The Lansing Town Board :met in Special Session at the Lansing Town Hall with
Supervisor Farkas presiding.
The Supervisor called the meeting to order and had the clerk take the Roll Call.

The Supervisor lead all present in the Pledge of Allegiance.
VISITORS: Jack French, Connie Wilcox, Dave Herrick, Dick Platt, Floyd Ferris, Randy
Swearingen and one other resident.
DAVE HERRICK - TOWN ENGINEER:
Mr. Shattuck read Par II of the Short Environmental Assessment Form in regards to
Water 17, Extension 10 (Rick Pinney). Mr. Shattuck answered all the questions asked on the
form to all present. The following resolution was then adopted:
RESOLUTION, offered by Mr. Shattuck and seconded by Mr. McEver:
WHEREAS, the Town Board of the Town of Lansing received a request for a back lot
water district extension for a parcel of land at 24 Ross Road located in the Town of Lansing,
being a portion of tax map parcel 21-1 -18.4, to receive a water line connection to Water District
17 through an easement over an adjacent property on Ridge Road, and the matter has been
presented for the establishment of a Water District in said Town to be known as Water District
17, Extension 10; and
WHEREAS, the Town Board of the Town of Lansing, having been designated as the
lead agency for conducting environmental review of the proposed project, and having conducted
such environmental review and after due deliberation having made a negative declaration of
environmental impact; and
WHEREAS, the Lansing Town Board having conducted said State Environmental
Quality review, reviewed the proposal in light of the Town's policy on back lot water district
extensions and held a public hearing; where no comment in opposition to the proposal was
received; therefore, it is
RESOLVED, that the Town Board of the Town of Lansing hereby finds that the
proposed Water District 17 Extension 10 complies with the requirements of the New York State
Environmental Quality Act and therefore makes a negative declaration of environmental impact;
and it is further
RESOLVED, that the Town of Lansing Town Board hereby shall allow the application
for the formation of a new water district extension across a back lot, to be designated as Water
District 17 Extension 10 to provide service to a parcel of property at 24 Ross Road, being Tax
Map Number 23. -1 -18.4 in the Town of Lansing.

mentioned is allowed to be constructed, the service therein mentioned to be provided for; and it
is
FURTHER RESOLVED, that such district extension shall be designated and known as
the "Water District 17 Extension 10" and shall be bounded and described as all of the properties
being Tax Map Parcel 23. -1 -18.4, located at 24 Ross Road in the Town of Lansing, to run
through an easement over the adjacent property on Ridge Road in said Town, and it is
FURTHER RESOLVED, that the proposed improvement, including costs of rights of
way, construction costs, legal and engineering fees and all other expenses shall be financed by
the owner of Tax Parcel 23. -1 -18.4; and it is
FURTHER RESOLVED, that this Resolution is not subject to approval by the New
York State Department of Audit and Control; and it is
FURTHER RESOLVED, that the Town Clerk of the Town of Lansing is hereby
authorized and directed, pursuant to Town Law Section 209 -g, to file this Order with the
Tompkins County Clerk.

Meg Overstrom stated that she has spoken to Jeffrey Harrison of Autumn Ridge Circle
regarding the letter he wrote to the Highway Department complaining about snow removal. Mr.
French explained the situation to the Board and stated that his department did the best job they
could have done with the weather conditions.
Mrs. Overstrom did not feel that Mr. Harrison wanted to go through with his request to
come before the Board. Mr. French felt it should be handled through his department.
A copy of Notice of Public Hearing having been furnished by the Town Clerk, the Public
Hearing on the proposed fees schedule for Electrical Inspections was called to order. Mr. Platt
and Mr. Ferris discussed the proposed schedule with the Board. All persons desiring to be heard,
having been heard, the Public Hearing was closed.
RESOLUTION, offered by Mr. Shattuck and seconded by Mr. McEver:
WHEREAS, pursuant to New York State Law, the Town of Lansing has adopted a local
law providing for the administration and enforcement of rules and regulations related to electrical
installations; and
WHEREAS, by Local Law #2 of the year 1985, the Town of Lansing has adopted the
National Electrical Code to govern all electrical installations in the Town of Lansing; and
WHEREAS, the Town of Lansing wishes to consider the amendment of Local Law #2 of
the year 1985, to require that all electrical installations in the Town of Lansing be conducted by
the Town Electrical Inspector pursuant to the requirements of the National Electrical Code, and
to allow the Town of Lansing to be reimbursed for the costs of conducting such inspections; and
WHEREAS, a Notice of Public Hearing was duly noticed and held on February 5, 2003
at 7:15 p.m. at the Lansing Town Hall to receive public comment regarding the amendment of
the Local Law #2 of 1985 providing for the appointment of a Town Electrical Inspector and

