Jeannine Kirby Herbert Beckwith Paul Butler Jeffrey Cleveland Larry Tvaroha Bonita Boles Debbie Crandall Richard John ROLL CALL Supervi Council Council Council Council Town C1 Deputy Town At sor man man man man erk Town Clerk torney Present Present Present Absent Absent Absent Present Present VISITORS: David Herrick & Bert Fortner, The Supervisor called the meeting to order and had the clerk take the Roll Call, Mr. Bert Fortner approached the Board requesting the Board's permission to give Highway Superintendent Pete Larson permission to occasionally plow Old School House Road. Mr. Fortner had previously supplied the Board with a letter requesting this. Attorney, Rich John informed Mr. Fortner that the Town has to comply with State Law in this situation. The private road would have to be brought up to Town specs. Mr. John suggested he form a cooperative private road agreement. Mr. John suggested that Mr. Fortner contact Assemblyman Marty Luster to see if there is any legislation pending on this issue. Mr. Larson has been contacted by John Paulsey in regards to placing a business sign next to the Town Barn Road sign. It was the consensus of the Board to let Mr. Paulsey place the sign there as long as it complied with the Sign Ordinance. Mr. Larson would like to know what doctor the Town would like to use for the required physical when a new employee is hired. It was the consensus of the Board to have the Convenient Care do the examinations. John has not heard form Mr. Mr. Herrick passed out correspondence from Martin Hubbard with concerns regarding the April 8th deadline in the Water Tank Project. Mr. Herrick will meet with NYSEG to give them an update on the situation and discuss moving the extension date to the end of May. It was the consensus of the Board that if Mr. Herrick reviews this with NYSEG and they are agreeable to extend the date of completion to the end of May, this is an acceptable amendment to the agreement with Martin Hubbard Construction, Inc. The engineers will design the intersection by the end of January and contact Mrs. Kirby when it is completed. 330 December 20, 1995, continued ORDER OF TOWN BOARD SPECIFYING TIME AND PLACE OF PUBLIC HEARING ON ESTABLISHMENT OF LANSING (T) WATER DISTRICT NO. 17 In the matter of the establishment of Lansing Water District No. 17, Town of Lansing, County of Tompkins, State of New York, pursuant to Article 12 -A of the Town Law. WHEREAS, a map, plan and report have been prepared in such • manner and in such detail as has heretofore been determined by the Town of Lansing, relating to the establishment of a proposed water district in the Town; and, WHEREAS, such map, plan and report dated June 30, 1993 having been duly filed in the Town Clerk's Office in said Town on June 30, 1993; and, WHEREAS, said map, plan and report were prepared by T. G. Miller & Associates, P.C., Engineers and Surveyors, Ithaca, New York, duly licensed by the State of New York, showing boundaries of the proposed district, a general plan of the water system and a report of the proposed method of operation, and, WHEREAS, said map shows the proposed water district, water mains, fire hydrants and other related and necessary appurtenances; and, WHEREAS, the boundaries of the proposed district are described in Exhibit "A" attached hereto at the time the District and made a part hereof; and, WHEREAS, the improvements proposed are as follows: SERVICE AREA - As shown on the map filed in the Town Clerk's Office and described in Exhibit A the proposed water district will include approximately 1040 acres of land, more or less. These presently include five (5) tax map parcels owned by New York State Electric and Gas which are undeveloped, and approximately 103 developed residential living units. The proposed service area would include properties along Ridge Road between the existing Water District No. 7 boundary and the intersection the new Milliken Station Road. WATER SYSTEM TO BE CONSTRUCTED - As shown on the map f i led with the Town Clerk, the facilities to be constructed consist of 28,400 linear feet of 13 inch diameter ductile iron pipe; construction of Pump Station No. 2 and acquisition of 1/3 acre of land; construction of a Pressure Reducing Station. Construction of Storage Tank No. 4 will include a 150,000 gallon elevated water storage tank, a granular pavement access driveway, a Telemetry Building and acquisition of 1/2 acre of land. The proposed storage tank will be designated as Town of Lansing Storage Tank No. 4. The source of supply of water is the SCLIWC water system. Storage Tank No. 4 is tentatively located off of Ridge Road at a high point north of Beckwith Lane. The overflow • POPULATION TO BE SERVED - There are presently 122 consumption units in the District and it is anticipated that there will be an additional 53 consumption units at the time the District has been fully developed. The proposed storage tank will be designated as Town of Lansing Storage Tank No. 4. The source of supply of water is the SCLIWC water system. Storage Tank No. 4 is tentatively located off of Ridge Road at a high point north of Beckwith Lane. The overflow • WATER SUPPLY - Treated water requirements, estimated not to exceed an average of 56,875 gallons per day, will be purchased from the Southern Cayuga Lake Intermunicipal Water Commission (Bolton Point Water Supply). The Town of Lansing is one of the municipalities who own the system. The capacity of the Bolton Point supply is considered more than adequate to supply this district. WATER SYSTEM TO BE CONSTRUCTED - As shown on the map f i led with the Town Clerk, the facilities to be constructed consist of 4900 linear feet of 8 inch diameter ductile iron pipe. The service connection with Water District 17 will be 38 3/4 inch copper service connections and approximately 950 linear feet of trenching for the service connections. All of the 8 inch ductile iron pipe and improvements including hydrants and valves will be dedicated to the Town. METHOD OF FINANCING - The project cost of construction of Water District 17 Extension 1 will be financed entirely by the issuance of serial bonds to mature in annual installments. The annual installments which include repayment of principal and interest will be assessed by the following formula: 1. Lots with Existing Dwelling(s) Frontina on Water Mains. a. Parcels 2 acres or less: Assessed one (1) unit per dwelling and one (1) unit for the dwelling lot. b. Parcels greater than 2 acres: Assessed one (1) unit per dwelling and one (1) unit for initial 2 acres of the dwelling lot. All remaining acreage will be assessed one - fourth (1/4) unit per acre. 2. Vacant LotslUnimproved Land Fronting on Water Mains a. Existing Subdivided Lots 2 acres or less: Assessed one (1) unit per dwelling lot. b. Existing Subdivided Lots greater than 2 acres: Assessed one (1) unit for initial 2 acre dwelling lot. All remaining acreage will be assessed one - fourth (1/4) unit per acre. C. Undeveloped Acreage: For the purposes of assessment, non - subdivided lots will be divided into approximately two acre lots with a minimum of 150 foot frontage and assessed one (1) unit for each lot. Remaining unimproved rear land will be assessed one - fourth (1/4) unit per acre. 3. Newly Built Homes and Apartments a. Water is to be pumped to this tank by Town pumps located at or near Ridge Road. The source of supply of water is the SCLIWC water system. The static pressure in the Town distribution system at the proposed service connection is estimated to be approximately 65 -120 psi. And, WHEREAS, the maintenance and operating costs are as follows: MAINTENANCE AND OPERATING COSTS - The costs of maintaining and operating and system -wide improvement cost are recovered in the per- gallon price charged to all water users in the Town and it is estimated at $80.00 per quarterly billing for a single family residence. The aggregate maximum estimated cost of the aforesaid specific objects or purposes is $750,000.00 The plan of financing the same consists of the issuance of said serial bonds in the amount of $750,000.00 and the balance to be paid with monies budgeted for said equipment and monies in the capital reserve fund. Section 3. All other matters except as provided herein relating to such bonds shall be determined by the Supervisor. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law and shall otherwise be in such form and contain such recitals, in addition to those required by Section 1.00 of the Local Finance Law, as the Supervisor shall determine. Section 4. It is hereby determined that subdivision 1 of paragraph a. of Section 11.00 of the Local Finance Law applies to the specific object or purpose of the purchase of the equipment set forth herein, and that the period of usefulness thereof is 40 years computed from the date of the issuance of the first serial bond or the first bond anticipation note issued therefore: It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years, but shall not exceed 20 years. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such obligations becoming due and payable each year. There shall be levied on all the taxable real property in said Town a tax sufficient to pay the principal and interest on such obligations as the same become due and payable. In the event that the annual collection of such assessments shall be less than the amount required to pay the principal and interest of said bonds as they shall become due, the Town Board shall direct that surplus moneys not otherwise appropriated be applied. Section 7. The powers and duties of advertising such bonds for sale, conducting the sale and awarding the bonds, are hereby delegated to the Supervisor who shall advertise such bonds for sale, conduct the sale and award the bonds in such manner as she shall deem best for the interests of said Town, provided, however, that in the exercise of these delegated powers she shall comply fully with the provisions of the Local Finance Law and any order or rule of the State Comptroller applicable to the sale of municipal bonds. The receipt of the Supervisor shall be a full acquittance to the purchaser of such bonds who shall not be obligated to see the application of the purchase money. Section 8. Mr. Herrick recommended to the Board that they adopt the following resolution: RESOLUTION, seconded by Mr. offered Butler: by Mr. Beckwith who moved its adoption, WHEREAS, a Southern Cayuga plan Lake for the installation Intermunicipal Water of master meters on the Commission (SCLIWC) has been proposed; and WHEREAS, the and acknowledges Town of its cost Lansing (Town) has responsibilities considered said as described plan in the "Transmission Main Master Meter Agreement" dated December 7, 1995; 33� December 20, 1995, continued WHEREAS, SCLIWC proposed to provide bidding and construction management services for the Town in connection with this project; and WHEREAS, time is of the essence and SCLIWC, in order to maintain the construction schedule for this project, wishes to be authorized by the Town to sign contracts on the Town's behalf after bids are received; therefore, it is RESOLVED, that the Town of Lansing hereby agrees to the terms of the "Transmission Main Master Meter Agreement" dated December 7, 1995 and grants authority to SCLIWC to enter into a contract on the Town's behalf to construct the Town's share of the site improvements to the existing transmission main connection to the Sheldon Road tank distribution system including the installation of a master meter, and to construct the site improvements to the existing transmission main connection to the Village Circle tank distribution system with the lowest responsible bidder for an amount not to exceed ten percent above the estimated cost of one thousand six hundred seventy dollars ($1,670). Fund Wr. #17 1 - 3 $ 590,299.59 Vote of Town Board (Aye) Herbert Beckwith, Councilman Vote of Town Board (Aye) Paul Butler, Councilman Vote of Town Board (Aye) Jeannine Kirby, Supervisor RESOLUTION, offered by Mr. Butler who moved its adoption, seconded by Mr. Beckwith: WHEREAS, the above named municipalities have entered into an amended, supplemental, restated and consolidated agreement of municipal cooperation for construction, financing and operation of an intermunicipal water supply and transmission system dated as of June 5, 1979; and WHEREAS, pursuant to said agreement each municipality agreed to pay to the Southern Cayuga Lake Intermunicipal Water Commission (hereinafter referred to as "Commission "), water revenues based upon, in part, a water rate schedule annexed as Exhibit I of Schedule A to said Agreement; and WHEREAS, because of increased costs, the Commission believes it is advisable to adopt a new water rate schedule in the form annexed to this agreement; and WHEREAS, Schedule A of said that the water rate schedule may without the written agreement to and June 5, 1979 agreement provides not be changed by the Commission such change of all the parties, • 1 U 339 December 20, 1995, continued WHEREAS, Exhibit I of Schedule A to said agreement has been amended from time to time since the initial date of the agreement; and WHEREAS, the parties believe it is necessary to amend Exhibit I of the Schedule A further; and WHEREAS, the parties are willing to agree to such change; NOW, THEREFORE, in consideration of the premises and the mutual undertakings of the parties pursuant to said June 5, 1979 agreement, the parties hereby agree that Exhibit I of Schedule A annexed to said June 5, 1979 agreement be amended effective January 21 1996" and that thereafter the Exhibit I annexed hereto is adopted as the water rate schedule for all purposes under said June 5, 1979 agreement. EXHIBIT I SCLIWC - BOLTON POINT WATER SYSTEM 1996 WATER RATE SCHEDULE EFFECTIVE JANUARY 2, 1996 RATE STRUCTURE: The flat rate charge per 1,000 gallons shall be non - fluctuating and equal to two dollars and fifty -five cents ($2.55). This rate is equal to one dollar and ninety -one cents ($1.91) per 100 cubic feet. The foregoing rate will be the rate charged for all regular quarterly bills sent after January 21r 1996. Actual or base consumption may occur prior to January 1, 1996, MINIMUM BASE CHARGES: Notwithstanding the foregoing rate structure, the following minimum base charges shall be applicable to the meter size indicated below, for regular quarterly bills sent after January 2, 1996. The table below shows the amount of water consumption that is permitted before the minimum base charge would be exceeded: Multiple Housing and mobile home parks of over 2 dwelling units, using a master meter, will be computed as follows: The quarterly master meter reading will be divided by the number of dwelling units and the water charge wi 1 1 be f i gured on this number as if the unit was individually metered. The water charge will then be multiplied by the number of units on the master meter and this will be the billing rendered. If the calculation of the water consumed per dwelling unit is less than the allowable consumption for a three - quarter inch meter, then the billing will be calculated by multiplying the- number of units on the master meter times the minimum base charge for a three - quarter inch meter (e.g., if there were 20 dwelling units on the master meter, and total water consumption shown by the master meter was 100,000 gallons, the Commission billing would be $510.00 (20 units times $25.50) rather than $225.00 (100,000 gallons at $2.55/1000 gallons).
