No. 2 $ 11460.00 The bids and all information were then given to the Highway Superintendent to look over and make a recommendation at a later 1 33 continued April 17, 1996 date. A number of Fiddler's Green residents approached the Board with concerns regarding their proposed water district. Comments were as follows: 1. Tammi Aiken -Lewis from T. G. Miller's Office explained the draft Engineers Report and Mr. John explained what a "buy -in" fee was. 2. It was stated by Mrs. Pinney that Pinney Lane would not be included in the district as they are looking into forming their own district. As a subdivision, the Pinney's did not feel it would be fair to ask a person who purchases one of their lots to take on ® a 20 year debt. She also felt they could perform the work more quickly and efficiently as they would not bond the project and are owners of an excavating business. She asked for assurance from the Board that at some point, they would be allowed to connect to the Fiddler's Green water district. She also asked what the costs would be. 3. All residents stated that they were in favor of a 20 year bond. 4. Some Fiddler's Green residents stated that they were against paying a buy -in fee to Water District 17, Ext. No. 1 as they felt they had already subsidized this district enough. Mr. Cleveland stated that the buy -in fee probably would not be dismissed. 6. Mr. John recommended to the Board that they do one District Extension instead of two. 7. It was stated that the two vacant landowners on Fiddlers Green did agree with a single water assessment unit charge even though there are not houses at this time on these lots. 8. It was stated that the debt payment each year (without Pinney Lane) would be approximately $ 1,000.00 per household. This would depend on what the interest rate is when the district is bonded. 9. Mr. Keller asked if Fiddler's Green would receive a buy - in fee from the Pinney Lane district. Mr. John stated that is the Town's policy. He also stated that Water District 17, Ext. No. 1 probable would not have been passed by Audit and Control as the price would have been too expensive with Fiddler's Green included. 10. Mr. Harry Keller stated that they need to find out if there will be any problems with Audit and Control and they need to move forward right away. 11. Mr. Tvaroha stated that he felt we should move forward with the project. 12. Mrs. Pinney stated that her family business offered the Fiddler's Green residents their services but they decided to go with the Town. 13. Mr. John stated that New York State cannot assess impact fees. Therefore, the buy -in fee helps to subsidize the cost of the water districts. 14. Mrs. Kirby stated that the Board could give her the facts, but that was all they could do. Mr. John stated that it would be a lot easier to deal with Audit & Control if everyone was in agreement. 6. The residents asked the Board to pass a Resolution to set a Public Hearing date but the Board had not received the final Engineer's report. Tammi Aikens -Lewis stated that she could have the Final Engineers Report finished tomorrow. The Town Board then made the following Resolution: RESOLUTION, offered by Mr. Beckwith and seconded by Mr. Butler: RESOLVED, that the Town Board of the Town of Lansing will hold a Special Town Board Meeting on April 19, 1996 at the Lansing Town Hall Board Room. Rick Pinney approached the Board concerning running a water line from Water District No. 17 down Ross Road to one resident. Mr. Pinney will contact Mr. Herrick to see exactly what will be needed to proceed. This will be discussed at a later date. Kim Davis asked the Board how the Emmons Road Water District was proceeding. Mr. John informed him that the Department of Agriculture and Markets had contacted him with questions regarding said water district. Mr. John stated that the Town Board could go ahead with the Public Hearing but also informed Mr. Davis that if the Dept. of Ag & Markets put a hold on the District it may have to be readvertised and that would be at the expense of the property owners in the District. Mr. Davis will contact the other landowners in the district and get back to Mrs. Kirby tomorrow. Mr. Larson reported the following to the Board: 1, Mr. Herrick wanted Mr. Larson to inform the Board that he felt if it looked like there was a possibility of a Bridge going in to replace the old Bridge in Myers in two to three years, then we should hold off in running the water line across the creek. If it is going to be longer than three years, he felt the lines should be run along the walk bridge as it is now. 2. The reason there was only one bid the first time on the In- Floor Hydraulic Hoist is because the Dodge Reports did not pick it up. Mr. Larson also advertised with the Bidders Guide Publications. Mr. Larson will look over the bids and get back to the Board with a recommendation. 