March 22, 2000 The Lansing Town Board met in Special Session at the Lansing Town Hall Board Room at 12:00 p.m. with Supervisor Farkas presiding. Visitors: Tammy Aiken of T.G. Millers and George Totman, The Supervisor called the meeting to order and had the clerk take the Roll Call. She stated that Section 7 (method of financing) was the only change made. After some discussion, the following resolution was adopted: RESOLUTION, offered by Mr. Beckwith and seconded by Mrs. Overstrom: RESOLVED, that the Town Board of the Town of Lansing does hereby accept the revised Engineer's Report as presented by Tammy Aiken of T.G. (Aye) Stephen Farkas, Supervisor NOTICE TO ALL TOWN OF LANSING RESIDENTS NOTICE OF PUBLIC HEARING REGARDING THE ESTABLISHMENT OF WATER DISTRICT 179 EXTENSION NO.6 (Town Law 209 -d) At a meeting of the Town Board of the Town of Lansing, Tompkins County, New York held at the Town Hall in said Town of Lansing, Tompkins County, New York on the 22nd day of March, 2000, PRESENT: Stephen Farkas, Supervisor, Herbert Beckwith, Councilperson, Katrina Greenly, Councilperson; Meg Overstrom, Councilperson; and Francis Shattuck, Councilperson. ------------------------------------------------------------------------------------ In the matter of the Petition for the Establishment of a Water District Extension in the Town of Lansing, Tompkins County, New York. ------------------------------ - - - - -- -------------- ......... -------------- - - - - -- WHEREAS, a written petition in due form and containing the required signatures has been presented to and filed with the Town Board of the Town of Lansing, Tompkins County, New York for the establishment of a Water District Extension in said Town to be bounded and described as follows: The properties located on Lake Ridge Point along a private road known as Milliken Road Extension, being all those tax map parcels indicated on Schedule A to this Notice of Public Hearing and, WHEREAS, the construction proposed consists of the installation of approximately 400 CONTINUED March 22, 2000 linear feet of 4 inch ductile iron pipe connected to the 8 inch gate valve at the end of Milliken Station Road (Water District No. 17), together with appurtenant facilities including valves, fire hydrants and connections to the existing main, in accordance with a map, plan and report contained within an Engineer's Report prepared by the Town Engineer, which report is made a part of such petition and is now on file in the office of the Town Clerk of the said Town, and WHEREAS, the maximum amount proposed to be expended for the said Water District, as stated in the said petition, is the sum of Twenty-three Thousand Seven Hundred Fifty nd 00 /100 Dollars ($23,750.00), and with a one time payment by the residents for the typical property within the Water District is $2,532.00 plus the estimated average annual cost of water in the amount of $316.44, and estimated average one time hook -up fees for connection of the service line to the residence in the amount of $1,175.00, and the residents within the proposed Water District 17 Extension 6 being all in agreement; THEREFORE, upon the motion of Herbert Beckwith, and seconded by Francis Shattuck, and the vote being unanimous, it is hereby ORDERED, that a meeting of the Town Board of the said Town of Lansing shall be held at the Lansing Town Hall, Lansing, New York on the 5th day of April, 2000 at 7:00 in the evening of that day to consider the said petition and to hear all persons interested in the subject thereof concerning the same and for such other action on the vote of said Town Board with relation to the said petition as may be required by law or proper in the premises. No. 6 Tax Map Parcels 12.-1 -1 12. -1 -3 12. -1 -5 12. -1 -7 12. -1 -9 12. -1 -11 HOME RULE REQUEST: 12. -1 -2 12. -1 -4 12. -1 -6 12. -1 -8 12.-1 -10 RESOLUTION, offered by Mr. Beckwith and seconded by Mrs. Overstrom: WHEREAS, the Town of Lansing has made a request of the New York State Assembly and the New York State Senate for the enactment of a special law to make certain findings and determinations with respect to certain bond anticipation notes issued by the Town of Lansing, Tompkins County, New York, validating and legalizing the same, and authorizing the issuance of obligations with respect thereto, and WHEREAS, in connection therewith, the Town of Lansing is required to make a Home Rule Request that such special law be enacted, therefor, it is RESOLVED, that the Town Board of the Town of Lansing hereby directs the Town Supervisor and the Town Clerk to execute the home Rule Request form as required to make the Home Rule Request to the New York State Legislature on behalf of the Town of Lansing. (Aye) Stephen Farkas, Supervisor SEWER: Mr. Shattuck informed the Town Board that the Planning Board would like a priority list to go by in their meetings. He stated that the Planning Board will meet twice this month and possibly continue to meet more as time goes on. They will be discussing the area where the sewer line will go. Mr. Farkas stated that at a S.J.S. meeting that took place yesterday, Larry Frabroni had a map of the County where the sewer service area would be placed. He also stated that Lansing will not be in the first phase of the project. Hopefully, the Town will be provided with a copy of said map. LIBRARY COMMITTEE: Mrs. Greenly stated that there is now a Library Financing Grant Committee which is made up of volunteers who will be looking into the possibility of receiving grants. An Arts Grant is also being looked into for the new Board Room. Mr. Farkas felt it would be nice to show pictures done by local students, senior citizens, etc. BIDDING PROCESS FOR WATER DISTRICTS• Mr. John stated that under Section 103 of the General Municipal Law, it states that if the project is under $ 20,000.00, the advertising and sealed bids requirement is waived. PRIVATE ROAD SITUATION: Rick Page will be going in front of the Planning Board for consideration of his request to build a road off the end of Sovocool Road. Mr. John indicated to him, that the Town Board had considered the issue of it's policy on private roads and liked what New York State had said. Mr. John felt that the Town Board should give the Planning Board some direction on the private road issue so they can consider Mr: Page's application. Mr. John and Mr. Totman agreed that there should be requirements stating that there be reasonable access for emergency vehicles. This will be discussed with the Lansing Fire Chief. Mr. Totman stated that there is already a private road agreement in place and felt the only changed needed to be made would be a section that states only four (4) houses can be built on a private road. Mr. Beckwith will bring up this situation at the next Fire Department meeting. The following resolution was then adopted: RESOLUTION, offered by Mr. Beckwith and seconded by Mr. Shattuck: RESOLVED, that the Town of Lansing Town Board does hereby authorize and direct the Town Attorney to write a letter to the Town of Lansing Planning Board regarding private roads to make them aware that in a subdivision approval, there needs to be a condition that a letter to the developer from the Town be filed in miscellaneous records and referenced against any deeds that are sold for the property. Said condition will show that there may be an issue of emergency access. Carried. On motion, meeting adjourned at the call of the Supervisor at 1:OO;p.m. %i 1' L?
