The Lansing Town Board met in Special Session at the Lansing Town Hall Board Room
at 7:00 p.m. with Supervisor Kirby presiding.

The Supervisor called the meeting to order and had the clerk take the Roll Call.
Town Engineer Dave Herrick passed out and reviewed the proposed Water District No.
12, Extension No. 2.
Mr. Herrick stated that out of the 14 existing homes, 10 are for the district and 4 are
against the district. This is an 80% approval rating. Based on this rating Mr. Herrick
recommended to the Board that the next step would be to authorize a formal Engineer's Report.
Therefore the following resolution was thereby adopted:
RESOLUTION, offered by Mr. Beckwith and seconded by Mr. Cleveland:
RESOLVED, that the Town Board of the Town of Lansing does hereby authorize the
Town Engineer, David Herrick to prepare a formal Engineer's Report for the proposed Water
District No. 12, Extension No. 2.

Roger Van De Poet presented the Board with a petition containing 130 signatures from
area residents of Sunset Drive, Woodsedge Senior Apartments, owners and employees of the
businesses in the Lansing Business and Technology Park as well as families of children who play
sports at the local ball fields requesting a posted speed limit of 30 mph on Sunset Drive,
Woodsedge Drive and Cayuga Vista Drive,
Roger Van De Poet also requested that two stop signs be installed at the intersections of
Woodsedge Drive and Cayuga Vista Drive. He stated that the residents feel very strongly that
these measures are necessary to maintain neighborhood safety as many through traffic motorists
utilize these streets as a bypass to avoid the traffic light and busy intersection of Routes 34 and
34B. Mr. Van De Poel also requested that a curb be installed to protect the signs at the
intersection of 34B and Woodsedge Drive.

The Town Board agreed with Mr. Van De Poet. The Board will ask Mr. Larson for his
recommendation concerning the stop signs and the requested curb. The Town Board supports
the request for a reduction in speed limit and therefore the following resolution was thereby
adopted:
Upon receipt of a Petition by the residents of the Town of Lansing who reside on. Sunset
Drive, Woodsedge Senior Apartments, owners and employees of businesses in the Lansing
Business and Technology Park as well as families of children who play sports at the local ball
fields, and after due deliberation and discussion of the subject matter, the following Resolution
was made and unanimously passed by the Town Board of the Town of Lansing at a Special
Meeting of the Town Board held on October 06, 1999.
RESOLUTION, offered by Mr. Beckwith and seconded by Mr. Farkas:
BE IT RESOLVED, that the Petition of the residents of Sunset Drive, Woodsedge
Senior Apartments, owners and employees of businesses in the Lansing Business and
Technology Park as well as families of children who play sports at the local ball fields be
forwarded to the Commissioner of the Department of Transportation together with the Town
Board's request for a review of the speed limit on Sunset Drive, Woodsedge Drive and Cayuga
Vista Drive between New York State Route 34 and New York State Route 34B as shown in the
Petition and attached map filed in the Town Clerk's Office, and an appropriate reduction of the
speed limit from 55 miles per hour to 30 miles per hour.
BE IT FURTHER RESOLVED, that the Town Board supports the requested reduction
in speed limit to ensure the neighborhood and usage of the Town ball fields safety as many
through traffic motorists utilize these streets as a bypass to avoid the traffic light and busy
intersection of Routes 34 and 34B.

SCLIWC is presently charging a flat rate fee of $2.04 /1,000 gallons of metered water.
The Town O &M Surcharge of $0.95/1,000 gallons has been in effect since November
1998 and a full year's revenue with this surcharge has not yet been recorded. However,
total water consumption verified by Bolton Point for the period July 16, 1998 through
July 15, 1999 was approximately 130,267,100 gallons.
With the Town's surcharge at $0.95/1000 gallons a residential Customer quarterly
bill is as follows:
1999 - Minimum Bill (10,000 gallons) - $29.90
1999 - Average Bill (20,000 gallons) - $59.80
The proposed. new SCCLIWC flat rate for quarterly bills sent in 2000 will be $1.79/1,000
gallons. To generate $130,000 O &M revenue from strictly water rents the new Town
surcharge is calculated as follows:
Anticipated Minimum Consumption 2000 = 130,300,000 gallons
Town Surcharge = $130,000/130,300,000 gallons = $1.00/1,000 gallons
To generate additional revenue in excess of the 2000 expenses the surcharge could be as
follows:

RESOLUTION FOR SCLIWC WATER RATE CHANGE
RESOLUTION, offered by Mr. Beckwith and seconded by Mr. Farkas:
WHEREAS, the Town Board of the Town of Lansing has received proposals from the
Southern Cayuga Lake Intermunicipal Water Commission for the water rates to be set for the
cost of water per thousand gallons and,
® WHEREAS, the Town Board of the Town of Lansing has received proposals from the
Town Engineer for the component of the water rates to be set by the Town of Lansing for the
cost of operations and maintenance of the water system owned by the Town of Lansing, such
charge to be established as an amount per thousand gallons and included in the water rate
charged by the Southern Cayuga Lake Intermunicipal Water Commission, and
WHEREAS, the Town Board of the Town of Lansing has considered the proposed rate
for operations and maintenance of $1.10/ 1,000 gallons, and has determined it presents a
reasonable estimate of the amount of projected revenue required to provide the operations and
maintenance services necessary for the water supply, therefore, it is
RESOLVED, that the Town Board of the Town of Lansing sets the operation and
maintenance component of the water rate at $1.10/1,000 gallons for the residents served by the
system within the Town of Lansing.

AGREEMENT TO CHANGE WATER RATE SCHEDULE
THIS AGREEMENT to change Water Rate Schedule is made as of the 2nd day of
January 2000, between the TOWN BOARD OF THE TOWN OF DRYDEN, Tompkins County,
New York, on its own behalf and on behalf of all water districts, in the TOWN OF DRYDEN
served by the Southern Cayuga Lake Intermunicipal Water Commission, (hereafter referred to as
"Dryden "), the TOWN BOARD OF THE TOWN OF ITHACA, Tompkins County, New York
(hereinafter referred to as "Ithaca. "), the TOWN BOARD OF THE TOWN OF LANSING,
Tompkins County, New York, on its own behalf and on behalf of all water districts in the
TOWN OF LANSING served by the Southern Cayuga Lake Intermunicipal Water commission,
(hereinafter referred to as "Lansing Town "), VILLAGE OF LANSING, on its own behalf and as
successor to LANSING WATER DISTRICT 1, Tompkins County, New York, (hereinafter
referred to as "Lansing Village "), and VILLAGE OF CAYUGA HEIGHTS, Tompkins County,
New York (herein after referred to as "Cayuga Heights "), all of the parties hereto sometimes
collectively or individually referred to hereinafter as "Municipalities" or "Municipality ",
WITNESSETH,
WHEREAS, the above named municipalities have entered into an amended,
supplemental, restated and consolidated agreement of municipal cooperation for construction,
financing and operation of an Intermunicipal water supply and transmission system dated as
June 5, 1979; and
WHEREAS, pursuant to said agreement each municipality agreed to pay to the Southern
Cayuga Lake Intermunicipal Water Commission (hereinafter referred to as "Commission "),

water revenues fused upon, in part, a water rate schedule annexed as Exhibit I of Schedule A to
said Agreement; and
WHEREAS, based on changes in costs, the Commission believes it is advisable to adopt.
a new water rate schedule in the form annexed to this agreement; and
WHEREAS, Schedule A of said June 5, 1979 agreement provides that the water rate
schedule may not be changed by the Commission without the written agreement of such change
of all the parties; and
WHEREAS, Exhibit I of Schedule A to said agreement has been amended from time to
time since the initial date of the agreement; and
WHEREAS, the parties believe it is necessary to amend Exhibit I of the Schedule A
further; and
WHEREAS, the parties are willing to agree to such change;
NOW, THEREFORE, in consideration of the premises and the mutual undertakings of
the parties pursuant to said June 5, 1979 agreement, the parties hereby agree that Exhibit I of
Schedule A annexed to said June 5, 1979 agreement be amended effective January 2, 2000 and
that thereafter the Exhibit I annexed hereto is adopted as the water rate schedule for all purposes
under said June 5, 1979 agreement.