PUBLIC HEARING - WATER DISTRICT 17, EXTENSION _10:
A copy of Notice of Public Hearing on proposed Water District 17, Extension 10, having
been furnished by the Town Clerk, the Public Hearing was opened at 7:05 p.m.
Mr. Herrick explained that the proposed water district extension would accommodate the
existing house on Ross Road and possibly another one family home in the future.
All persons desiring to be heard, having been heard, the Public Hearing was closed and
the following resolution offered:
ORDER AND RESOLUTION OF THE TOWN BOARD,
TOWN OF LANSING
ESTABLISHING WATER DISTRICT 17 EXTENSION 10
RESOLUTION, offered by Mr. McEver and seconded by Mrs. Greenly:
WHEREAS, request for a back lot water district extension for a parcel of land at 24 Ross
Road located in the Town of Lansing, being a portion of tax map parcel 23. -1 -18.4, to receive a
water line connection to Water District 17 through an easement over the adjacent property on
Ridge Road, had been presented to the Town Board of the Town of Lansing, along with the
necessary map, plan, and report for the establishment of a Water District in said Town to be

WHEREAS, an order was duly adopted by the Town Board on January 15, 2003, reciting
the improvements proposed, the boundaries of the proposed district and the estimated expense
thereof and specifying the 5th day of February, 2003 at 7:05 p.m. as the time and the said Town
Hall in the said Town of Lansing as the place where the said Board would meet to consider the
proposed water district extension and to hear all persons interested in the subject thereof,
concerning the same and said Order setting a public hearing was published and posted as
required by law; and
WHEREAS, the Notice of :Public Hearing published and posted identified the proposed
Water District as, and will hereafter be known as " Water District 17 Extension 10 "; and
WHEREAS, a hearing in the matter was duly held by the Board on the 5th day of
February 2003, commencing at 7:05 p.m. at the Town Hall in the said Town;
NOW, upon the evidence given upon such hearing, it is hereby
RESOLVED AND DETERMINED, that
(a) the petition, map, plan and report comply with the requirements of Sections 191 -a
and 192 of the Town Law and the notice of hearing was published and posted as required by
law, and are otherwise sufficient;
(b) all the property and property owners within the proposed district extension are benefited
thereby;
(c) all the property and property owners benefited are included within the limits of the
proposed district extension; and
(d) it is in the public interest to establish the Water District 17 Extension 10; and it is
FURTHER RESOLVED AND DETERMINED, that the establishment of a water
district extension as proposed in said petition be approved; that the improvement therein

authorizing the Town Board to prescribe a schedule of fees for electrical, inspections; and
WHEREAS, the fee schedule was presented at the Public Hearing and no member of the
public was heard to complain or otherwise express a contrary opinion to the proposed fee
schedule; and
WHEREAS, after review and discussion of each proposal, and after a review of the
results of the Public Hearing, the Town Board of the Town of Lansing has hereby
ORDERED and RESOLVED, that the Lansing Town Board hereby authorizes the
appointment of a Town Electrical Inspector; and it is further
ORDERED, and RESOLVED, that the Lansing Town Board hereby establishes the
requirement that all electrical installations in the Town of Lansing be conducted by the Town
Electrical Inspector pursuant to the requirements of the National Electrical Code, and to allow the
Town of Lansing to be reimbursed for the costs of conducting such inspections; and it is further
ORDERED and RESOLVED, that pursuant to Local Law #2 of the year 1985, the
Lansing Town Board does hereby adopt the following Fee Schedule for electrical inspections:

Additional Inspections
When the office or inspector sends the applicant a written notice of a defect of defects found during the original
inspection and the applicant or his agent reports the defect(s) have been removed, and after the second inspection the
inspector reports the defect(s) have not been corrected, a charge of $20.00 will be made for each additional
inspection.

