Adjournment. 204 January 15, 2003 The Lansing Town Board met in Regular Session at the Lansing Town Hall Board Room at 7:00 p.m. with Supervisor Farkas presiding. The Supervisor called the :meeting to order and had the clerk take the Roll Call. Oki -DIMU YEAR 2003 AGREEMENT TO SPEND HIGHWAY FUNDS TOWN OF LANSING County of Tompkins Pursuant to the provisions of Section 284 of the Highway Law, we agree that moneys levied and collected for the repair and improvement of highways, and received from the state for the repair and improvement of highways, shall be expended as follows: 1. GENERAL REPAIRS: The sum of $287.383 may be expended for general repairs upon 91. 64 miles of town highways, including culverts and bridges having a span of less than five feet. 2. IMPROVEMENTS: The following sums shall be set aside to be expended for the improvement of town highways: (a) On the road CHELSEA'S WALK (entire) from Bush Lane to Cherry Rd. SAID AGREEMENT WAS SIGNED BY Water main Break Jack French, Highway Superintendent Stephen Farkas, Town Supervisor Francis Shattuck, Town Council Katrina Greenly, Town Council Meg Overstrom, Town Council Douglas McEver, Town Council There was a water main break on Craft Road in the Village of Lansing today. The break has been repaired. Parked Cars on Roads Mr. French has asked attorney Rich John to add on to the 1958 policy of parked cars on 206 January 15, 2003, continued roads. He has asked that an update to charge current towing and storage fees be added. Mr. John is working on this update and will bring it to a future meeting. Mr. French stated that it is against the law to plow snow across a highway. The Town doesn't have to pass a policy because it is against the law and can be reported to the Sherriff's Department, Mr. French reported that the winter of 2001 -2002 from October - March they used 1950 tons of salt in the amount of $50,385. The first pay period of the month they recorded 9 hours of overtime. This winter they have plowed and salted 23 days in a row. So far from October to January 1 st they have used 3,201 tons of salt in the amount of $83,066 with 2 '/2 months of winter to go. The price of salt has gone down from last year. The first pay period of this year they have recorded 49 hours of overtime. Mr. Farkas, Mr. McEver and Mr. French met this morning with John Lapman and Pete Mesmer from Tompkins County Highway, Tom Todd and Barbara Blanchard from the County Board. They talked about putting the flashing light back up on the Asbury Road intersection. They were all against this. Mr. French suggested that they put up a flashing yellow light on the stop ahead sign on Asbury Road. Mr. French believed they were going to do this. The County agreed to aggressively deal with the State on reducing the speed limit to 45 mph. The County will also look at the double solid line on this road. By law if there is at least 500' of site distance there can't be a double solid line. The Sheriff also needs to patrol this. rig Mr. Shattuck informed the Board that the Town of Sterling has had their roof cave in on their Town Barn and has built a new one. They have since then had a fire and their Town Barn has burnt. There had been talk in the past about installing an alarm system at the Town Barn that would be directly wired into 911. Mr. French will look into this and report back at the next meeting. "A. 11-04MMR TG Miller has completed the SEQR Short EAF and a map of the proposed extension. A public hearing should be scheduled for early February, if acceptable. The SEQR statement will be reviewed at the hearing together with a determination of significance. RESOLUTION, offered by Mr. Shattuck and seconded by Mrs. Greenly: WHEREAS, the Lansing Town Board, having received a request for a back -lot water district extension for a parcel of land at 24 Ross Road, being a portion of tax map parcel 23. -1- 18.4, to receive a water line connection to Water District 17 through an easement over the adjacent property on Ridge Road; and WHEREAS, the Lansing Town Board, having conducted a State Environmental Quality review, reviewing, the proposal in light of the Town's policy on back lot water district extensions and wishing to hold a public hearing to receive comment on the proposal; therefore, it is hereby RESOLVED, that the Town Board of the Town of Lansing, hereby schedules a public hearing to receive public input on the proposed back lot water district extension to be held on 207 January 15, 2003, continued February 5, 2003 at 7:05 p.m. at the Lansing Town Hall. (Aye) Stephen Farkas, Councilperson Straub Back -Lot Water Servie Request Mr. Straub has confirmed his continued interest in obtaining public water even though he has connected his new building to the existing well. He contacted many of the adjacent landowners regarding a formal Town extension project and most indicated an interest in learning more about the costs. Eisenhut (large landowner to the north of Marion Lane) has notified TG Miller that they would be considering a realty subdivision sometime in the future and would like the opportunity to extend public water. As such, it would be wise to consider at least an 8" main on Marion Lane. Mr. Herrick asked if the Board will require a formal petition from the Marion Lane area before authorizing a feasibility study. Mr. Herrick will get in touch with Mr. Straub and let him know he needs to get a formal petition to the Board. Back -Lot Water Service and Subdivisions Mr. Farkas stated that he doesn't know if anything