The Supervisor called the meeting to order and had the clerk take the Roll Call. FINAL ORDER AND RESOLUTION OF THE TOWN BOARD TOWN OF LANSING ESTABLISHING WATER DISTRICT NO. 2 - EXTENSION 2 In the matter of the establishment of Lansing Water District No, 2 Extension 2, Town of Lansing, County of Tompkins, State of New York, pursuant to Article 12 -A of the Town Law. WHEREAS, a map, plan and report having been prepared by the Town Engineers, T.G. Miller, P.C., David A. Herrick, being duly licensed by the State of New York, dated October 21, 1993 and revised April 24, 1996, in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Lansing, relating to the establishment of a proposed water district extension in the Town; and WHEREAS, such map, plan and report, as revised, have been duly filed in the Town Clerk's Office in said Town on April 24, 1996; and WHEREAS, said map, plan and report showed the boundaries of the proposed district, a general plan of the water system and a report of the proposed improvements, the estimated expense of these I mprovements, the proposed method of financing, and all other matters required by law to be stated, which map, plan and report are on file in the Town Clerk's Office for public inspection; and WHEREAS, the map shows the proposed water district, water mains, fire hydrants and other related and necessary appurtenances; and WHEREAS, an Order was passed November 6, 1996 at 7:00 p.m. at t New York, to consider the revised all persons interested in this required by law and to comply with and Part 85 of Chapter III of Regulations; and on October 16, 1996, designating he Lansing Town Hall in Lansing, map, plan and report and to hear matter and to take action as the requirements of the Town Law 2 New York Codes, Rules and WHEREAS, said Order setting public hearing was published and posted as required by law; and r� u At a special Meeting of the Town Board of the Town of Lansing held in and for the Town of Lansing at the Town Hall on November 6, 1996 at 7:00 P.M., the following members being present: Jeannine Kirby, Supervisor; Larry Tvaroha, Councilman; Paul Butler, Councilman; Herbert Beckwith, Councilman; and Jeffrey Cleveland, Councilman; the following Resolution was duly made by motion of Paul Butler, and seconded by Herbert Beckwith. In the matter of the establishment of Lansing Water District No, 2 Extension 2, Town of Lansing, County of Tompkins, State of New York, pursuant to Article 12 -A of the Town Law. Upon the evidence given at the hearing and upon a motion duly made, the following resolution was unanimously adopted. It is hereby determined that: (a) The notices of hearing were published and posted as required by law, and are otherwise sufficient. (b) All the property and property owners within the proposed district are benefitted thereby. (c) All the property and property owners benefitted are included within the limits of the proposed district. (d) The establishment of this district is in the public interest. IT IS RESOLVED that the district as set forth in the map, plan and report dated October 21, 1993 and revised April 24, 1996, be approved, that the requested improvement be constructed and that the necessary easements and lands be acquired upon the required funds being made available and provided for. IT IS FURTHER RESOLVED that this district shall be known as Lansing Water District No, 2 Extension 2 in the Town of Lansing and shall be bounded and described as shown on Exhibit A to the Order of the Town B "bard dated October 16, 1996, specifying the time and place of the public hearing on the establishment of Water District 2 Extension 21 IT IS FURTHER RESOLVED, that the proposed improvement, including construction costs, cost of acquisition of lands and easements, legal and engineering fees, and all other expenses, be financed by the issuance of serial bonds of the Town of Lansing to mature in a number of annual installments not exceeding nineteen (19) years as may be determined by the Town Board, the cost of constructing Lansing Water District No, 2 Extension 2, to be assessed by the Town Board in as close a proportion to the benefit to which each lot or parcel derive from the improvement as is possible. IT IS FURTHER RESOLVED that this resolution is subject to permissive referendum as provided in Town Law, Section 209 -E in the manner provided in Article 7 of the Town Law. IT IS FURTHER RESOLVED that this resolution is subject to approval by the New York State Department of Audit and Control. IT IS FURTHER RESOLVED that the Town Clerk of the Town of Lansing is hereby authorized and directed, pursuant to Town Law Section 209 -g to file this Final Order with Tompkins County Clerk and the New York State Office of Audit and Control within ten (10) days after the adoption of this Order. RESOLUTION ADOPTING SPECIAL DISTRICT BUDGET offered by Mr Beckwith and seconded by Mr. Tvaroha: RESOLVED, that the Lansing Water District No. 2, Water No. 2, Ext. No.2, No. 3, No. 8, No, 9, No. 10, No. 13, No, 14, No. 15, No. 17, No. 18 and Lansing Light Districts No. 1, No. 2 and No. 3 for the year 1997, are hereby approved and adopted. RESOLUTION, offered by Mr. Tvaroha and seconded by Mr. Beckwith: RESOLVED, that the Town hereby authorizes and directs the Supervisor to send appreciation letters to all members of the Ambulance Committee thanking them for their time and a job well done. Carried. Mr. Larson handed out the results from the safety inspection that was performed by the Town's Insurance Agency, Mr. Larson will take care of all matters stated in the report. Mr. and Mrs. Richard Pinney of 24 Ross Road, Lansing presented the Engineers Report to the Board for the proposed Water District No. 17, Ext. No, 4. Mr. Larson discussed Snow Removal the bids that were open at the October 16th, 1996 meeting as required and the following resolutions were offered: RESOLUTION, offered by Mr. Beckwith and seconded by Mr. Cleveland: WHEREAS, bids for two (2) Snow Removal Equipment Assemblies to be mounted on the new 1997 CL713 Mack cab & chassis were advertised as required by law and opened on October 16, 1996 and WHEREAS, Mr. Larson recommended to the Board that the Highway Department install said assemblies WHEREAS, Mr. Larson recommended the Town Board approve the second low bid from Tracey Road Equipment in the amount of $ 20,378.00 each as the low bid had many deviations from the specifications. Now therefore be it RESOLVED, on recommendation from Mr. Larson, Highway Superintendent, that the Town Board of the Town of Lansing does hereby authorize the purchase of two (2) Snow removal equipment assemblies from Tracey Road Equipment, 6803 Manilus Center Road, East Syracuse, New York 13057 in the amount of $ 20,378.00 each and be it FURTHER RESOLVED, that the Lansing Highway Department will install said snow removal equipment assemblies. Now therefore be it RESOLVED, on recommendation from Mr. Larson, Highway Superintendent hereby authorize the purchase of two (2) heavy duty 13 foot dump /spreader boxes from Seneca Supply, Rt. 13 & Dryden Road, Ithaca, New York 14850 in the amount of $ 17, 290.00 each and be it FURTHER RESOLVED, that the Lansing Highway Department will install said heavy duty boxes. After some discussion, the following resolution was adopted by the Town Board: RESOLUTION, offered by Mr. Beckwith and seconded by Mr. Tvaroha: WHEREAS, the Town of Lansing has received an invitation from the Tompkins County Planning Department to participate in a study of traffic volume and patterns in a portion of Tompkins County including land within the Town of Lansing, the study to be entitled the Northeast Subarea Study; and WHEREAS, at least one recent similar study has been completed concerning the same issues of traffic volume and patterns under the title of Northeast Connector Study; and WHEREAS, there is no indication that the volume or patterns of traffic in the Town of Lansing have changed in any significant manner since the last study was conducted and report issued; and WHEREAS, it is the determination of the Town Board of the Town of Lansing that a better use of funds allocated for the Northeast Subarea Study be allocated towards the cost of implementing the recommendations of the Northeast Connector Study, therefore, it is RESOLVED, that the Town of Lansing respectfully declines the invitation to participate in the study to be entitled the Northeast Subarea Study and requests that the recommendations of the Northeast Connector Study be implemented instead. Mr. Orear stated that he has a signed approved will get a copy to Mr. John to look over. There was concern among the homeowners about and how this would be split between them. Mr. Herrick-. -offered to put together a cost Town's expense and bring it back to the Board discussed by the landowners and the Town Board at subdivision and the total cost estimate and in a later at the turn be date. L C 0 r. 157 continued, November 6, 1996 After a lengthy discussion it was the consensus of the Town Board to discuss this amongst themselves and try to come up with a solution for the problems. RESOLUTION,, offered by Mr. Beckwith and seconded by Mr Tvaroha: RESOLVED, that the Town Board of the Town of Lansing does hereby authorize the Town Engineer to prepare a preliminary water study for the Sun Path area and BE IT FURTHER RESOLVED, that said cost for study is to be charged to the Operation and Maintenance fund. PRESENT: Jeannine Kirby, Supervisor Herbert Beckwith, Councilman Paul Butler, Councilman Larry Tvaroha, Councilman Jeffrey Cleveland, Councilman In the matter of the establishment of Lansing Water District No, 17 Extension 4, Town of Lansing, County of Tompkins, State of New York, pursuant to Article 12 -A of the Town Law. WHEREAS, a map, plan and report have been prepared in