3. He felt it could take most of the summer to clean up after the flood. 4. Brush and limb pick -up will begin Monday. 5, The Highway Employees will go to four days a week, ten hours a day beginning Monday. 6, Mr. Larson is still having a problem with the intersection of Bean Hill Lane and Hillcrest Road. He feels the Town should do something to make the area more safe than it is now. He will contact a couple of Real Estate Agents to get their opinion on a piece of land in this area. He thought the Town may be able to purchase it, fix a better intersection, and then sell the unused portion. He will get back to the Board with his findings. 65 continued April 17, 1996 Mr. Beckwith asked Tammi Aiken -Lewis when Water District No. 17 would be ready to be energized as Mr. Marrabella from N.Y.S.E. and Gas is very concerned about this. Tammi stated that she was not sure of the dates. Tammi submitted the Final report on Water District 17, Ext. No. 1 and the following resolution was made: ORDER OF TOWN BOARD SPECIFYING TIME AND PLACE OF PUBLIC HEARING ON ESTABLISHMENT OF OF LANSING (T) WATER DISTRICT NO. 17, EXTENSION 1 ® At a regular meeting of the Town Board of the Town of Lansing held at the Town Hall in the Town of Lansing, Tompkins County, New York, on the 17th day of April, 1996 at 7:00 p.m. PRESENT: Jeannine Kirby, Supervisor Larry Tvaroha, Councilman Herbert Beckwith, Councilman Paul Butler, Councilman Jeffrey Cleveland, Councilman In the matter of the establishment of Lansing Water District No, 17, Extension 1, Town of Lansing, County of Tompkins, State of New York, pursuant to Article 12 -A of the Town Law. WHEREAS, a map, plan and report have been prepared in such manner and in such detail as has heretofore been determined by the Town Board of Lansing, relating to the establishment of a proposed water district in the Town; and WHEREAS, such map, plan and report dated June 30, 1993 having been duly filed in the Town Clerk's Office in said Town on June 30, 1993, having been revised on July 29, 1993, and as revised, filed in the Town Clerk's Office in said Town on July 29, 1993, having been revised April 17, 1996, and as revised, filed in the Town Clerk's Office in said Town on April 17, 1996; and, WHEREAS, said map, plan and report were prepared by T.G. Miller & Associates, P.C., Engineers and Surveyors, Ithaca, New York, duly licensed by the State of New York, showing boundaries of the proposed district, a general plan of the water system and a report of the proposed method of operation; and, WHEREAS, said map shows the proposed water district, water mains, fire hydrants and other related and necessary appurtenances; and, WHEREAS, the boundaries of the proposed district are described in Exhibit "A" attached hereto and made a part thereof; and, WHEREAS, the improvements proposed are as follows: SERVICE AREA - As shown on the map filed Office and described in Exhibit A, the proposed e include approximately 46 acres of land, more presently 37 developed parcels and 8 undevelor which are within an agriculture district. in the Town Clerk's water district will or less. WATER SUPPLY - Treated water requirements, estimated not to exceed an average of 12,025 gallons per day presently, and 14,300 gallons per day upon full development, will be purchased from the •• continued April 17, 1996 Southern Cayuga Intermunicipal Water Commission (Bolton Point Water Supply). The Town of Lansing is one of the municipalities which own the system. The capacity of the Bolton Point supply is considered more than adequate to supply this district. WATER SYSTEM TO BE CONSTRUCTED - As shown on the map filed with the Town Clerk, the facilities to be constructed consist of 4720 linear feet of 8 inch diameter ductile iron pipe. The service connection with Water District 17 will consist of 38 3/4 inch copper service connections and approximately 930 linear feet of 3/4 inch copper pipe trenched for the service connections. C, Undeveloped Acreage: For the purposes of assessment, non - subdivided lots will be divided into approximately two acre lots with a minimum of 150 foot frontage and assessed one (1) unit for each lot. Remaining unimproved rear land will be assessed one - fourth (1/4) unit per acre. 3. Newly Built Homes and Apartments a. When additional houses and apartments or other buildings are built on a lot, they will be assessed as per the above formulae. 20 Year Serial Bond Assuming the project is financed with 20 year serial bonds at 6% interest, the estimated annual payment is calculated as follows: Principal = Interest = $ $ 178,200 6 Term = 20 190.00 years Capital Recovery Factor = Annual payment = $ 178,200 x 0.0872 0.0872 = $ 15,539 Estimated First Year Cost /Property Owner $ 15,539/81.7 assessment units House and Lot One Acre Lot only = 1 unit _ $ 190 /assessment unit _ $ 380.00 _ $ 190.00 WHEREAS, the method and costs of operation is as follows: 11 UT continued April 17, 1996 METHOD OF OPERATION - The service connection will connect to the existing Town of Lansing Water District 17 System along N.Y.S. Route 34. Storage sufficient to meet consumption and fire fighting needs will be provided by a proposed 250,000 gallon capacity Town water tank tentatively located off Ridge Road North of Beckwith Lane. Water is to be pumped to this tank by Town pumps located at or near Ridge Road. The overflow for the tank is at 990± feet U.S.G.S. The source of supply of water is the SCLIWC water system. The static pressure in the Town distribution system at the proposed service connection is estimated to be approximately 65 - 120 psi. All connections to the system will be required to install an individual pressure reducing valve at between 40 and 60 psi to ® maintain moderate household pressures and to protect against pressure surges in the line. MAINTENANCE AND OPERATING COSTS - The costs of maintenance and operating and system -wide improvement cost are recovered in the per - gallon price charged to all water users in the Town, which is estimated at $ 32.00 per quarterly billing for a single family residence. ONE TIME CONNECTION CHARGE For each household: Bolton Point Water Supply Connection fee, $ 475.00 plumbing permit, water meter, and inspection (Does not include miscellaneous plumbing charges required by Bolton Point inspection) Water service line from curb box to structure (cost will vary depending on length of service line and depth to bedrock, if encountered) estimated average 100 if @ $ 10 /lf $ 11000.00 Total Charge $ 11475.00 WHEREAS, the Town Law related to the creation and the establishment and extension of special improvement districts has been amended by Chapter 397 of the Laws of New York 1995 Regular Session to no longer require the approval of the New York State Office of Audit and Control for water districts where the cost to the typical property, or, if different, the cost to the typical one or two family home, such cost being defined as the amount required to pay for debt service, operations and maintenance and other charges, such as user charges, related to the improvements in the first year following formation of the district or extension or, if greater, in the first year in which both principal and interest on any indebtedness and operation and maintenance costs will be paid, is not above the average cost threshold as computed by the New York State Comptroller; and WHEREAS, as calculated by the Town Engineer pursuant to the amendments to the Town Law, the cost to the typical property, or if different, the cost to the typical one or two family home does not exceed the average cost threshold as computed by the New York State Comptroller so that the approval of the approval of New York State Office of Audit and Control is not required; NOW, on motion of Councilman Herbert Beckwith, seconded by Councilman Jeffrey Cleveland, it is hereby ORDERED, that the Town Board of the Town of Lansing hold a public hearing at the Lansing Town Hall in said Town on May 1, 1996 at 7:15 p.m., and on that date to consider said revised map, plan and report and to hear all persons interested in the subject thereof concerning the same and to take such action thereof as is required or authorized by law. Tammi stated that the South Lansing Sewer District Committee is working on a draft news release. A date of May 16, 1996 at the Lansing Community Center (Annex) at 7:30 p.m. has been set for a Public Hearing, Mr. Totman handed out his monthly report to the Board Members and stated that he was 13 permits ahead of last year but down about $900,000.00 in estimated construction costs. Mr. Totman is still having complaints about Nalley's and Walrad's. RESOLUTION, offered by Mr. Beckwith and seconded by Mr. Cleveland: RESOLVED, that the Town Board of the Town of Lansing does hereby approve the SEQR for Water District No. 17, Extension No. 2 and BE IT FURTHER RESOLVED, that the Town Board does hereby authorize Supervisor Kirby to sign any necessary papers. RESOLUTION, offered by Mr. Beckwith and seconded by Mr. Cleveland: RESOLVED, that the Town Board of the Town of Lansing does 70 continued April 17, 1996 hereby authorize the payment schedule extended for David Hatfield's water bill without penalty as he had a leak which caused a large bill.
