The Lansing Town Board met in Regular Session at the Lansing
Town Hall Board Room at 7:00 p.m. with Supervisor Kirby presiding.

The Supervisor called the meeting to order and had the clerk
take the Roll Call.
Proof of Notice having been furnished by the Town Clerk, the
Public Hearing on the proposed increase for Senior Citizen's Tax
Exemption was called to order at 7:00 p.m.

TCAT:
Mr. Green, a representative from TCAT appeared in front of
the Town Board. He stated that this was his 50th public appearance
regarding TCAT.
He stated the following:
1.
New Equipment
will
be used in the near future.
2.
Gadabout and
Tioga
Transit contract with TCAT.
3.
Bicycle rakes
have
been installed on the buses.
4.
They have 2.3
to 2.4
million boarding in one year with about
half of these
being
on the Cornell Campus.
S.
Bike lockers
will
soon be installed at the bus stops on the
Commons.
6.
Larger buses
with
handicapped accessibility will soon be used
in the Town of Lansing.
7.
State funding
are
figured at .69 cents per mile of service
plus .39 cents
per
passenger. (Formula can vary)
NEW YORK STATE ELECTRIC AND GAS CUSTOMER ADVANTAGE PROGRAM:
Mr. Ciaschi stated that about 4,100 customers have signed up
for the program. On August 1, 1999, everyone will get to choose
their supplier. (Current energy credit is 03 cents and may
continue to go up).
Mr. Larson reported the following:
WATER LINE FAILURE:
The bolts that hold the bonnet on the valve rotted away and
the valve bonnet blew off causing a major leak. (Failure happened
below the reducing station on Brickyard Road).
All old bolts will soon be replaced with new stainless steel
bolts. (About 12 to 15 will need to be replaced).

The amps at the Highway Garage have been changed from 200 to

400 amps.
TELEMENTARY BUILDING:
The telementary building has been redone at the Village
Circle. It has new vinyl siding, inside and out. The one on
Brickyard Road will be done in the near future also.
HILLCREST /BEAN HILL LANE PROPERTY:
An agreement
has been reached. Mr. John stated that
the
abstract
looks good
but
there is a "limitation on subdivision"
of the property, to be
clause in
the title.

John did not feel this was a subdivision

that the purchase of the property would serve a municipal purpose
in allowing the reconfiguration of Bean Hill Lane to create a
safer intersection between Bean Hill Lane and Hillcrest Road, and
WHEREAS, the Town Board of the Town of Lansing has entered
into negotiations with the owners of the property and has
determined a fair market price for the property, being the amount
of Twenty -Nine Thousand One Hundred Seventy Dollars ($29,170) for
the purchase of the property, to be paid by an initial payment of
Nineteen Thousand Six Hundred Dollars ($19,600) and by the owners
of the property taking a mortgage in the amount of Nine Thousand
Five Hundred Seventy Dollars ($9,570), therefore, it is

RELOCATION OF WATERLINE ON EAST SHORE DRIVE:
The following resolution was adopted:

RESOLVED, that the Town Board of the Town of Lansing does

hereby authorize the Town Supervisor to enter into any and all
agreements with New York State Department of Transportation for
the State's reconstruction of Culvert #3 P.I.N. 380362101, NYS
Route 34.

BOLTON POINT WATER RATE CHANGE:
The following

proposals from the Southern Cayuga Lake Intermunicipal Water
Commission for the water rates to be set for the cost of water per
thousand gallons and, by prior resolution of the Lansing Town
Board, the Town of Lansing approved such proposal, and
WHEREAS, the Town Board of the Town
of Lansing has received
proposals from
the
Town Engineer for the
component of the water
rates to be set
by
the Town of Lansing for
the cost of operations
and maintenance
of
the water system owned
by the Town of Lansing,
such charge to
be
established as an amount per thousand gallons
and included in
the
water rate charged by
the Southern Cayuga Lake
Intermunicipal Water
Commission, and
the
gallons,

TAXES ON PROPERTY AT 36 MILL STREET:
Mr. Totman stated that the Tompkins County Department of