2000 WATER MATED SCHEDULE
EFFECTWE JANUARY 2, 2000
RATE STRUCTURE;
The fiat rate charge per 1,000 gallons shall be nonAuctuating and equal to one dollar and
seventy-nine cents ($1.79). This rate is equal to one dollar and thirty -four cents ($ 1.34) per 100
cubic feet. The foregoing rate will be the rate charged for all regular quarterly bills sent after
January 2, 2000. Actual or base consumption may occur prior to January 2, 2000.
MINIMUM. BASE CHARGES:
Notwithstanding the foregoing rate structure, the following minimum base charges shall be
applicable to the meter size indicated below, for regular quarterly bills sent after January 2,
2000. The table below shows the amount of water consumption that is permitted before the
minimum base charge would be exceeded:

Multiple Dousing and mobile home parks of over two dwelling units, using a master meter, will

be computed as follows. The quarterly master meter reading will be divided by the number of
dwelling units and the water charge will be figured on this number as if the unit was individually
metered. The water charge will then be multiplied by the number of units on the master meter
and this will be the billing rendered. If the calculation of the water consumed per dwelling unit
is less than the allowable consumption for a three - quarter inch meter, then the billing will be
calculated by multiplying the number of units on the master meter times the minimum base
charge for a three - quarter inch meter (e.g., if there was 100,000 gallons, the Commission billing
would be $358.00 (20 units times $17.90) rather than $179.00 (100,000 gallons at $1.79/1000
gallons).
An annual charge for each fire protection main serving a fire suppression system will be billed
along with the first quarterly water bill of the calendar year. The annual charge for this service
shall be $20.00 per diameter inch of the pipe supplying the fire suppression system. The pipe
supplying the fire suppression system is the pipe needed to supply the fire suppression system,
installed downstream of the system control valve.
The water application fee shall be as follows for each new service for which application is made
after January 2, 2000:
Service Size 3/4" and smaller $150.00
Service Size I to $200.00
Service Size larger than l " $250.00
Plus the cost of a meter, tap, accessory materials and installation costs in a location approved by
the Southern Cayuga Lake Intermunicipal Water Commission.
Mr. Herrick discussed the proposed project and passed out a draft letter to be sent to the
landowners in the proposed Lake Ridge Point Water District.
After further discussion Mr. Herrick will prepare a revised letter and the Supervisor's
Office will. send the letter to all landowners.
The letter asks the landowners to complete and return the questionnaire to the Town
before November 12, 1999. The results will be discussed at the regular Board meeting in
November.
Mr. Herrick discussed with the residents the proposed district. Beth Boyer and Bryan
Clark informed the Board that at this time there are b in favor and I against.
After further discussion Mr. Herrick will send a letter to landowners Howell and Gardner
explaining the current situation and the advantages of being in the water district at this time
versus doing a water district extension in the future. They will be asked to reply by November
123 1999 and this will be further discussed at the regular Board meeting in November.

Attorney Guy Krogh informed the Board that Rich John is in the progress of filling out
the application.
Dave Herrick recommended to the Board that a letter be sent to Bolton Point informing
them of the district and to share a copy of the Engineers Report. Mr. Herrick also recommended
that the SEQR process be started.

Mr. Herrick informed the Board that Jack McNamara would like to see the Town
entertain a project that would include Algerine Road, Lansing Station Road, and part of Ludlow
Road. He is requesting that the Town develop a different formula on how the cost is shared
based on front footage, assessed value and units. This would be based on frontage and not
acreage. The majority of the costs will be on units. Mr. McNamara is asking for the Board to
consider this scenario.
After further discussion the following resolution was hereby adopted:

RESOLVED, that the Town Board does hereby direct Town Engineer, David Herrick to
set up a scenario of the costs based on frontage in the proposed Water District No, 17, Ext No, 5.

A copy of the minutes of August 18th, September l st and July 21, 1999 having been
given to the Board Members beforehand, the Supervisor asked for a motion to make corrections
or to accept the same as submitted.

The matter has gone before the judge. The judge ordered him to have the property on
Ridge Road cleane&up by mid November. If it is not cleaned up at that time he will consider
putting him in jail for being in contempt of a Supreme Court order.