such manner and in such detail as has heretofore been determined by the Town Board of Lansing, relating to the establishment of a proposed water district extension in the Town; and WHEREAS, such map, plan and report dated November 6, 1996 having been duly filed in the Town Clerk's Office in said Town on November 6, 1996; and, WHEREAS, said map, plan and report were prepared by T.G. Miller & Associates, P.C., Engineers and Surveyors, Ithaca, New York, duly licensed by the State of New York, showing boundaries of the proposed district, a general plan of the water system and a report of the proposed method of operation; and, WHEREAS, said map shows the proposed water district, water ® mains, fire hydrants and other related and necessary appurtenances; and, WHEREAS, the boundaries of the proposed district extension are described in Exhibit "A" attached hereto and made a part hereof; and, WHEREAS, the improvements proposed are as follows: SERVICE AREA - As shown on the map filed in the Town Clerk's Office and described in Exhibit A the proposed water district will include approximately 24 acres of land, more or less. The service area presently includes 6 undeveloped residential vacant lots. The proposed service area would include properties along Pinney Lane which intersects with Fiddler's Green on the boundary of Water 158 continued, November 6, 1996 District 17 Extension 3. WATER SUPPLY - Treated water requirements, estimated not to exceed an average of 1,950 gallons per day, will be purchased from the Southern Cayuga Lake Intermunicipal Water Commission (Bolton Point Water Supply), The Town of Lansing is one of the municipalities who own the system. The capacity of the Bolton Point supply is considered more than adequate to supply this district. The proposed water district extension will be served from the Town's Water Supply Tank Number 4, located on Emmons Road in the Town of Lansing. WATER SYSTEM TO BE CONSTRUCTED - As shown on the map filed with the Town Clerk, the facilities to be constructed consist of 1,010 linear feet of 8 inch diameter ductile iron pipe, and related improvements including valves and hydrants. All of the 8 inch ductile iron pipe and related improvements will be dedicated to the Town. WHEREAS, the method of financing will be as follows: METHOD OF .FINANCING - The total projected cost of the Water District 17 Extension 4 improvement is estimated as $41,500. The project cost of construction of Water District 17 Extension 4 will be financed entirely by Richard and Florence Pinney and no indebtedness will be incurred by the Town. The owners of the vacant lots will incur the following costs if a household chooses to connect to the system. Water Use Fees, Maintenance, and Operating Costs Water Use Fees as well as maintenance and operating costs and system -wide improvement costs are financed by metered water revenues and for a Single Family Residence are estimated at $40,00 per quarterly billing. One Time�Connection Charae_s For Each Household: Bolton Point Water Supply connection fee, plumbing permit, water meter, and inspection (Does not include miscellaneous plumbing changes required by Bolton Point inspection) $ Meter Pit (If required) 485. 850. Water service line from main structure (Cost will vary depending on length of service line, boring under highways, and depth to bedrock, if encountered) 3/4" copper service line 400 if @ $10.00 /lf Estimated Average $4,000 Total Charge $5,335 METHOD OF OPERATION - The proposed water main extension will connect to the existing Water District No. 17 Extension 3 distribution system on Fiddler's Green, MAINTENANCE'AND OPERATING COSTS - The costs of maintaining and operating and system -wide improvement cost are recovered in the per - gallon price charged to all water users in the Town and it is estimated at $40.00 per quarterly billing for a single family residence. WHEREAS, the Town Law related to the creation and the E E POPULATION TO BE SERVED - There are presently no consumption units in the District and it is anticipated that there will be an additional 6 consumption units at the time the District has been fully developed. The number of persons to be served at that time will be approximately 18. However, in this instance there is no financing being provided by the Town of Lansing, and therefore, no application to the Department of Audit and Control; is necessary; and NOW, on motion of Herb Beckwith, seconded by Larry Tvaroha, it is hereby ORDERED, that the Town Board of the Town of Lansing hold a public hearing at the Lansing Town Hall in said Town on November 20, 1996 at 7:00 P.M. on that date to consider said map, plan and report and to hear all persons interested in the subject thereof concerning the same and to take such action thereof as is required or authorized by law. WHEREAS, the Town of Lansing, Tompkins County, New York has issued a Bond Anticipation Note