RFP AUDIT SERVICES FOR THE TOWN OF LANSING.
Mr. Shattuck stated that he was concerned that we may not be comparing apples to apples
but he does not want to dely the hiring of an accountant. Mrs. Overstrom stated that it was
interesting how one could charge a flat fee and others did not. She stated that she would like to
hear from others as to what they think of our current C.P.A. She felt that Mrs. Bowman should be
contacted with her input. When asked what Sharon's feeling were on this subject, Mr. Farkas
stated that there have been no problems with audits done by the Comptroller's Office. He also
stated that Mrs. Bowman and Mrs. Nabinger rely on the Comptroller's Office for answers to their
questions.
Mr. McEver thought a questions period between Andy LaVigne and the Ciaschia Firm
could take place to see why there is a $ 1,500.00 difference.
After some discussion, the following resolution was offered:
RESOLUTION, offered by Mrs. Overstrom and seconded by Mrs. Greenly:
WHEREAS, the Town of Lansing solicited proposals from qualified accountants for the
conduct of financial audits of the accounts maintained by the Town of Lansing Supervisor, Town
Clerk and Town Court; and
WHEREAS, a Request for Proposal for Audit Services was duly advertised stating that
the Town of Lansing would consider proposals from qualified accounting firms and accountants
that were received on or before noon on January 15, 2003; and
WHEREAS, proposals were received from Andrew N. LaVigne, Sciarabbla Walker &
Co. LLP, and Ciaschi Dietershagen Little & Mickelson LLP, and
WHEREAS, after review and discussion of each proposal, the Town Board of the Town
of Lansing has hereby
RESOLVED, to accept the bid proposal submitted by Andrew N. LaVigne to provide

AMTEK - DRUG AND ALCOHOL POLICY•
RESOLUTION, offered by Mr. McEver and seconded by Mr Shattuck:
WHEREAS, the Town of Lansing has participated in the development of a joint drug
and alcohol testing program through its advisors, and
WHEREAS, the Town Board wishes to revise its drug and alcohol testing procedures
while still using the Tompkins County drug and alcohol testing program for employees who hold
commercial drivers licenses; and
WHEREAS, by Resolution dated August 21, 2002 the Lansing Town Board voted to
retain Amtek, Inc. to assist in drafting a new Town of Lansing drug and alcohol policy for use in
conjunction with the Tompkins County drug and alcohol testing program; and
WHEREAS, Amtek, Inc. Had completed a Drug and Alcohol Policy, which has been
reviewed and approved by the Lansing Highway Supervisor and other Officials of the Town; and
WHEREAS, after review and discussion of each proposal, the Town Board of the Town
of Lansing has hereby
RESOLVED, that the Town Board of the Town of Lansing accepts and adopts as Town
Policy the Drug and Alcohol Policy as prepared by Amtek, Inc.

INTERMUNICIPAL WASTEWATER AGREEMENT:
Mr. Shattuck had question with numbers 6, 8 and 12. After a lengthy discussion, it was
the consensus of the Board that the Draft Agreement was suitable and it could be included in the
Draft Environmental Impact Statement. It was felt this could go to the D.E.I.S.
Mr. Farkas stated that Tompkins County Personnel Department has no such item as a
truck driver. Therefore, the Town plans to establish a new title of Laborer which would be a
probationary position. Anyone coming into this position would have to hold a CEO permit and
within six months would have to obtain a CEO license. The next level would be MEO. The
Town would like to establish 5 Laborer positions and 5 MEO positions (not all will be filled at
this time).
RESOLUTION, offered by Mrs. Greenly and seconded by Mr. Shattuck:
WHEREAS, the Town is re- naming employee positions so as to have job titles and
descriptions match those of the County, at the recommendation of the Town's consultant, and

WHEREAS, the purpose of matching job titles is to promote a consistent and logical
employment structure for civil servants and other employees for the Town, and accordingly, and
WHEREAS, the Town has current positions designated as Truck Driver, and there is no
such designation by or corresponding position in the Tompkins County job titles, nor in the
Tompkins County's hiring guidelines and job descriptions, and
WHEREAS, the Town desires to create the necessary positions to fill anticipated needs
for the coming 12 -24 months, even though some of said positions will remain unfilled and
unfunded, and
WHEREAS, after review and discussion of each proposal, the Town Board of the Town
of Lansing has hereby
RESOLVED, that 5 positions of Laborer be and are hereby created, and 8 positions of
Machine Equipment Operator be and are hereby Created, and the Town Board reserves the right
to classify or re- classify existing affected employees consistent with current Town probationary
practices, employment practices, and job requirements.

