogh Visitors: None ROLL CALL Supervisor Absent Councilperson Absent Councilperson Present Councilperson Present Deputy Supervisor Present Town Clerk Absent Town Attorney Absent Set Public Hearing For Bolton Point Water Tank: RESOLUTION 09 -95 IN THE MATTER OF THE CONSTRUCTION OF THE SOUTHERN CAYUGA LAKE INTERMUNICIPAL WATER COMMISSION'S BURDICK HILL WATER TANKS PROJECT, THE EXPENDITURE OF FUNDS FOR SUCH PURPOSE, THE ISSUANCE AND SALE OF JOINT AND SEVERAL SERIAL BONDS FOR THE COSTS OF SUCH PROJECT, AND THE EXECUTION OF AN AMENDMENT TO THE AGREEMENT OF MUNICIPAL COOPERATION GOVERNING SUCH WATER TANK. At a Special Meeting of the Town Board of the Town of Lansing held in and for the Town of Lansing at the Lansing Town Hall on 30th day of April, 2009, the following members being present: Connie Wilcox, Deputy Supervisor; Francis Shattuck, Councilperson; Martin Christopher, Councilperson; and the following members being absent: A. Scott Pinney, Supervisor; Matthew Besemer, Councilperson; and the following motion for a Resolution was duly made by motion of Connie Wilcox, and was duly seconded by Francis Shattuck; and the vote was as follows: Francis Shattuck — Aye; Connie Wilcox — Aye; Martin Christopher — Aye; and the following Resolution therefore passed 3 -0, and was duly adopted: WHEREAS, a plan, report and map has been duly prepared in such manner and in such detail as this Board determines to be necessary, relating to the dismantling of an existing water storage tank and the construction of two new water storage tanks, all in the Town of Lansing, to be part of the Southern Cayuga Lake Intermunicipal Water Commission ( "SCLIWC ") water system, and all pursuant to Article 5 -G of the General Municipal Law and relevant provisions of the Town Law and Village Law, such project to be known and identified as the SCLIWC 2009 Burdick Hill Tanks Project, and hereinafter also referred to as "Improvement," to provide improved water storage capacity for SCLIWC and the system owned in common by the Towns of Dryden, Ithaca and Lansing and the Villages of Cayuga Heights and Lansing (collectively the 0110 "Municipalities" and sometimes individually the "Municipality "), such Improvement to be constructed and owned by the Municipalities; and WHEREAS, the proposed SCLIWC 2009 Burdick Hill Tanks Project consists of the improvements set forth below and as more particularly shown and described in said map, plan and report presently on file in the Office of the Town Clerk of the Town of Lansing: (i) Construction of a new 900,000 gallon pre- stressed concrete water storage tank (the "New Tank ") on the site of the Commission's existing 33 year old 1,500,000 gallon welded steel water storage tank (the "Existing Tank ") just east of the intersection of North Triphammer and Burdick Hill Roads in the Town of Lansing, construction of 290 feet of twenty inch diameter ductile iron pipe and appurtenances running from the Commission's existing transmission main, and required drainage and site improvements; and dismantling and removing the Existing Tank, construction of a new 1,5000,000 gallon pre- stressed concrete water storage tank ( "New Tank No. 2 ") on the same footprint as the Existing Tank, construction of a concrete catch basin and replacement of the Existing Tank overflow outfall piping to bring the overflow structure up to current Health Department standards, and installation of perimeter drainage around the New Tank; and WHEREAS, the maximum proposed to be expended for the aforesaid Improvement is $27600,000.00 ($1,200,000 for the New Tank No. 1 project and $1,400,000 for the New Water Tank No. 2 project); and WHEREAS, the proposed method of financing to be employed for the aforesaid Improvement is issuance by the Municipalities of joint and several serial bonds not to exceed $2,600,000; and WHEREAS, the area of said Town determined to be benefitted by said SCLIWC 2009 Burdick Hill Tanks Project consists of the Town of Lansing Consolidated Water District, the Town of Lansing Consolidated Water District Extension #1, and the Town of Lansing Consolidated Water District Extension #2 served by the SCLIWC Water Treatment Plant; and WHEREAS, it is now desired to call a public hearing for the purpose of considering (i) the aforesaid plan, report and map, (ii) the providing of said SCLIWC 2009 Burdick Hill Tanks Project, (iii) the authorization of serial bonds for payment of the costs of the Improvement, and (iv) the amendment of the existing Agreement of Intermunicipal Cooperation between the Municipalities in relation to such Improvement, and to hear all persons interested in the subject thereof, all in accordance with applicable provisions of General Municipal Law, Local Finance Law, Town Law, and Village Law; NOW, THEREFORE, IT IS HEREBY ORDERED, by the Town Board of the Town of Lansing, Tompkins County, New York, as follows: Section 1. A public hearing will be held at the Town Hall, 29 Auburn Road in Lansing, New York, on the 20th day of May, 2009, at 6:25 P.M., to consider the aforesaid plan, report and map and the questions of the providing of said SCLIWC 2009 Burdick Hill Tanks Project, the authorization of joint and several serial bonds for payment of the costs of the Improvement, and the amendment of the existing Agreement of Intermunicipal Cooperation between the Municipalities to authorize such Improvement, bonding, and other activities, to delegate to the Treasurer of SCLIWC certain authority 2 111 to issue such bonds on behalf of the Municipalities, and to grant SCLIWC certain other powers and authority, and to hear all persons interested in the subject thereof and concerning the same, and to take such action thereon as is required by law. Section 2, The Town Clerk of the Town of Lansing, Tompkins County, New York, is hereby authorized and directed to cause a copy of this order to be published once in the official newspaper of the Municipality, and also to post a copy thereof on the Town signboard maintained by the Clerk, not less than ten nor more than twenty days before the day designated for the hearing as aforesaid. Section 3. This action is hereby classified as a Type II Action under 6 NYCRR Part 617.5(c)(2) and 617.5(c)(11), and no environmental review is therefore required as this project is a replacement and reconstruction of an existing water tank related to the extension and distribution of a public utility, namely, water. Section 4. This order shall take effect immediately.
