Any other Business that might come before the Board 89 Board Member Reports 90 Executive Session of needed 100 Adjournment February 27, 2002 The Lansing Town Board met in Special Session at the Lansing Town Hall Board Room at 7:00 p.m. with Supervisor Farkas presiding. The Supervisor called the meeting to order and had the clerk take the Roll Call. Mr. Farkas lead all in the Pledge of Allegiance. PUBLIC HEARING - BETTER :HOUSING GRANT: Mr. Carlson passed out a fact sheet to all Board Members. Himself and Stacy Crawford went over the fact sheet with the Board. Mr. Carlson stated that the Town can apply for up to $ 400,000.00 through the Small Cities Program and that the dead line for all applications is April 12, 2002. Stacy Crawford stated that approximately 150 surveys were sent out and about 80 have been returned stating they were interested. It was stated that the Village of Lansing is not included in this survey. HUD guidelines are used qualifying residents for this program. Mr. Shattuck asked if people in mobile homes were included. Mr. Carlson stated that, at this point in time, the priority is with permanent structures. One more Public Hearing will be held on March 20, 2002 at which time a resolution will need to be passed to accept the grant. On motion, the Public Hearing was closed at 7:26 p.m. PUBLIC HEARING - LIVING QUARTERSIDISABLED: After some discussion, it was decided to take no action on this and to republish the Public Hearing to include disabled persons. The following resolution was then offered: RESOLUTION, offered by Mr. Shattuck and seconded by Mrs. Greenly: WHEREAS, New York State has recently added Section 469 to the Real Property Tax Law to create a tax exemption for increased assessed values of residential property, where the increased value is due to construction or reconstruction of living quarters for parents and grandparents; and WHEREAS, Section 467 -d to the Real Property Tax Law creates a tax exemption for increased assessed values of residential property, where the increased value is due to construction or reconstruction of living quarters for individuals who are considered disabled and receiving social security benefits; and WHEREAS, the Lansing Town Board believes such tax exemptions will provide some assistance to families who wish to have a parent or a disabled person reside with them as well as to improve properties and the housing stock within the Town of Lansing; and WHEREAS, the Town of Lansing may pass a local law to adopt these tax exemptions by local option pursuant to the New York State Home Rule Law, and the text of the proposed Local Law is as follows: 47 Continued, February 27, 2002 Be it enacted by the Town Board of the Town of Lansing as follows: Section 1. This Local Law shall be entitled " Local Law No. 1 of the Year 2002" and shall authorize a Property Tax Exemption for Living Quarters for Parents and Grandparents Age 62 or Older, and for individuals who are considered Disabled and Receiving Social Security Disability Benefits, which shall read as follows: Exemption: Pursuant to Sections 467 -d and 469 of the Real Property Tax Law, there shall be an exemption from taxation to the extent of any increase in assessed value of residential property resulting from the construction or reconstruction of such property for the purpose of providing living quarters for a parent or grandparent who is sixty -two years of age or older, and for individuals who are considered disabled and receiving social security disability benefits. Such exemption shall not exceed (a) the increase in assessed value resulting from construction or reconstruction of such property, or (b) twenty percent of the total assessed value of such property as improved, or (c) twenty percent of the median sale price of residential property as reported in the most recent sales statistical summary published by the states board for the county in which the property is located, whichever is less. Section 2. No such exemption shall be granted unless the residential property so constructed or reconstructed is the principal place or residence of the owner. Section 3. This local law shall take effect upon filing with the Secretary of State. WHEREAS, the Town Board of the Town of Lansing wishes to receive public input on the proposed local law; therefore, it is RESOLVED, that the Town Board of the Town of Lansing hereby schedules a public hearing to receive public input on the proposed local law to be held on March 20, 2002 at 7:15 p.m. at the Lansing Town Hall. (Aye) Stephen Farkas, Supervisor JACK FRENCH - HIGHWAY SUPERINTENDENT: A bid opening was held on February 21, 2002 for a 2003 10 -Wheel Truck and Cab Chassis, a Heavy Duty Dump /Spreader Box and Snow Removal Equipment Assembly for a 10 -Wheel Truck. Mr. French looked over all bids and gave his recommendations. The following resolution was then offered: RESOLUTION, offered by Mr. Shattuck and seconded by Mrs. Greenly: WHEREAS, the Town of Lansing, upon the recommendation of the Town Highway Superintendent, issued a Request For Bids for the Town Highway Department to purchase one ten wheel dump truck, and WHEREAS, the Town Highway Superintendent having reviewed the bid submissions and indicated to the Town Board that the bid of $ 74,897.40 submitted by Beam Mack Sales and Service Incorporated of Elmira was the lowest bid received and satisfied the requirements of the Request For Bids; therefore, it is hereby RESOLVED, that the Town of Lansing Town Board hereby accepts the bid submitted by Beam Mack Sales and Service Incorporated of Elmira to sell to the Town of Lansing Highway Department one ten wheel dump truck for an amount of $ 74,897.40, said truck to be delivered to the Town of Lansing Highway Department by June 1, 2002, and authorizes the execution of all HIS Continued, February 27, 2002 necessary documents to accomplish such purchase by the Town Supervisor and Highway Superintendent. (Aye) Stephen Farkas, Supervisor RESOLUTION, offered by Mrs. Greenly and seconded by Mr. Shattuck: WHEREAS, the Town of Lansing, upon the recommendation of the Town Highway Superintendent, issued a Request For Bids for the Town Highway Department to purchase snow removal equipment, and WHEREAS, the Town Highway Superintendent having reviewed the bid submissions and indicated to the Town Board that the bid of $ 22,856.00 submitted by Transmission Repair Service Incorporated of Syracuse was the lowest bid received and satisfied the requirements of the Request For Bids; therefore, it is hereby RESOLVED, that the Town of Lansing Town Board hereby accepts the bid submitted by Transportation Repair Service Incorporated of Syracuse to sell snow removal equipment to the Town of Lansing Highway Department for an amount of $ 22,856.00, and authorized the execution of all necessary documents to accomplish such purchase by the Town Supervisor and Highway Superintendent. (Aye) Stephen Farkas, Supervisor MYERS PARK BOAT PARKING: Mr. John stated that Steve Colt was concerned with people taking up boat slips that did not belong to them and what action the Town could take. It was decided that the Town is already authorized to take action according to a previous Ordinance. Mr. Colt will discuss the problem with Scott Ferris who will issue tickets. The Board felt that a warning could be given at first and then the fine would be up to the judges. This will be discussed with Mr. Howell and Mr. Burin. Warning signs will be placed in the park to warn all boaters beforehand. W Continued, February 27, 2002 PLANNING BOARD: Mr. Shattuck stated that the Planning Board has hired a temp to merge all changes in the new proposal which will be given to Board Members by March 20th for their review. On April 3, 2002, the working meeting will be combined with the Planning Board to discuss the changes. The Planning Board will start going over the maps at Monday's meeting. DRUG AND ALCHOL POLICY - HIGHWAY DEPARTEMTN• Mr. French stated that Ronnie Travers informed him that the Company that is doing the testing should not be the one who writes the policy. She offered to write the policy for $ 1,500.00 which the Board felt was too much. The Board will look into what the County and the State have on their files. SAFETY ADVISOR= HIGHWAY DEPARTMENT: Mr. French stated that that Board should look into appointing a new safety advisor as Mr. Beckwith was it when he was a councilperson. Mr. Farkas will check with Mr. Beckwith to see if he would like to continue to be the advisor and get back to the Board. On motion, meeting adjourned at the call of the Supervisor at 8:05 p.m.