to the Tompkins County Trust Company in the amount of $813,400.00 (Bond Anticipation Note 2 -95) for the above - mentioned water system improvements, the purchase of land by the Town of Lansing from New York State, and the purchase of highway equipment; and WHEREAS, Bond Anticipation Note 2 -95 became due on November 12, 1996 together with interest at the rate of 4.100 per annum; and NOW THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Lansing, Tompkins County, New York hereby authorizes the Supervisor to execute and deliver such documents as are necessary to renew Bond Anticipation Note 2 -95 in an amount of $610,000.00 with the Tompkins County Trust Company with interest thereon at the rate of 40 per annum for one year, renewable March 31, 1997; and be it further RESOLVED, that the Supervisor cause to be paid the interest on Bond Anticipation Note 2 -95 together with $30,000.00 on principal towards the amount due for the above - mentioned water system improvements; and be it further RESOLVED, WHEREAS, the Town Board is desirous of renewing a Bond Anticipation authorized Note for the amount financed for the above - mentioned water system improvements less a principal payment in the amount of $30,000.00 The financing of the amounts due for the purchase of the land from New York State and the purchase of highway equipment to be renewed by a separate Bond Anticipation Note. NOW THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Lansing, Tompkins County, New York hereby authorizes the Supervisor to execute and deliver such documents as are necessary to renew Bond Anticipation Note 2 -95 in an amount of $610,000.00 with the Tompkins County Trust Company with interest thereon at the rate of 40 per annum for one year, renewable March 31, 1997; and be it further RESOLVED, that the Supervisor cause to be paid the interest on Bond Anticipation Note 2 -95 together with $30,000.00 on principal towards the amount due for the above - mentioned water system improvements; and be it further RESOLVED, that the Supervisor be and she hereby is authorized to execute and deliver such documents as are necessary to n E continued, November 6, 1996 effectuate the purposes of this Resolution; and be it further RESOLVED, that all of the provisions in the Bond Resolution dated November 4, 1992 in connection with the Bond Anticipation Note 1992 are designated to apply to the Bond Anticipation Renewal Note to be executed by the Supervisor and designated as Bond Anticipation Renewal Note 2 -96. He stated that the approximate cost for a single family would be $ 618.00 per year (2 units) . A public informational meeting will be set up in room 101 at the Lansing High School on December 4, 1996 at 7:00 p.m. Mrs. Kirby will meet with Mr. Mobbs regarding the Myers Road Bridge on Friday. She will get back to the Board at a later date. It was the consensus of the Town Board that we should repair the Gulf Creek Bridge before winter sets in. The cost to be about $ 30,000.00. The Board discussed the large bottled water bills that were to be paid by the Town of Lansing for the Milliken Station Building. It was the consensus of the Board to pay these bills until employees can drink the water. Mr. John will send out letters to people to see if they would be interested in being on a Town Hall Committee, Mrs, Kirby, Mr. Cleveland and Mr. Tvaroha will meet with Jim Hansen regarding the Water Front project. Mrs. Kirby informed the Board that there will be a Tompkins - Cortland Homebuilders luncheon on Thursday, November 7th at which time Jim Shug will speak and would like any officials from Tompkins and Cortland Counties to attend. Mr. Steve Colt, Lansing Recreation Director, gave the Board Members copies of three (3) quotes he received to construct a new 36' x 9' x 48' pavilion in the Myers Park. Excavating, Inc., of 24 Ross in the amount of One Hundred Thirty :y -Seven Dollars and 00 /100 ($130,637.00), RESOLVED, that the Town Board of the Town of Lansing makes a Notice of Award and accepts the bid proposal received from L.R.S. Excavating, Inc., 24 Ross Road, Lansing, New York in the amount of One Hundred Thirty Thousand Six Hundred Thirty -Seven Dollars and 00 /100 ($130,637.00), for the construction work to be completed in Water District 17 Extension 3, subject to the completion of contract documents and presentation of proof of insurance and bonding satisfactory to the Town Engineer and Attorney, and it is FURTHER RESOLVED, that the Town Board of the Town of Lansing authorizes the Town Supervisor to execute the contract documents on behalf of the Town of Lansing. Mr. Larson stated that he would collect $ 1,000.00 from L.R.S. Excavating and a Certificate of Insurance before they will be allowed to start the work on the Water District. At the completion of the work, the $ 1,000.00 will then be reimbursed to L.R.S. Excavating, The Board agreed with this procedure.