has been formalized in regards to the homeowner being responsible for fees for services and advertising related to an extension but Mr. Herrick will look into this. It was also suggested that this apply to subdivisions. Mr. Shattuck stated that it has been illegal for the Town to do it in the past and that the Town has been doing it wrong and it needs to be corrected. Mr. Shattuck stated that he doesn't think that the Town can use town wide money to do work on specific subdivisions or back -lot water extensions that don't benefit the whole Town. It was recommended that it be put in the fee schedule. Mr. Farkas asked that it be put altogether by March and hold a separate Public Hearing. Once the fee schedule is accepted it could always be amended. Storm Water System Planning and Maintenance SPDES General Permit for MS4's The workshop series at Syracuse University on January 7th was postponed pending more revisions in the State's new permit. The Cornell Cooperative Extension will be hosting a seminar for municipal officials and staff on January 22nd. TG Miller will be attending representing Lansing (T) as and engineer. Sanitary Sewer System Planning and Maintenance Intermunicipal Sewer Committee Recent developments between the SJS partners have slowed the development of the "business plan" agreement. Any diversion from the northeast area (Town of Ithaca) to the IAWTP will require an amendment in the current SJS agreement. There is apparent reluctance in the City to oblige this amendment until cost sharing of historical improvements is rectified. Any further negotiations with the VCH have been delayed. Issues still facing the Town of Lansing with respect to treatment at VCH include: 1. Will the Town expect to become an owner /partner in the VCH plant? 2. If there is no partnership in VCH then what assurances will the Town require so that another moratorium won't occur? 3. A new agreement must be considered for long -term treatment at VCH. Does the Town want to continue as a 1.5x rate customer? 4. Will the Town be expected to subsidize VCH and Ithaca (T) for the apparent lack of system maintenance (I &I) and overextended customer base, which is necessitating the immediate diversion of 0.738mgd? 208 January 15, 2003, continued The USDA Rural Development has forward the current pre - eligibility determination application for the Town to process and return. The emphasis should be to obtain grant funds to bridge the difference between the current EDU cost ($721 +) and the State Comptroller's threshold (now at $525, down from $569 in 2002). Will the Board authorize TG Miller et. al. To complete the necessary forms? Estimated preparation cost is $2,500. After some discussion the following resolution was hereby adopted: RESOLUTION, offered by Mr. McEver and seconded by Mrs. Overstrom: WHEREAS, the Town Board of the Town of Lansing authorizes Town Engineer David Herrick of TG Miller to apply and complete the necessary forms for the USDA Rural Development Grant. (Aye) Stephen Farkas, Councilperson Subdivision Regulations Both Jack French and Dave Herrick suggest a change in the Town's approval or realty subdivision utilizing "private roads ". If there is concurrence with the Board's can a process begin to amend the subdivision? Mr. Herrick stated that the subdivision application should be based on the concept of a Town road only where the frontage is going to be required to service the property. Mr. Shattuck stated that now any other drive that has a multiple use is now being built to Town standards. Mr. French stated that the one on Collins Road is not being built to Town standards. Mr. Shattuck stated that it was being built to Town specs and they have had the engineer twice and they have agreed to build it to Town standards. Whatever the standards are that Mr. French and the engineer gave them. Mr. French heard that they got around this because it is more or less going to be a private driveway with other driveways going off of that. Mr. Shattuck stated no. There is only going to be one driveway going back that will be shared and they were told it had to be built to Town standards. Mr. French questioned that and he was told that was the way they got around that. That only one person was going to own that driveway and other driveways were going off it. Mr. Shattuck stated no, he attended all the Planning Board meetings and the engineers were there and they have to build it to Town standards. Mr. French stated the permit was issued for one driveway only. Mr. Platt stated they gave the owner Town specs, told him it didn't have to be paved and that it would never be a Town road. Mr. French stated that was the problem, that they were told it never would be a Town road. Mr. French stated there is going to be 5 houses up there and Mr. Shattuck stated only 3 houses. Mr. Shattuck stated there are only three side by side driveways. Mr. French stated there are five lots there. If they were putting into that permit that it will never be a Town road then how can we enforce it. Mr. French asked the Board if he was suppose to go there and inspect the road at certain times and how do you know if they are putting it in to Town specs or not? Mr. Shattuck stated that we get to inspect the road before a Certificate of Occupancy is given to the main house. Mr. French asked who is we? Mr. Platt stated that we are not inspecting it as the road is being built. Mr. Shattuck stated that you do not get a Certificate of Occupancy until they have fulfilled everything within there subdivision. Mr. French stated that when he inspects a Town road he has certain procedures he follows and that is not going to happen on this road. Mr. McEver stated it should. The rules were specifically passed last year to make private roads all to Town specs. After further discussion Mr. Herrick and Mr. French will meet with the Planning Board on this issue. 