Mr. Thoma felt the Town needed to search for other funding
and also work with the Health Department to bring up the third
party documentation. This could increase the points for the
district.
After a long discussion it was decided that Mr. Herrick will
write a letter to ALL parties involved and set up an informational
meeting to take place at the Lansingville Fire Hall at a later
date.
It was stated that the drinking water fund may be another
source to look into for another source of funding.
Mr. John felt the HUD Grant should still be pursued along
with other sources of funding.
EAST SHORE CIRCLE WATER:
Four residents from East Shore Circle confronted the Board
regarding the possibility of getting public water at this time.
The residents stated that they would pay to bore under the
highway. It was stated that the residents could do a district
extension with individual lines and pay all expenses incurred.
Mr. Herrick will look into the possibility of this and get
back to the residents involved.

Mr. John Bailey discussed the possibility of the Town of
Lansing purchasing additional insurance coverage for Town
Constables. It was mentioned that the Town should look into a
contractual agreement with the County in case a law suit comes up
involving a constable. After some discussion, the following

WHEREAS, the Town Board of the Town of Lansing has received a
request to consider the addition of an insurance rider known as
Police Professional Coverage to provide the Town with insurance
protection for the acts of the Town Constables, and
WHEREAS, the Town Board of the Town of Lansing, after
conferring with the insurance agent for the Town of Lansing, has
determined that such coverage should be added to the Town of
Lansing insurance policy, therefore, it is

RESOLUTION, offered by Mr. Cleveland and seconded by Mr

WHEREAS, the Town Board of the Town of Lansing, by prior
resolution, has excepted the dedication of a portion of Autumn
Ridge Circle, and has now received a request from the developer
for the dedication of the remaining portion of Autumn Ridge
Circle, and
WHEREAS, the Town Board of the Town of Lansing wishes to
accept the dedication of the remaining portion of Autumn Ridge
Circle to the Town of Lansing, therefore, it is
RESOLVED, that the Town Board of the Town of Lansing accepts
the dedication of the remaining portion of Autumn Ridge Circle to
the Town of Lansing, pursuant to the following conditions:
approval of the condition of the road and related drainage
easements by the Town Engineer and the Town Highway
Superintendent, and approval of the deeds and legal documentation
of title by the Town Attorney, and subject to a one year guarantee
of the roads by the developer, such guarantee to run from the time
of acceptance and recording of the deeds for the roads.

AMENDMENT TO TOWN OF LANSING ORDINANCE NO, 5
FOR THE YEAR 1966
Ordinance No. 43
The Ordinance of the Town of Lansing known as Ordinance No. 5
entitled ORDINANCE OF THE TOWN OF LANSING, PROVIDING FOR A PARTIAL
TAX EXEMPTION OF REAL PROPERTY OWNED BY CERTAIN PERSONS WITH
LIMITED INCOME WHO ARE AGE 65 YEARS OF AGE OR OVER, which
Ordinance was adopted on August 9, 1966 and thereafter amended on
November 30, 1970, March 11, 1975, February 14, 1978, June 27,
1979, September 9, 1980, July 13, 1982, March 13, 1984, February
11, 1987, August 15, 1990, January 30, 1991, December 8, 1993,
October 12, 1994, December 21, 1994 and December 31, 1996 is
hereby further amended.
SECTION 1. The provision of the Ordinance of the Town of
Lansing adopted August, 9 1966, as amended from time to time, is
hereby further amended to read as follows:

Section 2. Pursuant to the provisions of Section 467 of the
Real Property Tax Law of the State of New York, real property

or more persons, each of whom is 65 years of age or over, or real
property owned by husband and wife, one of whom is 65 years of age
or over, shall be partially exempt from taxation by said Town for
the applicable taxes specified in Section 467 based upon the
income of the owner or combined income of the owners. A person
otherwise qualifying for such exemption shall not be denied such
exemption if such person becomes 65 years of age after the
appropriate taxable status date and before December 31 of the same

the Assessment Department Office on or before the appropriate
taxable status date.

conviction of having

willful false
statement

the application for such
exemption shall be
punishable
by
a fine if not more that

and shall
disqualify
the
applicant or applicants from further
exemption for
a period of
five
( 5 ) years.
