HomeMy WebLinkAbout1996-12-31G0:1 SPECIAL TOWN BOARD MEETING DECEMBER 31, 1996 The Lansing Town Board met in Special Session at the Lansing Town Hall Board Room at 12:00 p.m. with Supervisor Kirby presiding. ROLL CALL Jeannine Kirby Supervisor Present Herbert Beckwith Councilman Present Paul Butler Councilman Present Jeffrey Cleveland Councilman Present Larry Tvaroha Councilman Absent Bonita Boles Town Clerk Present Richard John Town Attorney Present VISITORS: David Herrick, Town Engineer The Supervisor called the meeting to order and had the clerk take the Roll Call. Proof of Notice having been furnished, the Public Hearing entitled " AMENDMENT TO TOWN OF LANSING ORDINANCE # 5 FOR THE YEAR 1966 ", Ordinance No. 44 was called to order. No one appeared voicing any objections, the Public Hearing was terminated at 12:05 p.m. RESOLUTION, offered by Mr. Beckwith and seconded by Mr. Cleveland: RESOLVED, that the following Ordinance is hereby approved and accepted by the Lansing Town Board: AMENDMENT TO TOWN OF LANSING ORDINANCE NO. 5 FOR THE YEAR 1966 Ordinance No. 44 The Ordinance of the Town of Lansing known as Ordinance No. 5 entitled ORDINANCE OF THE TOWN OF LANSING, PROVIDING FOR A PARTIAL TAX EXEMPTION OF REAL PROPERTY OWNED BY CERTAIN PERSONS WITH LIMITED INCOME WHO ARE 65 YEARS OF AGE OR OVER, which Ordinance was adopted on August 9, 1966 and thereafter amended on November 30, 1970, March 11, 1975, February 14, 1978, June 27, 1979, September 91 1980, July 30, 1982, March 13, 1984, February 11, 1987, August 15, 1990, January 30, 1991, December 8, 1993, October 12, 1994 and December 21, 1994 is hereby further amended. SECTION 1. The provision of the Ordinance of the Town of Lansing adopted August 9, 1996, as amended from time to time, is hereby further amended to read as follows: Section 1, This Ordinance is enacted pursuant to Section 467 of the Real Property Tax Law of the State of New York as amended by Chapters 588 and 287 of the Lansing of 1989. Section 2. Pursuant to the provisions of Section 467 of the Real Property Tax Law of the State of New York, real property located in the Town of Lansing, County of Tompkins, owned by one or more persons, each of whom is 65 years of age or over, or real property owned by husband and wife, one of whom is 65 years of age or over, shall be partially exempt from taxation by said Town for the applicable taxes in Section 467 based upon the income of the owner or combined income of the owners. A person otherwise qualifying for such exemption shall not be denied such exemption if such person becomes 65 years of age after the appropriate taxable status date and before December 31 of the same year. This Ordinance shall be administered in accordance with said sections of the Real Property Tax Law, as now adopted, and as they may be amended from time to time, and the provisions of said sections as provided in Section 467 shall be applicable to the effectuation of the exemption provided for in this Ordinance. Section 3. Application for such exemption must be made by the owner or all of the owners of the property on forms prescribed by the State Board to be furnished by the Tompkins County Assessment Department and shall furnish the information and be executed in a manner required or prescribed in such forms and shall be filed in the Assessment Department Office on or before the appropriate taxable status date. This will be discussed at a later date. WATER 17, EXT. 3 ( Fiddlers Green): The water main is in and pressure tested. The pressure reducing vault is on order but not expected to be delivered until Friday. Mr. Herrick felt January 15th would be the earliest date they could hook up, Mr. Herrick did not feel L.R.S. was responsible for the delay as the vault has not come in. WATER 17, EXT..4 (PINNEY LANE): Mr. Herrick stated that L.R.S placed 1,000 ± feet of water II v 205 continued December 31, 1996 pipe on a Saturday without obtaining a Highway work permit. They also did not deposit the required $ 1,000.00 nor did they show proof of an Insurance Certificate. Mr. Herrick stated that the water pipe was suppose to go over the first culvert and under the next two. They were all installed over all three culvert pipes. Mr. Herrick stated that this could become a hassle in the future if any of the culvert pipes needed replacing. Mrs. Kirby stated that L.R.S. should be made to correct the problem at this time as she felt it could be a problem in the future. Mr. Herrick stated that he was told that Pinney's Engineer was present while the work was being performed and felt it might be a good idea for the Board to talk to him to see if he would certify the work that has been completed. It was the consensus of the Board to authorize Attorney John to write L.R.S. Excavating a letter stating the above information and inviting them to a Board meeting to discuss the matter. RESOLUTION, offered by Mr. Cleveland and seconded by Mr Beckwith: RESOLVED, that the Special Meeting be adjourned to go into Executive Session at 12:29 p.m. to discuss a claim related to a change order in Water District No, 17, Carried. RESOLUTION, offered by Mr. Cleveland and seconded by Mr. Beckwith: RESOLVED, that the Executive Session be terminated and the Special Meeting be reconvened at 12:58 p.m. Carried. RESOLUTION, offered by Mr. Cleveland and seconded by Mr. Beckwith: RESOLVED, that the bookkeeper is hereby authorized and directed to pay $ 19,615.58 of voucher No. 52 which was presented at the December 18, 1996 meeting. The total amount of the bill was $ 23,652.61 and WHEREAS, the Town Board of the Town of Lansing hereby authorizes the Town Engineer to negotiate the balance of $4,037.03 with Highlander Construction. Mr. John thanked the Board for allowing Thaler and Thaler Law Firm to represent them in the past and future.