200 January 15, 2003, continued Reimbursement for Professional Services Historically, the costs for subdivision application reviews and benefit district studies incurred by professionals have been covered by general funds. Benefit districts actually established will "refund" the general fund. For those that are not formed, and for subdivision reviews, the Board may wish to consider some mechanism for reimbursement. This was also discussed previously in the meeting. CODE ENFORCEMENT OFFICE REPORT - DICK PLATT Monthly Report Mr. Platt handed out the monthly and year end report. He stated last year they issued 207 permits and 13,113,065 in cost of construction. December 2002 - up 6 permits from last year and up in project costs $1,822,381. i• i Mr. Platt informed the Board that Wes McDermott has a plan in place to demolish the white house and hopefully he won't have to take him to court. SCHEDULE OF FEES FOR BUILDING PERMITS RESOLUTION RESOLUTION, offered by Mrs. Greenly and seconded by Mr. Shattuck: WHEREAS, pursuant to New York State Law, the Town of Lansing has adopted a local law providing for the administration and enforcement of rules and regulations related to fire prevention and construction; and WHEREAS, by Local Law #3 of the year 1984, the Town of Lansing Town Board is authorized to adopt a Schedule of Fees for building permits and permits issued pursuant to the Uniform Fire Prevention and Building Code; and WHEREAS, pursuant to Local Law #3 of the year 1984, the Town of Lansing Town Board is authorized to adopt a Schedule of Fees for building permits and permits issued pursuant to the Uniform Fire Prevention and Building Code; and WHEREAS, the Town of Lansing wishes to consider the amendment of the Schedule of Fees adopted for building permits and permits issued pursuant to the Uniform Fire Prevention and Building Code to allow the Town of Lansing to be reimbursed for the costs of issuing such permits and conducting such inspections; therefore it is ORDERED and RESOLVED that pursuant to Local Law #3 of the year 1984, the Lansing Town Board does hereby adopt the following Schedule of Fees for building permits and permits issued pursuant to the Uniform Fire Prevention and Building Code: BUILDING PERMIT FE 'c!, Residential: $0.30 /sq. ft. for: one and two family residences, modular homes, mobile homes, multiple housing and additions. W�.I - _ He has attended a Water Resource Committee meeting. They are now in the process of putting people on new committees. He is on the Grants and Finance, RPP Storm Water Ordinances and RPPIO Implemation Committee with County Representatives. She attended the Fire Commissioner's meeting and Dale Oplinger was re- elected as Fire Chief. There has been a lot of renovations in the various fire houses. In December they spent $80,000 in maintenance and repairs. Steve Farkas and herself met with Better Housing and the grant writer. They recommend that the Town resubmit the application for the grant. They will do that. The library is still waiting for the money ($50,000) for renovations from the County. The County's follow up to initiative last year is to work on the County Comprehensive Plan. They have approached the communities and Municipal Officials Association about sending representatives from the community, a Board member and Planning Board member that they would engineer. The Municipal Officials Association told them thanks, but no thanks, they want to send their own committee. There is a committee structure that all the municipalities that attend the Municipal Officials Association have agreed to send a Town Board member and Planning Board member. The reps from Lansing are himself from the Town Board and Nancy Loncto from the Planning Board. They have had there first meeting and met with the Planning Commissioner and Deputy and talked about frame work. The meetings will be the last Wednesday at 4 :15 of every month. The Planning Board met this week. There are two major requests. The Montorssori School has approached the Rink about adding on to there building and utilizing their parking. The addition would be on the westside of the building. The preliminary plans have been approved. The Industrial Park behind the Town Hall has asked about the possibility of putting in apartment houses. In the new zoning regulations they are looking for a denser population. We haven't defined what that density is yet. A high level apartment houses would be appropriate. 213 January 15, 2003, continued They talked about the Town Center's Plan, etc. NEW ZONING PROPOSALS They have now been working on the new zoning proposals for three years. The Board agreed that these should be instituted this year. After further discussion the Board will inform the Planning Board that the new zoning proposals need to be submitted to the Town Board by April 292003, Steve Farkas Mr. Farkas recommended that Mr. McEver be appointed to the Water Resource Council, Water Resource Council RESOLUTION, offered by Mr. Shattuck and seconded by Mrs. Overstrom: RESOLVED, that the Town Board of the Town of Lansing does hereby appoint Douglas McEver to the Water Resource Council.
