SPECIAL TOWN BOARD MEETING
November 8, 2017
A Special Meeting of the Lansing Town Board was held at the Town Hall Board Room, 29 Auburn
Road, Lansing, NY on the above date at 6:30 p.m. The meeting was called to order by the Supervisor,
Edward LaVigne and opened with the Pledge of Allegiance to the flag. Roll call by Deborah K.
Munson, Town Clerk, showed the following to be

Oblinski, Jason Whiting, and a few other attendees.

A resident asked if this included the proposed new water districts.
Supervisor Edward LaVigne, stated this is for the existing special districts: water, sewer, lighting; not
the proposed new water districts.

RESOLUTION ADOPTING LOCAL LAW #8 OF 2017 – A LOCAL LAW TO REPEAL LOCAL
LAW #4 OF 2017 AND REINSTATING THE TAX CAP LIMITS OF GENERAL MUNICIPAL
LAW § 3-C
The following Resolution was duly presented for consideration by the Town Board:
WHEREAS, on April 19, 2017, the Town adopted a local law to override tax cap limits set forth in GML
§ 3-C (Local Law #4 of 2017), and due to other NYS legislation allowing certain limited tax refunds
under stated conditions, one of which is that no tax cap override may be in place at the time of adoption of
a final budget for 2018, the Town Board has decided to repeal Local Law #4 of 2017, the tax cap override
local law; and
WHEREAS, a public hearing was duly held at the Lansing Town Hall, 29 Auburn Road, Lansing, New
York, being in the Town of Lansing, on November 8, 2017, to consider the adoption of proposed Local
Law #8 of 2017, and all persons interested therein were duly heard and all evidences were taken; and
WHEREAS, since this action is a Type II SEQRA action for which no environmental review is required,
and upon due consideration thereupon, the Town Board of the Town of Lansing has hereby
RESOLVED, that Local Law #8 of 2017 be and hereby is approved and adopted in the form as presented
to this meeting, and in such form “be it so enacted”; and it is further
RESOLVED, that in accord with §21 of the Municipal Home Rule Law, the final adopted version of this
Local Law shall be presented to the Supervisor for approval; and it is further
RESOLVED, that upon such approval by the Supervisor (or other approval occurring pursuant to said §21
of the Municipal Home Rule Law), and within 20 days after the final adoption of this Local Law, the
Town Clerk shall file a certified copy of this Local Law, together with the required certifications, if any,
as follows: (i) in the Office of the Town Clerk; and (ii) with the New York State Secretary of State as
required by Municipal Home Rule Law §27 (said filing may be made by delivery to the NYS
Department of State, Division of Corporations, State Records and Uniform Commercial Code, One
Commerce Plaza, 99 Washington Avenue, Albany, New York 12231).
The question of the adoption of such proposed Resolution was duly motioned by Councilperson
Katrina Binkewicz, dul y seconded by Councilperson Doug Dake, and put to a roll call vote with the
following results:

Accordingly, the foregoing Resolution was approved, carried, and duly adopted on November 08,

Supervisor Edward LaVigne, and Bookkeeper Charmagne Rumgay, stated the 2018 Budget is under
the tax cap by about $74,785.
TOWN OF LANSING, TOMPKINS COUNTY, NEW YORK
LOCAL LAW NUMBER 8 OF 2017
A LOCAL LAW TO REPEAL LOCAL LAW NUMBER 4 OF 2017
AND REINSTATE THE TAX CAP LIMITS
ESTABLISHED IN GENERAL MUNICIPAL LAW §3-C
Be it enacted by the Town of Lansing as follows:
SECTION 1: LEGISLATIVE INTENT: This Local Law shall be known as “Local Law
Number 8 of 2017”. It is the intent of the Local Law to repeal Local Law Number 4 of 2017, and to
thus reinstate the limits on the amount of real property taxes that may be levied by the Town of
Lansing pursuant to General Municipal Law §3-C,
SECTION 2: EFFECT: This Local Law hereby thus repeals in its entirety said Local Law
Number 4 of 2017, and declares the same of no force or effect, and thus the Town of Lansing repeals
the prior tax cap override local law of the Town of Lansing and reinstates the tax levy limits imposed
by General Municipal Law §3-C.
SECTION 3: SEVERABILITY: If any portion this Local Law, or the application thereof to
any person, entity, or circumstance, shall be determined by any court or tribunal of competent
jurisdiction to be invalid or unenforceable, such determination shall be confined in its operation to the
invalid part hereof, or in its application to such person, entity, or circumstance as is directly involved in
the controversy in which such determination shall have been rendered, and the remainder of this Local
Law shall not be impaired thereby and such determination shall not be deemed or construed to apply to
other persons, entities, or circumstances.
SECTION 4: EFFECTIVE DATE: This Local Law shall take effect immediately upon
filing with the Secretary of State.