APPROVE MINUTES OF JANUARY 15, 2003:
A copy of the minutes of January 15, 2003, having been furnished to the Board
beforehand, the Supervisor asked for a motion to make corrections or to accept the same as
submitted.
RESOLUTION, offered Mr. Shattuck and seconded by Mrs. Greenly:
RESOLVED, that the minutes of January 15, 2003 are hereby approved with the
following corrections:
1. On the second to last page, second to last paragraph, it should read "their" building,
not "there" and
2. On page three it states that the Town Board burnt and should read Town Barn burnt.
Carried.
PENNY'S LAW:
Mr. Farkas stated that he has received a letter from Candy Brown asking for the Town
Board of the Town of Lansing to authorize Mr. Farkas to have the Town of Lansing added to a
list of Agencies and Officials of Legslitative Bodies who fully support the Penny's law that seeks
to enable a Juvenile convicted of second degree murder as an adult, to also be sentenced as an
adult.
RESOLUTION, offered by Mr. Shattuck and seconded by Mr. McEver:
WHEREAS, the Board has received a letter from Candi Brown, a non - resident, seeking
the Town of Lansing's support for the passage of Penny's Law, named for a teenager killed in
Salamanca, New York by a juvenile who was tried as an adult but sentenced as a juvenile, and
WHEREAS, said Candi Brown was the victim's mother and is lobbying for the passage
of Penny's Law, which will require that those tried as adults be sentenced as adults, and

WHEREAS, after review and discussion of each proposal, the Town Board of the Town
of Lansing has hereby
RESOLVED, that the Town of Lansing is in favor of Penny's Law and believes that
those tried as adults should be sentenced as adults.
The vote being four yeah and one neigh in favor of passage, Meg Overstrom being the
sole neigh vote.
Carried.
BOARD MEMBER REPORTS:
DOUG MCEVER .
There have been no meetings in the past two weeks.
MEG OVERSTROM:
The Lansing Housing Authority honored Louis Emmick for his devotion to the Lansing
Housing Authority and to Woodsedge for many years. Barbara Blanchard may be doing a market
study to determine whether a second building like Woodsedge is needed. She will be back at the
end of the month to propose what type of study she would like to do.
KATRINA GREENLY:
Nothing to report.
FRANCIS SHATTUCK:
Personal Water Craft:
Mr. Shattuck stated that Mr. Farkas had done some research regarding the County
wanting to control personal water craft on the lake.
He stated that Mr. Farkas contacted the Association of Towns and a ruling came back
that, yes a County can create jouristional control over certain things but they cannot control what
type of water craft goes out on the lake.
Everyone was pretty close to agreement on the hours of operation and the speed to the
lake other than the middle of the lake.
Hazard Mitigation:
A meeting will be held tomorrow at 1:00 but Mr. Shattuck will not be able to attend it.
He felt the Town may be able to share the cost. It may go from $ 60,000.00 as ordinally thought
to $ 753000.00. It has gone from 5 townships to 8 and also some Villages.
Comprehensive Plan:
Mr. Shattuck and Mrs. Nancy Loncto are the reps. for the Town and Village of Lansing.
Railroad Taxes:
Per Herb Beckwith, the Railroad taxes will be cut in half as Mr. Pataki has signed a bill to
this effect.
Planning Board•
The Town Board wants all of the proposed changes by April 1, 2003. The Planning Board
has agreed to this date. They should be ready for the Board to look over at the March meeting.

Public Hearings may start in May of 2003.
ZBA Board:
The Zoning Board of Appeals has turned down Mr. John Hicks' proposal on subdividing
land on Waterwagon Road
STEVE FARKAS.
Bingo Parlor.
Mr. Farkas has received a letter from the Supervisor of another Townwhere a large Bingo
Parlor is planned for construction. He asked the Town of Lansing to express their concerns to
State and Federal Officials. Mr. Farkas felt it was a personal choice and not a Town choice.
Ottenschott Property:
The Town of Lansing is in the process of completing negotiations on the purchase of the
Ottenschott property on Ridge Road. Mr. Farkas has signed an offer that is over what the asking
price of the property was. If an underground tank is found, the Town may have to pay half of the
cost to have it removed. Mr. French has looked into this and cannot find an underground tank
anywhere on the property.
Mr. Shattuck stated that the BAN of the property comes due March 28, 2003 and felt the
closing date should be set before that date.

Due to the Conference in February, the Regular Meeting will be held on February 20th,
