The Supervisor called the meeting to order and took the Roll Call. The Town Board discussed the 1998 proposed Town Justice Budget with Mr. Howell and Mr. Burin. RESOLUTION, offered by Mr. Cleveland and seconded by Mr. Tvaroha: RESOLVED, that the Special Meeting be adjourned to go into Executive Session to discuss laws regarding Adult Entertainment at 8:30 p.m. Carried. RESOLUTION, offered by Mr. Cleveland and seconded by Mr. Tvaroha: RESOLVED, that the Executive Session be terminated at 8:45 p.m. and the Special Meeting be reconvened. Carried. RESOLUTION, offered by Mr. Beckwith and seconded by Mr. Tvaroha: WHEREAS, pursuant to a Comprehensive Plan for the Town of Lansing, the .Town Board of the Town of Lansing has referred to the Planning Board for their review and recommendation an amendment to the Town of Lansing Land Use Control Ordinance to provide for zoning regulations throughout the entire Town of Lansing, rather than maintaining the limited existing zoned area of the Town, and WHEREAS, the Town Board of the Town of Lansing has received many comments from residents of the Town of Lansing requesting modifications to the proposed ordinance, including the addition of a provision regulating adult establishments within the Town, and WHEREAS, the proposed definition of an adult establishment is as follows: (a) Adult Bookstore, An establishment having as a significant portion of its stock in trade books, magazines, other periodicals, films, slides or video tapes, and which establishment is customarily not open to the public because it excludes minors by reason of age. (b) Adult Eating or Drinking Establishment. An eating or drinking establishment which customarily presents topless or nude dancers, strippers or similar entertainments, and which establishment is customarily not open to the public because it excludes minors by reason of age. (c) Adult Theater. An establishment which customarily presents motion pictures, films, videotapes, slide shows, or live performances featuring topless or nude dancers, 3 continued October 29, 1997 strippers or similar entertainments, including an establishment where such entertainment is viewed from an enclosure; and which establishment is customarily not open to the public because it excludes minors by reason of age. and, WHEREAS, the Town Board conduct a study of the effect to determine the effect on related behavior surrounding whether such effects are establishments, and of the Town of Lansing has decided to of adult establishments, particularly property values and crime and. crime adult establishments and to determine related to the presence of adult WHEREAS, the Town Board of the Town of Lansing, pending the results of the study to be performed and the implementation of the amendments to the Land Use Control Ordinance as deemed appropriate, desires to place a moratorium within the Town on all applications for special permits, use permits, building permits and site plan applications, as appropriate, for any adult establishments, and, therefore, it is RESOLVED, that the Town of Lansing shall conduct a study of the effects of the presence of adult establishments with the Town, particularly to determine the effect on property values and crime and crime related behavior surrounding adult establishments and to determine whether such effects related to the presence of adult establishments, and BE IT FURTHER RESOLVED, that the Town Board of the Town of Lansing orders that a public hearing shall be held on the 19th day of November, 1997, at 7:00 p.m, at the Lansing Town Hall to receive public comment on the proposal to create a moratorium in the Town of Lansing such that, in all districts, no new adult establishment shall be allowed, nor shall any existing adult establishment be enlarged or extended, nor shall any non - conforming use be changed to an adult establishment for an interim period of one year from the date of the moratorium, or pending the completion of the above mentioned study and the implementation of amendments to the Town of Lansing Land Use Control Ordinance regulating adult establishments, whichever occurs first.