RESOLUTION TO BUDGET FOR PROFESSIONAL SERVICES TO ASSIST WITH
EMERGENCY MEDICAL SERVICES PLANNING IN 2018

RESOLUTION TO BUDGET FOR PROFESSIONAL SERVICES TO ASSIST WITH
EMERGENCY MEDICAL SERVICES PLANNING IN 2018
The following Resolution was duly presented for consideration by the Town Board:
WHEREAS, the Tompkins County Council of Governments Emergency Medical Services Task Force
(TCCOG EMS-TF) has identified that the current system of providing emergency medical response
and transport is stressed – with declining numbers of volunteer and paid responders, and Lee Shurtleff,
the Director of the Department of Emergency Response has warned that the system could “collapse”
without intervention; and
WHEREAS, timely, competent, affordable emergency medical and transport services are critical and
necessary public services; and
WHEREAS, the TCCOG EMS-TF will be working for the next several months to identify possible
solutions to stabilize provision of EMS services and anticipates having preliminary recommendations
by March 2018; and
WHEREAS, it is anticipated that the EMS-TF may require professional services to assist in refining and
guiding implementation of proposed remedies; and

WHEREAS, at this point the EMS-TF is unable to provide specific information as to scope of work or
expertise required, but the EMS-TF and the Town of Lansing believes it is prudent to be financially
prepared to engage such services as may be indicated so that the crucial work of the EMS-TF can
continue uninterrupted;
NOW, therefore be it
RESOLVED, that the Town of Lansing will provide $5,000 in their 2018 budget to support
professional services to assist with planning and/or implementation of EMS-TF recommendations; and
further be it
RESOLVED, that the commitment to spend some or all of these funds will be contingent upon
presentation by the EMS-TF of preliminary recommendations to stabilize provision of EMS services as
well as a description of the professional services, qualifications and scope of work to be provided by
the expert, and approval of the Town of Lansing to support such proposed work.
The question of the adoption of such proposed Resolution was duly motioned by Councilperson Robert
Cree, duly seconded by Councilperson Andra Benson, and put to a roll call vote with the following
results:

RESOLUTION APPROVING THE SPECIAL DISTRICTS BUDGET AND
TOWN BUDGET FOR THE FISCAL YEAR 2018
The Preliminary Budget and information pertaining to the Proposed Final 2018 Budget were available
as handouts. The following 2018 Budget Changes from Preliminary to Proposed Final Budget were
also available as a handout.
2018 Budget Changes from Preliminary to Proposed Final Budget
Assessment decreased
The Town assessment total decreased from $840,099,427 to $839,894,427, a total of $205,000. This
decrease shifted a little over $100 from Town Property taxes to be raised to the ILO (In-Lieu of) taxes
to be raised. The decreased assessment, increases the tax rate by .02%, from 1.4910 to 1.4912. The
2018 tax rate decreased by .03% from the 2017 tax rate.
Emergency Preparedness request from Tompkin s County
At the October Board Meeting, the Board approved an addition to General A Fund appropriations in
the amount of $5,000 for Tompkins County Emergency Preparedness (A1989.400). To keep the tax
rate consistent, the use of fund balance was increased from $202,000 to $207,000 (see the Summary of
Fiscal Budget by Fund sheet).
Consolidated Water Units
The Consolidated Water Units increased by .5 of a unit, from 2,899.85 to 2,900.35. A unit charge is
$155, so a half unit increase is $77.50. With the revenue (SW1030) increase of $77.50, contingency
appropriation (SW1990.400) increased by $77.50.
Warren Rd Sewer P&I Units
Warren Rd Sewer P&I units changed from 222.22 to 223.16. The amount raised remains the same at
$20,684.67, so the unit charge decreased from $93.08 per unit to $92.69 per unit.

The following Resolution was duly presented for consideration by the Town Board:
WHEREAS, the Town Board duly held Public Hearings on November 8, 2017 at the Lansing Town
Hall, 29 Auburn Road, Lansing, New York and all persons thereat were duly heard; and
WHEREAS, upon due deliberation thereupon, the Town Board of the Town of Lansing has hereby
RESOLVED, that the proposed Special Districts Budget and the proposed Town Budget are hereby
adopted as the Town of Lansing Final Budget for the Fiscal Year 2018.
The question of the adoption of such proposed Resolution was duly motioned by Councilperson Doug
Dake, duly seconded by Councilperson Katrina Binkewicz, and put to a roll call vote with the
following results:
