The Lansing Town Board met in Regular Session at the Lansing Town Hall Board
Room at. 7:00 p.m. with Supervisor Farkas presiding.
The Supervisor called the meeting to order and had the clerk take the Roll Call,

FEE SCHEDULE CHANGE — LOCAL LAW NO, 1 FOR THE YEAR 2004:
04 -60 RESOLUTION, offered by Mrs. Wilcox and seconded by Mr. Christopher:
RESOLVED, that the Public Hearing for the Fee Schedule change entitled, Local
Law No. 1 for the year 2004, be called to order at 7:05 p.m.
Carried.
Mr. Platt explained the following changes to all present. No one appeared voicing
any comments.
TOWN OF LANSING, TOMPKINS COUNTY, NEW YORK
LOCAL LAW NUMBER 1 OF 2004
SUBDIVISION, PERMIT, LAND USE AND INSPECTION FEE SHEDULES
SECTION 1. TITLE & APPLICATION - This Local Law shall be entitled "Local Law No. 1
of the Year 2004 ", This Local Law repeals, supersedes and replaces (a) Local Law Number 3 of
1984 concerning this same subject matter, and (b) each other Local Law or Resolution that is
inconsistent herewith. For all applications and matters submitted or filed after the effective date
hereof, this Local Law shall be exclusively controlling. This Local Law shall apply only within the
Town of Lansing, Tompkins County, State of New York,
SECTION 2. SUBDIVISION FEES — the following fees apply to the applicable named land
use process or procedure listed below. Each fee must be paid in full without reservation, restriction or
recourse prior to the issuance of any approvals or permits, whether referenced in the applicable Town of
Lansing Land Use Ordinance, or otherwise:
A. Boundary Change Fee: $25.00
B. Minor Subdivision Fees:
1. Initial Application Fee: $25.00, to be paid at the time of application.
2. Lot Fees: $100.00 for each Additional Lot created, to be paid upon endorsement.
C. Major Subdivision Fees:

1. Initial Application Fee: $50.00, to be paid at the time of
application.
2. Classification Fee: $250.00 payable upon classification as a Major
Subdivision.
3. Lot Fees: $100.00 for each additional lot created, to be paid after
any Preliminary Approval and before any Final Approval.
4. Reimbursement Fees: payable to the Town of Lansing for any fees
incurred by the Town of Lansing that are directly related to the
Application or project, including, but not limited to, engineering
fees, attorneys' fees, notice and notification fees and expenses,
publication and posting fees and expenses, advertising fees and
expenses, filing fees and expenses, any consultants' fees and
expenses, and any inspection fees or expenses; each, every and all
such fees and expenses to be paid within 15 days of the day the
Town of Lansing submits any invoice for the same. No permit or
approval shall be issued if any such reimbursement is delinquent.
SECTION 3, PLANNED DEVELOPMENT AREAS (also known as Cluster Zones,
Planned Unit Developments, etc.) - Fees to be paid are as follows:
A. Initial Application Fee: $300.00, to be paid at the time of application.
B. Per Unit Fee: $50.00, paid at the time of approval or acceptance of each unit.
C. Reimbursement Fees: to the Town of Lansing for any fees incurred by the
Town of Lansing that are directly related to the Application or project,
including, but not limited to, engineering fees, attorneys' fees, notice and
notification fees and expenses, publication and posting fees and expenses,
advertising fees and expenses, filing fees and expenses, any consultants' fees
and expenses, and any inspection fees or expenses; each, every and all such
fees and expenses to be paid within 15 days of the day the Town of Lansing
submits any invoice for the same. No permit or approval shall be issued if
any such reimbursement is delinquent.
SECTION 4, SITE PLAN REVIEW FEE - $75.00, due at the time of application.
SECTION 5. SIGN PERMIT FEE - $25.00, due at the time of application.
SECTION 6, ZONING BOARD OF APPEALS HEARING FEE - $75.00, due at the
time of application.
SECTION 7. SPECIAL PERMIT FEE - $75.00, due at the time of application.
SECTION 8, FLOOD ZONE CERTIFICATION FEE - $25.00, due at the time of
application.
SECTION 9, CERTIFICATE OF ZONING COMPLIANCE FEE - $25.00, due at the
time of application.
SECTION 1Q, JUNK YARD LICENSE & RENEWALS OF JUNK YARD LICENSE
FEES - $100.00, due at the time of application or renewal.
SECTION 11, MOBILE HOME PARK & MOBILE HOME PARK LICENSE RENEWAL
FEES - Fee is based upon number of lots, as follows:
1. Up to 5 lots: $50.00, due at the time of application or renewal.

2. Over 5 lots: $100.00, due at the time of application or renewal.
SECTION 12. CELLULAR TOWER PERMIT FEE - No special fee, but a Building
Permit is required, as is a $25,000.00 bond or other security, as
determined by the Town of Lansing.
SECTION 13, TOWN DIRECTORY FEE - $10.00, due when requested.
SECTION 14, COPY OF SUBDIVISION REGULATIONS FEE - $20.00, due when
requested.
SECTION 15. FLY ASH PERMIT FEE - No set fee; fee set per agreement.
SECTION 16. BUILDING PERMIT FEES - All issued Building Permits are valid for
only 1 year, after which a renewal application must be filed. Fees for Renewal Applications
shall be one -half of the Building Permit Fees. Applicable Building Permit Fees are as follow:
A. Residential Dwellings: $0.30 per square foot for one and two family
residences, mobile homes on owner owned lots, modular homes, multiple
housing, and additions. Basements are not included in square footage
calculations.
B. Mobile Homes on leased lots: $150.00.
C. Other Residential Structures: $0.07 per square foot. "Other Residential
Structures" includes garages, storage buildings incidental to a residence,
workshops, pole barns, and similar structures.
D. Remodeling: $3.00 per thousand dollars in expense, if square footage rule
does not apply, but in either case subject to a $50.00 minimum.
E. Minor Alterations (less than $1,000.00): $25.00.
F. Commercial Structures: $5.00 per thousand dollars of cost based upon
construction estimate approved by the Town of Lansing.
G. Prefabricated Sheds in excess of 100 square feet: $25.00.
H. Pools: All Pool Permits are valid for only 90 days, after which a new
permit must be obtained. Fees are based upon the type of pool, as follows:
1. Above ground: $25.00.
2. In ground: $50.00.
SECTION 17: ELECTRICAL INSPECTION FEES: Fees apply according to the following
schedule. For special equipment, services, appliances, apparatus or devices not listed on the
following schedule, or for voltage in excess of 600 volts nominal, contact the Town of Lansing
Electrical Inspector for pricing. When the Town of Lansing, or its inspector, sends the applicant a written
notice of a defect (or defects) found during the original inspection, and the applicant or his agent reports that
such defect(s) have been corrected, a second inspection will be provided free of additional charge. If,
however, the inspector finds or reports that any defect(s) have not been corrected, a charge of $20.00 will be
made for each additional inspection. The Schedule is subject to a MINIMUM INSPECTION FEE of
$55.00:

SECTION 18: EFFECTIVE DATE - This local law shall take effect immediately upon filing
with the Secretary of State.

At a Regular Meeting of the Town Board of the Town of Lansing held in and for
the Town of Lansing at the Lansing Town Hall on 21st day of January, 2004, the
following members being present: Stephen Farkas, Supervisor; Francis Shattuck,
Councilperson; Douglas McEver, Councilperson; Connie Wilcox, Councilperson;
and Martin Christopher, Councilperson; and the following members being
absent: none; and the following motion for a Resolution was duly made by
motion of Douglas McEver, and was duly seconded by Connie Wilcox; and the
vote was as follows: Stephen Farkas - aye, Francis Shattuck - aye, Douglas
McEver - aye, Connie Wilcox - aye, and Martin Christopher - aye; and the
following Resolution therefore passed 5 -0, and was duly adopted:

WHEREAS, the Town of Lansing has several Local Laws, of varying years, and
related Resolutions, governing various fees for subdivision applications, permits,
inspections, and related matters; and
WHEREAS, the Town of Lansing has determined that it would be in the public
interest to consolidate those various schedules and fees into a single Local Law;
and
WHEREAS, a public hearing was duly noticed to be held, and was duly held,
upon March 17, 2004, at 7:05 p.m. at the Town of Lansing Town Hall, at 29
Auburn Road (State Route 34), Lansing, New York, whereat citizens of the Town
of Lansing and interested members of the public could be heard upon the issues
under consideration; and
WHEREAS, the Town Code Enforcement Officer had available copies of the
proposed Local Law Number 1 of 2004, and discussed the same; and
WHEREAS, after review and discussion of each of the foregoing premises and
the proposals set forth or referenced herein, the Town Board of the Town of
Lansing has hereby
RESOLVED, that the Town Board of the Town of Lansing, in its capacity as
governing body of the Town of Lansing, does hereby pass, adopt and approve
Local Law Number 1 of 2004, as set forth in its entirety below, and as a
consequence hereof, the Town Board hereby further repeals each and all prior
Local Laws and Resolutions in conflict with Local Law Number 1 of 2004:

SECTION 18: EFFECTIVE DATE - This local law shall take effect immediately upon

LANSING COMMUNITY LIBRARY COMMITTEE,
Marlaine Darfler gave the Board an overview of what has been going on with the
Library. She stated that there has been 6,130 hours of work performed by volunteers in
the year 2003. She also stated that the Library has received $ 31,600.00 in fundraisers and
will proceed with phase I of the remodeling of the building this spring.
ALVIN FELDZAMEN - ARROWOOD AREA,
Mr. Feldzamen approached the Board regarding the water pressure in his
area. Mr. Farkas stated that Mr. Herrick is looking into the situation. This will be
discussed at a later date.
VINCE MEHRINGER -11 PHESANT WAY:
Mr. Mehringer informed the Board that there is an area in the Pheasant Meadows
sub - division that will need work in the future and that he would offer his assistance to the
Board in said matter.

Sun Path Area,
A number of residents from the Sun Path area were present to discuss the water
situation in their area. Mr. Herrick presented the feasibility study and stated that the

residents could pay a one time up front cost of $ 19.875.00 per EDU or the project could
be bonded for 20 years at a yearly cost to the resident of $ 1,663.50 per EDU.
After a long discussion, it was decided that the property owners need to decide
what direction they want to take and then get back to the Board.
Mr. French asked if the bid opening could take place at this time so that the
bidders present would not have to wait until Mr. Herrick was finished. The bids were then
opened and the results were:

DAVE HERRICK TOWN ENGINEER:
Bean Hill Pressure Zone Improvements:
Tompkins County Health Department is requiring a municipal pressure booster
station for the proposed subdivision and will not approve the use of household systems. A
short-term solution is being looked into.
MS4 Program:
Mr. Platt and Mr. Herrick met with Jason Haremza on 2/23/04 to review the
process in the development of the Town's stormwater management ordinance. Mr. Herrick
gave the Board a copy of Mr. Haremza's e -mail. Mr. Herrick stated that the MS4 reporting
deadline to the DEC for the measurable goals is June I".
Town Barn Roof:
Mr. Herrick will have Engineer, Peter Novelli perform a structural estimate on the
Highway Garage at a cost not to exceed $ 1,500.00. Mr. French will go ahead with
replacing the roof.
JACK FRENCH — HIGHWAY SUPERINTENDENT:
Smoke/Heat System:
Mr. French stated that he has received two (2) estimates out of a possible 5 to
install a smoke and heating system at the Highway Garage that would be connected to the
Lansing Fire Department. The low estimate came from Sentry Alarm in the amount of
$5,096.00. Mr. French will look into this further.
New Sign Machine:
Mr. Ferris has hooked up the new machine and it is now up and running. The new
road signs will now be 9 inches instead of 6 inches.
DICK PLATT — CODE ENFORCEMENT OFFICER:
Monthly Report:
Mr. Platt stated that they were down in project costs from last year by $
236,700.00.

Mr. Farkas stated that the group of six (6) municipalities has agreed to hire Susan

Mr. Christopher asked who the liaison officer was to the Library. It was decided that
there was not one so Mr. Christopher volunteered to be the Town's liason officer to the
library.
Connie Wilcox:
Bolton Point:
Bolton Point is looking forward to putting out bids on the addition to the building
on March 30, 2004.
Doug McEver:
Personal Watercraft.
Attended the Town of Ithaca's meeting regarding Personal Watercraft. He stated
that they passed a 10:00 a.m. start and 500 feet before they can go 45 mph. A noise
ordinance was also added. The Town of Ulysses will meet regarding this on March 30,
2004. Mr. McEver will up date the Board on their decision.
WRC:
In the process of setting up a grant committee.
I.O.
A project manager has been hired by the name of Darby Kieley. Will be looking
for a place to set up an office for her in the near future.
Bud Shattuck.
Planning Board:
Mr. Herrick has been asked to attend the Planning Board Meetings. The meetings
are held on the second and fourth Mondays of each month at 7:15 p.m.
Appreciation of the Month.
Mr. Shattuck stated the Town of Lansing residents should show their appreciation to our
firefighters for all the hours of training they go through and for putting their lives on the
line.
Assessment Meeting:
Mr. Shattuck stated that there was a full house at this meeting and the people of
Lansing felt they were getting "screwed" by the Assessment Department again. He felt
there is an unfair balance of the tax assessment and they are not doing a 100% evaluation
as they say they are.
Steve Farkas:
Salt Point:
The second salt point meeting will be held this coming Saturday and Mr. Krogh
has been asked to attend.
Shared services between the Municipalities and the County:
Shared services has been a topic at recent Tompkins County Municipal Officer's
meetings. There are three services, which are being looked into at this point. Mr. French
and Mr. Farkas will represent the Town of Lansing regarding the sharing of highway
services. Sharon Bowman will represent the Town in the sharing of health insurance. Mr.

Farkas stated that he was not in favor of a unified court system and that the only way he
would be in favor of any of it, is if the Town saw a decrease in taxes.
